Yes. Applying for AP however is your choice and it does not automatically go with EAD.

If you don't have EAD and are laid off on H1 you have limited time to switch to another job on H1 or else you must leave the US. In that case your 485 may be in jeopardy as well.

Please understand the importance of EAD. Many people don't see any value in it and think of saving money, but it is like an insurance policy.

The short answer is no. Also she can get OPT later on.

There is not a case in your profile so I can't tell more about the fees. The new 485 application fees don't require EAD fee anyway even for renewals.

I had an opportunity to talk to my lawyer just last week. He says USCIS is operating in go slow mode. He also expected things might change for better in case DHS leadership changes as Obama may do reshuffle.

Guys,

Once you saw on the USCIS website that your EAD is approved, can you immediately start the work right away on EAD or you need the real physical EAD card in your hand before you start your work.

You would the physical card in your hand because someone in Employer's HR would have to verify and sign it sayign that they verified your employment eligibility proof.

Topic: Linking the EB dates


Dear Wtng4Ever ,
Mine I-485 was processed from Nebraska service center. Below are the details how the events happened:

Eb-3 I-140 approved in Sepetmber 2006 (TEXAS)
July 2007- filed the I-485 (NEBRASKA)
Pending EB-2 at backlog got approved some time in August 2007
applied I-140 in september 2007 (Texas)
I-140 approved in July 2008
Interfiled at NEBRASKA in August 2008
therefate called USCIS customer service about 10 times in two weeks period.
Issued RFE in October regarding Birth certificate in October
November 5 submitted the affidivit
Nov 13 got approved.

Topic: Linking the EB dates

First of all Congratulaitons!

My situation could be similar to yours so could you please share your application locations with me. Here is my case:

Approved I-140 with PD April 2007 at Nebraska in May 2008
Pending I-485 concurrently filed in July fiasco, at Nebraska
Approved I-140 with PD Oct 2001, at Texas in May 2008

Following a PD Capture letter from the lawyer, USCIS Nebraska asked us to file I-824. When we filed it to them, they internally forwarded to Texas. The TSC issued a SRC number for the 824. Not realizing why NSC asked us to file 824, TSC misinterpreted the I-824 and instead sent us a duplicate copy of old I-140 (thinking I-824 was request for I-140 copy). (I guess TSC did not know why the I-824 was filed.)

Now I am thinking of sending a letter to USCIS myself but don't know which center to send it to -- NSC where 485 is filed OR at TSC where old I-140's was approved and who can also request a visa to National Visa Center based on Oct 2001 PD.

Any thoughts or inputs would also be great!
