Had attorney representation.

Interview time at 10:00 am and called in around 10:20 am.

Officer asked us to accept the oath.

Verified my details on applications.

Verified details like the first time I came into the US, the last time I came into the US.

Verified all H-1B approval copies... Note they already had these with our application packet. Asked whether I had ever been out of status and I said No.

Asked me whether i still work with the employer that submitted the 485 application and I affirmed. Took latest Employment Verification letter. Took latest paystubs. Took 2007 Tax Return copy and W-2 copy.

For wife, officer initially asked for proof of status for entry into the US uptil point of H-4 petition submission for her. She came to US in July 2003 and her first H-4 petition was not submitted till December 2005 (those of you whose wife came through H-4 initially to US will understand why this is the case, this is not the case for people whose wife was already in US before marriage). Officer took copy of her 1st H-4 visa as proof of this. Verified that she had been in status.

My wife has birth certificate affidavit from parents. Her birth certificate is handwritten, looks like an affidavit itself :) and does not have her name in it (hence the affidavit was required). Officer was wondering why we don't have non-availability certfiicate from India and then realized that one of the items was the birth certificate. Whew!

Asked us if we had any kids. Took birth certificate copy for our son.

i think that was it.. officer gave a hint that everythign is ok and he was going to make a decision in the afternoon but then checked records and found that my prio date is not current. Said i will have to wait till date becomes current.

congrats for interview notice..I saw that in AOS tracker..Did your case change to "pending in the office where transferred" and when?
Did you get any LUDs recently because my case was transferred to NBC around your case transfer and I got 2 LUDs on 10/9 and 10/10 but have not received interview notice yet!!



Thank you ls521. I hope you saw my response to your question on the AOS Interview tracker. my online status is still : Case transferred to NBC... blah... jurisdiction over the case. My last LUD is that. no soft LUDs after that. this is the very next intimation i have had from them. so it was a surprise.

Good luck to u. I wish there was logic in the way these things work but unfortunately no.

Because if it is still like this,I would feel better because we are at the same boat(my case was transferred almost the same date of yours from nebraska to NBC)

:) ok I guess I did not specify... I had an infopass appointment last week and the IO told me that my case was received at NBC on August 26th (it got sent on the 19th)... my Congressman office also replied to a request I had sent them with the same information.

An Infopass appointment, or your local congressman will definitely be able to get this information for you. My application was received at NBC a week after transfer, but no change in status though.

arunarch, when is the soft LUD on your 485 and 140 ?



latest soft LUD on my I-140 : 7/28/07 (last year)

latest soft LUD on our I-485 (mine and spouse) : 8/5 and 8/6/08 (after this I have hard LUDs on 8/19 for the transfer to NBC)

my case is also I-140 approved in Texas and I-485 in nebraska. well, not anymore because they transferred my application to NBC.

RESIDENCE OR TO ADJUST STATUS to our NATIONAL BENEFITS CENTER location for
processing because they now have jurisdiction over the case."

Topic: EAD CPO IS IT GOOD OR BAD

they are independent applications. It does not say anywhere in the EAD application that if your I-485 is close to approval, they won't grant you an EAD. that would be too much of a gray area for them.

I believe it is when your case is 30 days outside PROCESSING TiMES reported before you can contact USCIS to raise an SR ...
