I should certainly inquire about the future effective date for H4 COS when applying with H1B.

Just one followup question with your first statement

I think you can apply for H1B extension + COS with future date +EAD ( note there is no option for EAD "future" date). The idea is that if your H4 COS is selected for future date, then EAD should be valid from that date.>>>>> My wife should be able to continue working with her H1B status intact until that future date when EAD becomes effective? And provided we have EAD card in hand, her status will magically change from H1B to H4+EAD on that future date.

Hope everyone is doing well and getting ready for the holiday season.

I wanted to ask few specific questions about the future start date option for H4 EAD.

My wife is currently employed and holds a H1B visa. I am applying for my extension in PP and planning to apply for my wife's H4 EAD at the same time. As per my knowledge even if USCIS approves all 3 applications (H1B extension + H4 COS + H4 EAD) at the same time, technically the H4 EAD seeker can not work from the date of approval until the physical EAD card is received.

How much time generally it takes for EAD card to arrive after the approval of the case?
Will this time GAP between case approval and card arrival be an issue in her current employment and work status?
How a specific future start date for H4 EAD helps to mitigate risk of any possible employment GAP?
Will she be able to continue her work and maintain her H1B status until the effective start date of H4 EAD, even though her COS is approved?

Your response is much appreciated.

This is a big big thing, guys.

Remembering the hardship that me and my wife had gone through in last 4 years, it feels like this news is going to wipe out all the darkness and uncertainty that has been lingering around.

Another reason to be even more joyful is, 'Oh law firm' mentioned below,

If one has left with some sense of what is humane and what is not he or she need no counselor or a philosopher to open their eyes and broaden their minds. But unfortunately that sense of humanity is so dead in such folks that they see no good deed shall benefit a single soul if there is nothing in it for them.

Nope I may have my spouse do H1 (if decided to work) and be independent by self >> Don't you think the first half of your sentence contradicts the other half. "I may have" who are you to decide what one may or may not have - master of a slave? and yet you talk about giving independence in the second half of the sentence. How hypocrite.
Don't you think it ought to be her choice to decide what she wants?

In case this rule passes, which it will for sure and off course without your support, I hope you will be man enough not to avail its benefits.

I better log off now if I want to ignore such ignorant comments. Ignorance is bliss.

OMG...That guy sounds so scared of office politics. Looks like someone in his team made his manager to spank this guy in front of his team mates.
For some reason he thinks that H1 folks will hire their spouses, who now have EADs as if their forefathers own the Co they work for.

I love such blokes who hang their ignorance and greedy nature on the empire state for everyone to see.

If you are looking for a definitive answer to your own confusions, then do one thing.
When you go home today simply ask your wife if she wants to gain an immediate right to work and earn OR wants to sit at home idle for uncertain number of years waiting for green card.

We will be waiting for your answer.

If she wants to utilize her talent and education and decides to use this opportunity, we want to see at least 2 comments in support of this rule. If she is happy to be in house arrest and wanna give up on her financial freedom, I would say this rule is not for such individuals and don't even bother to support this rule.
In either case you will be able to put an end to your confusion.

Hope you would not mind my direct question.

I am in a similar boat as yours.
Just got this question, How one can verify whether he has been extended under AC21. I am in my 8th year and changed to a new employer when I was in 7th and had approved I140 from previous employer.

Does I-797 notice mention anything about AC21?

I guess your spouse shud be able to maintain EAD as long as the last I140 is not revoked. Because any GC application is for future employment and the process does not stop even though you leave the employer that had filed your I140.

As we discussed yesterday OMB will still be reviewing the public comments and providing the final approval - source http://www.immigration-law.com. That means, OMB part is not over yet and we should still be in touch with the officials who showed interest in our cause.

To me it sounds like, whatever may be the reason (political or fairness) DHS and OIRA/OMB understand the importance of this rule and are all prepared to implement it. We should not give them any opportunity during this commenting period to think otherwise. Certainly there would be some annoying and insulting comments from conservatives and anti-immigrants, but we should not engage in any kind of nasty arguments. Bittrness in the words does not change anything but truth can certainly create an impact.

I think that followup meeting you guys were promised of is still crucial for us. In light of the recent developments, we can change the timing of that meeting to a week or two after the commenting period ends. We should not lose touch with OIRA/OMB officials even though we see some progress. I am sure someone wud 've sent a 'thank you' email to the officials you met.

In my understanding OMB has cleared the pathway for this rule to move forward. But the public comments that will be posted in the next 30-60 days will still be reviewed by OMB. Based on which the agency will decide whether to finalize it in its current state or amend this rule further or stall it just like it has been for last several months.

Feel free to correct me if my understanding is based on a false assumption.

According to Oh Law Firm its still a long way to go. We should not rest once the rule opens for public comments.

We cant change how certain pessimists think of this rule but certainly we can direct our reponses/feedbacks/emotions/arguments/challenges towards OMB during this commenting period. Though OMB is the one who will be deciding the outcome of this proposed amendment, its our responsibility to help it understand how important this rule is for us. Half of the battle is won but we still want to make every effort to help the agency realize what will be the economic downside if this rule sees no end and if implemented how this will enrich the state of US economy.

I see its a nice tactic from DHS to propose this rule in such a way that it will benefit a huge number of H1-B population than it was expected earlier. I guess DHS has kept some buffer just in case it has to amend this rule should there be too much noise from conservatives and anti-immigration groups. Such greedy individuals will definitely make every attempt to jeopardize the implementation of this rule to its fullest extent.

Having said that I am not trying to curtail any hope or excitement. To make sure this rule gets implemented as stated everyone must offer as much support as he or she can. From the bottom of my heart I want this rule to be implemented for each and every H-4.
