Topic: EAD for H4 Visa Holders

Sometime back I have seen a list of employee who filed H1's count wise. It was from USCIS. If anyone can find that file online please share the link. That may be more useful than just top 500 companies list. I am searching for it too.

Thank you buddy for the support. If you guys like this idea then please support by tracing official accounts of top 500 IT companies. We have the list in google. I am trying to find each Org official Id by searching for it in twitter and questioning them as why there is no support till date. If they pressurize government then there is a possibility of we getting answer. They have their own sources to reach them. It is first they who get benefited from H1's. I understand it is a win-win situation for employee and employer but looking at it in a larger perspective it is corporates who get more. Their participation should be there. Specially lets questions more those IT Companies who file lot of H1's every year.

I am interested in participating in Candle March. I was thinking about Candle light campaign in front of USCIS Local office. And Ice bucket challenge was suggested to grab the attention for response w.r.t H4EAD by one of our group members. Since we are doing it outdoor Ice bucket challenge may be difficult. Logistics will be concern due to non-availability of changing rooms there. I have come up with slight changes in campaign, I was thinking of relay torch kind of activity but with feet immersed in Ice. But we need people to join. They may be standing in ice only for 15-30 mins but someone will takeover. That way we will do it for long and upload the video to officials thru twitter, youtube etc., Interested participants in Dallas, Irving, Plano, Frisco, Arlington other nearby cities please respond in next 2 days. Lets do this next week on Monday. We will have time 2 days of time to let media know about this thru twitter. The same if can be done in front of other USCIS offices too, this will turn out to be big. Suggestions entertained.

I did not say all others please send your resumes. I have included myself in it. And above all I said, I have an idea. Suggestions entertained. If majority says a yes to it, we will implement. We are discussing what is the best way to gain attention from them to get response on H4EAD rule. We only want them to respond with specific deadlines instead of saying very soon. Since it is they who have asked for H4 stories we want to contribute to that. We do not want them to show sympathy by listening to our sad side of our story. We want them to see us as Strong, Capable, Qualified Professional who can contribute to society. That is the motto behind sending resume. Not to mislead them or start some fraud business.

Well, What I mean to say is we will send our resumes to help them understand our talent. Show the talent pool which is not being utilized. They are not trying to screen our resumes to interview us or help us find job. They just need to know the amount of untapped skill in various industries. And I felt it is not aggressive campaign but show the department the untapped talent. Above all, no one has to spend money. Our resumes are available with us all the time. It is just one click with subject line H4 Candidate Resume with . I am not expecting them to read the resume. Subject line will give indication of Talent. To make sure there is authenticity we are giving resumes. Just in case they want to cross check on sample basis couple of resumes they can always do that. In India, reference check is mandate and every Employer does give response for reference check. We are just giving the input on talent and offering them the option to authenticate. No fraud

Hello Smithusa,

Satish is not forcing anyone to tweet. He is only asking people and the interested ones are doing it. He is motivating by reminding us our target. Keeping us on track by not getting sidelined. There are few of them who are doing this job irrespective of hurdles created to non-supporters. If every H4 applying for H1 can get H1 then there will be no problem only. Do you know that there is a limit for number of H1's issued? Do you know how many H1's are taken by few corporate giants? Do you know that all H4's are not from IT hence there is a possibility that they do not qualify for H1 visa? If someone doesn't qualify for H1 visa that doesn't mean they are aiming at grocery stores cashier positions. Please give respect to H4's. They are suffering but not playing victim. Since deadline has crossed and there is no update from department we as stakeholders pushing for project to be finished. If you do not agree with our actions you are free to act according to your interest. We will not force you and Satish is not forcing anyone to do against their will. Only the one who is experiencing situation will know the pain. The one who is swimming against upstream is the only one who knows how difficult it is. Standing on the shore and giving advice is easy

No, H4's are given drivers license. I do have my license. It is just that it took 1.5 years after my wedding. I was here on 3rd day after my wedding. I have come on B1/B2 as we did not have time for H4 stamping. I went to india after 5 months and got stamping. But the Visa expiry date for just 7 months away and anyone whose visa expires in less than 6 months are not given Drivers license. I had to wait another couple of months to get the extension and after receiving extension i had to wait for my husband to accompany me to DMV office to get my license. As we do not have SSN our spouse is expected to sign off on our behalf taking responsibility. Texas does issue license to H4's. Process is difficult as we have to pull out time of our spouse from work hours

Hi Campaign Managers,

I have another idea. If earlier one is not feasible as we need crowd we can look into the 2nd one.

How about sending our resumes to Leon R, Jeh Johnson and all the other email id's we have? Let them see the kind of talent we have and they can always see how much value addition it is going to be for US. They will understand that we are not just from IT but cover various other industries & departments. We all have Education, Certifications, Experience, Appreciations etc., covered in resume.

What say?

Viral video is for sure a good idea. how do we make it? It has to grab attention. Just holding placards and candles for few mins will not be effective. I thought of actually staying there for couple of hours on a week day @ work hours. Since we will message media too about our plans they may cover few places if not all. What we can do is one from each group cover the video and combine all the videos of all participated locations and upload in youtube. It looks like we are small in number but we are covering majority of USCIS offices where our communities are present. Except for a candle we don't have to spend money anywhere else. For placards we can create them at home with boxes that come with shipping. We just throw them. Instead we can use them. We can use those boxes to create placard. All we need is a scissors, glue / sellotape, sketch pen / marker and a packing box. Cut the packing box big enough to write our message. Also cut a side of packing box length wise with small width to hold enough in hand, stick these two pieces. it is ready. All we need is transportation. I am sure if not all, few of us have 2nd vehicle and we can use them for commuting. If there is no 2nd vehicle then we can drop our spouse at office and get the vehicle just for one day as long as we have drivers license. We don't need vehicle from every participant. one in 5 will suffice the needs. As we are targeting only local offices, we will just have to pick up locals only. I don't think they will be more than 5-10 miles radius apart. We always drop our friends at their place or pick up friends from their place when partying. It is something similar to that. The only difference is we are trying to do something for our own community. That was my thought process. Suggestions entertained.

Topic: EAD for H4 Visa Holders

Hi, I found solution for our problem. We do not need any permits . I got inputs from this website www dot aclu dot org/free-speech/know-your-rights-demonstrations-and-protests. Please check this link.

Where can I engage in free speech activity?
Generally, all types of expression are constitutionally protected in traditional "public forums" such as streets, sidewalks, and parks. In addition, you may have a right to speak in other public locations that the government has opened up for unrestricted public speech, such as plazas in front of government buildings.

Do I need a permit before I engage in free speech activity?

Not usually. However, certain types of events require permits. For example:

A march or parade that does not stay on the sidewalk, and other events that require blocking traffic or street closure;
A large rally requiring the use of sound amplifying devices; or
A rally at certain designated parks or plazas.

Many permit procedures require that the application be filed several weeks in advance of the event. However, the First Amendment prohibits such an advance notice requirement from being used to prevent protests in response to recent news events. Also, many permit ordinances give too much discretion to the police or city officials to impose conditions on the event, such as the route of a march or the sound levels of amplification equipment. Such restrictions may violate the First Amendment if they are unnecessary for traffic control or public safety, or if they interfere significantly with effective communication to the intended audience. A permit cannot be denied because the event is controversial or will express unpopular views.

If organizers have not obtained a permit, where can a march take place?

If marchers stay on the sidewalks and obey traffic and pedestrian signals, their activity is constitutionally protected even without a permit. Marchers may be required to allow enough space on the sidewalk for normal pedestrian traffic and may not maliciously obstruct or detain passers-by.

What do I do if I get stopped by the police?

Stay calm, be polite, and don't run. Don't argue, resist, or obstruct the police, even if you are innocent or you believe that the police are violating your rights. In some states, you must give your name if asked to identify yourself, but you do not have to provide an ID or other paperwork. Make sure to keep your hands where police can see them. Point out that you are not disrupting anyone else's activity and that the First Amendment protects your actions. Ask if you are free to leave. If the officer says yes, calmly and silently walk away.

What do I do if my rights have been violated?

Remember: the street is not the place to challenge police misconduct. Don't physically resist officers or threaten to file a complaint. As soon as you can, write down everything you remember, including officers' badge and patrol car numbers, which agency the officers were from, and any other details. Get contact information for witnesses. If you are injured, take photographs of your injuries (but seek medical attention first). Once you have this information, you can file a written complaint with the agency's internal affairs division or civilian complaint board; in many cases, you can file a complaint anonymously if you wish. You can also seek the assistance of an attorney or the ACLU.

Do I have the right to photograph or videotape during protests?

Yes. When you are lawfully present in any public space, you have the right to photograph anything that is in plain view. That includes pictures of federal buildings, transportation facilities, and the police. When you are on private property, the property owner may set rules about the taking of photographs or video. Police officers may not confiscate or demand to view your digital photographs or video without a warrant, nor may they not delete your photographs or video under any circumstances. However, they may legitimately order citizens to cease activities that are truly interfering with legitimate law enforcement operations.

******Read more about what to do if you're stopped by the police, with special information for non-citizens.*****

YOUR RIGHTS
- You have the right to remain silent. If you wish to exercise that right, say so out loud.
- You have the right to refuse to consent to a search of yourself, your car or your home.
- If you are not under arrest, you have the right to calmly leave.
- You have the right to a lawyer if you are arrested. Ask for one immediately.
- Regardless of your immigration or citizenship status, you have constitutional rights.

IF YOU ARE QUESTIONED ABOUT YOUR IMMIGRATION STATUS
You have the right to remain silent and do not have to discuss your immigration or citizenship status with police, immigration agents or any other officials. You do not have to answer questions about where you were born, whether you are a U.S. citizen, or how you entered the country. (Separate rules apply at international borders and airports, and for individuals on certain nonimmigrant visas, including tourists and business travelers.)
If you are not a U.S. citizen and an immigration agent requests your immigration papers, you must show them if you have them with you. If you are over 18, carry your immigration documents with you at all times. If you do not have immigration papers, say you want to remain silent.
Do not lie about your citizenship status or provide fake documents.

IF THE POLICE OR IMMIGRATION AGENTS COME TO YOUR HOME
If the police or immigration agents come to your home, you do not have to let them in unless they have certain kinds of warrants.
Ask the officer to slip the warrant under the door or hold it up to the window so you can inspect it. A search warrant allows police to enter the address listed on the warrant, but officers can only search the areas and for the items listed. An arrest warrant allows police to enter the home of the person listed on the warrant if they believe the person is inside. A warrant of removal/deportation (ICE warrant) does not allow officers to enter a home without consent.
Even if officers have a warrant, you have the right to remain silent. If you choose to speak to the officers, step outside and close the door.

IF YOU ARE CONTACTED BY THE FBI
If an FBI agent comes to your home or workplace, you do not have to answer any questions. Tell the agent you want to speak to a lawyer first.
If you are asked to meet with FBI agents for an interview, you have the right to say you do not want to be interviewed. If you agree to an interview, have a lawyer present. You do not have to answer any questions you feel uncomfortable answering, and can say that you will only answer questions on a specific topic.

IF YOU ARE ARRESTED
Do not resist arrest, even if you believe the arrest is unfair.
Say you wish to remain silent and ask for a lawyer immediately. Don't give any explanations or excuses. If you can't pay for a lawyer, you have the right to a free one. Don't say anything, sign anything or make any decisions without a lawyer.
You have the right to make a local phone call. The police cannot listen if you call a lawyer.
Prepare yourself and your family in case you are arrested. Memorize the phone numbers of your family and your lawyer. Make emergency plans if you have children or take medication.
Special considerations for non-citizens:
- Ask your lawyer about the effect of a criminal conviction or plea on your immigration status.
- Don't discuss your immigration status with anyone but your lawyer.
- While you are in jail, an immigration agent may visit you. Do not answer questions or sign anything before talking to a lawyer.
- Read all papers fully. If you do not understand or cannot read the papers, tell the officer you need an interpreter.

IF YOU ARE TAKEN INTO IMMIGRATION (OR "ICE") CUSTODY
You have the right to a lawyer, but the government does not have to provide one for you. If you do not have a lawyer, ask for a list of free or low-cost legal services.
You have the right to contact your consulate or have an officer inform the consulate of your arrest.
Tell the ICE agent you wish to remain silent. Do not discuss your immigration status with anyone but your lawyer.
Do not sign anything, such as a voluntary departure or stipulated removal, without talking to a lawyer. If you sign, you may be giving up your opportunity to try to stay in the U.S.
Remember your immigration number ("A" number) and give it to your family. It will help family members locate you.
Keep a copy of your immigration documents with someone you trust.

IF YOU FEEL YOUR RIGHTS HAVE BEEN VIOLATED
Remember: police misconduct cannot be challenged on the street. Don't physically resist officers or threaten to file a complaint.
Write down everything you remember, including officers' badge and patrol car numbers, which agency the officers were from, and any other details. Get contact information for witnesses. If you are injured, take photographs of your injuries (but seek medical attention first).
File a written complaint with the agency's internal affairs division or civilian complaint board. In most cases, you can file a complaint anonymously if you wish.
Call your local ACLU

w.r.t permits I am unsure. I don't know if we need one. I am talking about small groups say 10-15 people as I am not expecting too many to join and we are trying to cover all those USCIS Local offices wherever possible. well, I don't even know where & whom should we approach for this if they need permit. I just wanted to make sure we grab media attention. If media guys are not present @ any the local offices on the day despite of messages we can carry one video cam of ours, shoot it, upload it in youtube, h4 visa curse blog and other places. Once video starts trending automatically we will gain attention from media and we can expect concrete answers. We need more inputs, need to brainstorm. This is basic idea I have come up with. we can always improvise with more and more people giving their inputs to make this success.

Hi Campaign Managers, How about we in small groups covering all USCIS offices where there is more local population on same day, same time with candles? Candles indicating we are looking for light in our life. we can hold pluck cards too. In TX we have 5 USCIS offices. Most of them are in the place where immigrants are. East Irving, North point drive Houston, Hawkins Boulevard El Paso, Four Winds drive, San Antonio, Street Harlingen, TX. We don't have to cover every USCIS office in country. We should send messages to news channels via twitter about date, time and location they can find us. If we can gather just 10-15 per member for each office we are going to cover that will be good enough. I understand lot of people do not participate and the most common reason could be no transportation. Why not we help each other. The one who has vehicle can come forward and pick up the rest who are in the same area. That way we will need 2 or 3 vehicles only and we can gather in groups. If we hold candles, pluck cards and stand there outside office without making any noise we may get attention. Since we will be sending messages on twitter to news channels and USCIS office, Leon R on Date, Time & Venue we may get some attention. What say? If 2 or 3 people will come forward to help rest with commuting in each area we will succeed. Let's show our Unity. If this is a yes, I am willing to pick up at least 4 or 5 people in Irving area and cover East Irving USCIS office. We can fix date & time based soon. We should send messages on twitter to news channels about this campaign for 2 days and then immediately implement it.

Thank you Mr / Ms IndianH4 for your clarification. We all are being soft here and we all know how to speak to an official. We are not kids. We are educated, grown up, matured professionals. No one is rude to any official and no one is using foul language. You are the one who is asking forum, "are you not aware of consequences of H4, why are you crying, blah blah". Yes, we are aware of it. We do all the home work before coming to US. It is not a option that we marry and stay away from husband. That is not our culture. We respect our parents decision and we try to keep family united. Secondly, if officials have proposed a rule then they have thought about it a lot. This rule is created long back. We gave our inputs on how good this is. There are always pros and cons. Weigh the option and take decision is what we said initially when they asked us for inputs. Any project you start there are risks as well as opportunities. Will you not sponsor a project / take a project just because you see risks? People analyze risks, try to minimize them, maximize opportunities and get more out of it and that is how a end product comes. This particular project has crossed its deadline. The deadline was not created by common man. It was created by officials of respective department. We are just asking them now as the deadline has crossed. We are the stakeholders and any stakeholder would love to know what is happening with a project. No one is forcing anyone to do anything. We are doing what we can in our limit. If you want to do something, go ahead and do according to your convenience and your interest. You do not have to object others. I said, thank you to the other guy and was politely declining his suggestions for now as it doesn't suit to our needs according to me. We are following what is best for us. You follow what is best according to you for you. If you are a H4 or was on H4 being a qualified person you will understand the stress. Else it is not that easy to understand. Every individual is different and their thought process is different, their stress levels are different as situations are not same for everyone. Being on H4 someone may be happy, someone may be restless, someone is unhappy. It is always different. Do not assume. Ask questions. Give suggestions. When suggestions are not considered, it is ok. It may be useful elsewhere. No one has intention of attacking anyone at a personal front.

Hi Nochange,

If you are under assumption that highly qualified and experienced people will settle for those low tech skills. Then you are for sure wrong. I personally will not take up any job that is less than my previous assignment. Do you think any individual will do those jobs being experienced in one field? We will look for those jobs where our expertise exists. It is not necessarily only in IT. It can be IT / HR / Mass Communicaton / Fashion Industry / Engineering and many more. Not every H4 is IT person and not every H4 is just a High School or Graduate with No experience. Most of them are qualified and experienced who have the capability to even start a business. So, please don't assume. We for sure will not take away those middle class jobs where low skills are required. I don't think a person who has experience in their field will leave that area and go to new area that too which needs low skills. Here we are asking for EAD to stay independent. Becoming independent is not just earning money. With EAD, we get SSN #. In US, for every thing SSN is the reference. Without that we are not treated like humans. With EAD the additional incentive is we get to work and that is where we can use our brains which are not being used much. We are used to process our process not just keep idle. With no work, we are keeping them idle. At least people like us are enhancing their skill utilizing this time by educating themselves in their field of expertise. So, please do not assume we will go for those jobs where we do not need to use much of brains. We for sure do not want to be a Barbie dolls in hands of others. That is the reason why we want this EAD. Stay independent, use brains for self and as well as for community. Even to do free service to community people need reference and obviously we will have no reference as we know none here. Everything is linked up to SSN and we don't get SSN without EAD. This is not just about work permit. If you understand Quality Terminology, do a fish bone analysis on this subject. You will see EAD is not just for work purpose. There are lot more things that will get solved with this one. This is the root cause for lot of issues and the linkage can be seen.

Hi IndianH4,

I don't think you have clarity the subject that you are speaking. You may have been tracking websites. Did you ever be in the situation of H4? Ok, don't take H4 visa to experience H4 situation. Just sit at home, don't go to work to earn. Depend completely even to buy basic necessities, change the location and go to a place where you have no friends and family a complete new environment and feel the experience. Despite of being highly qualified, lived independently and then now depending for every small thing on someone else (specially for newly weds who were working before wedding and now asked to sit at home) is the most cruel punishment. It is for sure slavery but at emotional level. Sit at home for 2 or 3 months and ask money from your family. Despite of being educated, talented, experienced and you don't earn the treatment given to you by people around you changes. We are not saying money is important in life. But people around you change. That is the fact of the life. Specially when you have to find new friends it is much more difficult. In school, college, workplace while making a new friend you talk to multiple people and you choose very few as your friends. Whom do we get to talk here? Neither we can go to work place nor to any other place as we are dependent even for commuting. Without SSN, it is difficult to get Drivers license too (I did not say impossible). For me it took 1.5 years to get drivers license after relocating to US whereas I was a person who was completely independent driving my own car earned by me for last 10 years, had my own house, working and earning a 6 figure salary in India monthly. You can never feel the emotional stress we go thru. Few years ago there was a great man in this country by name Abraham Lincoln. I don't think you know him well or probably you know him, but you can never walk in his path. Forget walking in his path, you will never want to see anyone walking in his path to support humanity. You are jealous. Yes, we all know when we were taking flight to US that we will be housewife. But we also had hope that we will soon get green card as our spouses green card were already in process. The long wait is making us wait too long to get our GC's. Even back in old days, Slaves new that they will be slaves and will have a bad life, but did they have a choice to not to become slaves? No. Similarly, once we get married do we have a choice to leave husband and stay in India just to work and be independent? No. Come to reality. Every other country offers work permit to spouses except US. It is like legal slavery. US law says we are against slavery and we will do everything to abolish it. Check US government websites once. You will see that this month it is dedicated for National Slavery, Human Trafficking Eradication. So, before you express your views, do complete research. don't do half work and spread negativity. If you cannot do good just keep quiet. Don't do bad at least.

May be, we should get our post in reddit. Does any of you remember Boston bombings recently? When someone in reddit posted a picture of some missing asian stating he is responsible the whole media gave attention and started confirming without any evidence that they found culprit and he is the one. A news which was not good for that family but the way media attention was really big. Finally, that family came out clean by God's grace and support of FBI until then every media room was speaking only about this person. That is the level of publicity reddit got for that case. May be we should try and attempt thru reddit. Not just that scenario there are other scenarios too which got publicity thru media just because they were trending in Reddit

Hi All,

I have one suggestion. Not sure if it is good, bad or worst but would like to share and take opinion from you all here. Why not all H4's who are highly qualified and sitting at home idle due to Visa status send our resume (word document) attached and in body of the letter mention the overview of our skills, education & number of years we have been wasting our skills due to non availability of work permit. May be they will get an idea of the kind of skills and number of people looking forward for this Rule to be cleared. We should also state that they can verify our experience with our ex-employer (verification check) which we generally let all Companies do when we attend interview and get selected for a role. That way, random sampling or 100% sampling will help them understand that the kind of expertise they can capture and utilize to increase US Economy. We should send our resume's to the list of OIRA members (whoever Email ID's we have). This may have positive effect on quick decision making due to facts in hand with them.
