Topic: H4 visa interview while I795 pending

My spouse H4 EAD is pending for 2 months and now traveling to india and H4 visa stamp is expired. We have to go for H4 visa stamping interview. Is that Ok while EAD pending ?

H4 is not work visa but with H4 EAD , it does allow to work. So it will be dual intent. Will create any issues with Visa interview process ?.

I've two approved I140 from Company A & B and also completed 6 years.

Early 2011 - Company A's I140 approved.
Early 2013 - Moved to Company B with H1 extension for 3 years (based on A's I140)
Early 2014 - Company B's I140 approved with same priority date of A's PERM.
Late 2014 - Completed 6 years on H1.
Early 2015 - Company C gives good opportunity and willing to transfer H1 and do PERM. They mentioned they will use Company B's I140 to get 3 years extension. What happens if Company B withdraws I140 (not as fraud) ?. Can company C file PERM and recapture priority date of Company A's I140?.

I'm trying to understand what are the benefits to person like me in the GC queue. My PD is Dec/2010 from Company A with I140 approved. Later 2013, i changed company and got I140 with same priority date. Other than spouse can work, is there any other benefits who are standing in queue at the stage like me (I-140 approved)?. If i change a job in a month, will i miss any benefits ?.

If Company B does not sponsor Green Card application, can company B extend my visa after my current visa expires in 2015 (as they would have taken over my H1B by then) ?
If Company B can extend the H1B application, then is there any caveat to it ?

Ans1: When you transfer H1B, say 2014 (August) you should able to till 2017(August) based on your current I140.
Ans2: I don't know if your company B doesn't do GC, will you able to get another 3 years after 2017(August). I believe that's possible as long as your current I140 is valid and not revoked due to fraud.

In order to continue the Green Card application process, does Company B need to redo the PERM application and so forth?
Are there any other consequences / impact of such a move that I need to keep in mind?

Ans3: Company B should start GC process ASAP. there shouldn't any issue as long as your roles are similar to use current I140 date. If you are engineer and moved to mgmt/product marketting area, in that you may not able to port ur current i140.


I moved from company A to company B and used company A approved I140 to get 3 years when joined company B.

Thanks all.

I consulted lawyer and they said, you are allowed to have only one status at any time. I will need to file H4 OPT. A letter from college saying, that I've currently enrolled and completion date. This will prove, I've maintained my current status.

Hi,

I've valid H4 797 notice of approval with validity to Jan 2016. I did COS to F1 on last year August and got it approved and been in F1 for last one year. I'm wondering if my H4 is still valid and if f1 expires after school (by aug 2014), do i still need to apply for h4 cos ?

I was on H4 till August 2013 with I797A which is valid upto Jan 2016. On August 2013, I got my F1 approved via I539 COS and got new I797A with new validity but same I94 number on bottom. Right now, my courses are getting cover in few more weeks and I wanted to go back H4 instead of OPT. My questions are,

1) My old I797A of H4 validity is upto 2016. Does it mean that, I no need to file H4 I539 now ?.

2) If I need to file I539 COS again, what are documents required from my university to show my current status.

I've I-140 approved my previous company(X). Currently I work for company(Y). Using X company I-140 approval, I got 3 years extension when I transferred H1 to Y company. My question is, Can I transfer my H1 to Z company and extend for next 3 years based on X company I-140 ?. Is there any restrictions ?.

Assuming CIR passed, regardless of India's policy, i guess most of the Indians will be current in one year and get green card.Then it doesnt matter if H4 can work or not. It may be just that one year wait. Isn't it ?.

thats correct.

I got same info (i140 application copy which has stamped saying its approved and PD, etc) via FOIA.

I got 3 years extension (beyond 6 years - my stay in us is only 4 years. so i got 1 year more from current date if you look at it) when i transferred my visa. Even though my lawyer said, they need approval notice, having i140 application copy has everything which is there in approval notice. (info in the i140 application is more than i140 approval notice).

I had 2 years left in my initial 6 years. Based on I140 approval, I got 3 years of extension.

When company files for extension, they have to request for 3 years extension and mentioning I140 approval & copy of I140 along with that.

I've a question on H1 transfer while H1B extension under processing.

My company has filed my H1 extension and its pending in USCIS. Based on my I140 approval, my current company have requested +3 years. I've have been in US only for 4 years and I've 2 more years under total of first 6 years.

If I do H1 transfer to other company, Will the new company able to get +3 years based on my current I140 approval even though I need restart my PERM after joining new company ?
