My H1-B visa extension got approved today from Nebraska center (beyond 6 years). These are the details -

Mode - Regular (based on earlier I-140 approval)
Filed - Nov 03, 2017
Employer - Full time (no client or vendor)
RFE - No
Approval received - Feb 07, 2018
Approved till - Apr 2021
Time taken ~3 months.

Does this mean anyone who is on H4 now and has filed for H1-B in the past but was rejected or not selected in the lottery is not eligible for EAD? Can someone please explain this?

Topic: Which state is best to settle down in USA

Tampa is unbearably hot and humid for 9 months a year. There is a constant threat of hurricanes and sinkholes damaging or destroying your house. Humid weather also creates problems like mosquitoes and other insects. Not many jobs in Tampa Bay area. Lived there for a few years, hated it. The only good thing about that place is proximity to beaches (if you like beaches) and Orlando (and the airport is awesome - large and well maintained). Housing is affordable all over FL except for maybe Miami and few other places. Crime rate is also high in Tampa.

In the battle between pro-immigration and anti-immigration people it is the legal immigrants who are caught in the crossfire. Separate legal immigration reforms from the undocumented and border security issues. Since both parties more or less agree on reforming the legal immigration system take that up first. Build a consensus and meet each other half way. That is the way to get out of this analysis paralysis situation we are in.

As chances of CIR get dimmer by the week EAD for H4 by rule making process seem more likely. This will lead to a funny situation wherein dependents of primary visa holders will have greater freedom in employment than the primary visa holder. Still something is better than nothing.

This would mean all H4s who have initiated the GC process (filed labor) but would still leave out H4s who are waiting to file LC or those who have no intention of doing so. Still this rule if implemented would help a lot of people who have been waiting for a long time (in some cases 5+ years).

The original bill had a clause that granted EAD for H4 visa holders only from nations that granted the same to their immigrants on similar dependent visas. Sen. Hatch added an amendment that removed the reciprocal clause but left the option open to deny EADs for some based on the recommendations of the Secretary of Homeland Security. Now if some nation for e.g. India grants work visas to dependents (X visa) of people on employment visas (E visa) then it will be possible for H4 visas holders to get EAD. In short this arrangement is a win-win for both X visa holders in India and H4 visa holders in US :) The only issue I hope is sorted out is X visa holders can not work on X visa in India, they have to get an E visa. US already has the H4->H1 option. SD might not consider this X->E as reciprocal arrangement.

If this is true then H4 people from India will become eligible for EAD even if there is a clause in CIR for reciprocal arrangement from foreign governments. This is good news for for all (H4 visa holders and X visa holders).

The bill has not passed the senate yet but the key amendment for BS has passed. This will make it easier for Republicans to support the bill in Senate. With regards to your question regarding reciprocal treatment on EAD for H4 read this -

Yes. As per the Hatch amendment there is no requirement 6 years on H1 or even of filing for GC. In short it will be the same as L2.
