Topic: 3 Year Degree (Let's try to evaluate approval/denied reasons)

I have a 3 year degree and my attorney filed under EB2. Got an RFE and got it denied. My denial notice specifically states that I am entitled to EB3.

Mine was Document mailed to applicant, when we got the RFE. It never changed back. I saw the hard LUD and inquired with the employer/attorney and realized that they have received the denial notice.

Topic: Unusual situation

My attorney received the denial notice for my I-140 petition on July 4th. It is due to my educational equivelancy. It was stated that I do not qualify for EB2 and entitled to file under EB3. Online status changed to "Document mailed to Applicant".

We sent in MTR asking them to downgrade to EB3. We mailed it on 15th August. Today, my attorney mailed me saying that she got the MTR package back stating that as per USCIS, my case is still not denied.

I actually have the denial notice sent to my employer in my hand. Wondering what USCIS doing and where it went wrong. Don't know whether it is a denial and they made a mistake in rejecting the MTR or they made a mistake by denying the I-140. Do not know.

Any thoughts on this please?

Topic: I-140 Denied due to Education - HELP NEEDED PLEASE

I had similar problem. 3 year degree with a lot of experience. My attorney filed under EB2 and got the denial notice on August 4th. However, we sent in MTR to downgrade to EB3. Today, my attorney wrote back saying that she got the MTR pack back from USCIS stating that according USCIS, the case has not been denied.

I am very much confused. What is going on? Any idea please?

My I-140 got denied. We are filing MTR. My PERM was approved in July, 2007. I was wondering whether I can file another I-140 while the MTR is being processed. My attorney mentioned that the PERM has expired as it has been over 6 months. I am just trying to explore all options I have.

Topic: Changing from EB3 to EB2

My I-140 got denied last week.

Throughout, I kept telling my attorney to go for EB3 as I have 3 year degree. She insisted that we should try EB2 as it is current. Got an RFE with regard to the education and affordability to pay.
Last week, got the denial notice. Came to know this today.

My labor was approved in September 2007 (180 days passed).

My question is,
Can I appeal/MTR by stepping down to EB3? Will this work or I need to start the PERM and go from scratch?
