Topic: when will be november processing dates releases?



A big time bullsheet. my 140 is pending for over 15 months (eb3, nsc). if they are saying that previously it used to take 6 months and new goal was 4 months and they are meeting the goals, where the fcuk is my 140??

and am i the alone person lost in this space with my 140?? what the fcku?

Topic: I-140 approved, intend to change jobs


I have not filed 485 yet (pls see my profile). All I have is the labor application form (before submission) and copy of approved 140. Again coming back to my questions - what are the consequences if employer revokes 140 after I leave :

1. Would my H1 be at risk, since I'm on 3yr extension after 6yrs - even if the NEW employer has applied H1 extension.
2. Can I retain the PD with NEW employer if NEW employer apply GC before current employer revokes 140 ?



to the best of my knowledge, you cannot. if you are on h extensions, it cannot be extended by new employer if aos is not applicable. in your case, aos is not applicable since 485 has not been applied. new employer cannot keep old pd. yes, you run into serious problems if your previous employer revokes 140. ac21 does not apply to your case.

i am not a lawyer but i am here struggling for gc for 11 years so know this a little bit. you should consult a lawyer before making any decision..

Yes, I'm aware - but my question is if the NEW employer starts GC process (with the old PD) BEFORE current employer revokes I-140 does it have an impact ?



new employer need not file new gc process. you have your own labor (if not, take it from previous employer). if your 140 is revoked by x employer, but you have 180+days with 485, then it has no effect as long as your new company has sent ac-21 details in its entirety, otherwise you should expect noid via your x employer. if your x employer throws that paper in garbage, then eventually 140 gets denied and you need to file mtr.

if your 485 is pending over 180 days, then x employer can do nothing. his attempt to revoke 140 is a waste of time/money for him and some additional work for you.

my daughter is already 6 months old. when she is 21, she will put my file and I will get GC with family category, i think that will be quicker than this wait... i just have to hang in with my h1b extensions for another 20.5 years like i have been for last 11 years..

no big deal, economy is booming, my company is doing exceptionally well and i am getting along with my mgr so nicely that she has already given job security letter until my daughter gets me the GC.

Topic: is it okay to file for divorce while dependant I-485 is pending



I haven't been the good wife to my husband. I scold him everyday for something or the else. he makes me to scold.
anyway, things aren't going well between us. I am not sure if I would like to get divorced so I can avoid scolding or fighting with him.

What will happen to my pending I-485 if I file for the divorce ? he got the gc I am the dependent and still waiting.
got married in India, so anyone has any idea how long it will take to complete this divorce process.
does it impact my pending I-485 as soon as I file for the divorce ?



sorry to learn about your married life. gc and married life are two issues. which one is bigger? i do surprise when i see that people put more wt on gc as compared to married life? what do we get if you have gc and screwed up married life - no other half in life? i think you two have more important issues to take care before even thinking about gc. think over it for few minutes peacefully and may god give both of you courage to come out of issues positively. this is a red flag for many couples standing on a bleeding edge due to gc.

regarding I 485, I am not lawyer but my educated guess tells me that if your husband is primary and has recd gc and you are waiting then it depends on him. if he revokes your file - your process stops. if he continues - you get it. dont file divorce in US and probably uscis never knows about you two getting seperated. once you get gc then you can file for all these and both will be ok legal status wise.

Every week goes by..... Monday starts with hope and despair..
Friday closes with dissapointment.
I am really frustrated and tired, checking the status of I140.

When will I see the light at the end of the tunnel?



you will get it approved when you least expect it, and you no longer remain interested about it's progress, when you truly start believing in "don't care, what the heck, I am more interested in going back instead of ruining my family life" about GC.

So, sit back, relax and concentrate on attaining that stage and you will get it. more you run after it, more it will run away from you because its speed is more than your thought speed. let it change it's direction and greet you!!

I am in the same boat as yours and have started attaining that stage.. still miles away from fully achieving it... good luck, god bless.

Letsthink: I have called 1-800 number (USCIS) and walked through the Customer Service Rep as well as IO about this thread and your details have been captured. I have also explained the complete case and I was told that they will verify the details about recent approvals matching with yours and take necessary actions against such act.

Luckily they were well aware of such activities by applicants and have already taken actions against it (if you are not aware of.. from different websites,sources. The reason given is: USCIS wants to be much more stricter than it used to be).

Enjoy your day. If and when beer drops out of your head, start talking with your lawyer to save your case. Good Luck.

I have a great solution to the housing problem. If any foreigner residing in the US currently purchases a (foreclosed?) house that is between 85k and 500k (depending on the location), between now and 12/31/2009, the person will be granted permanent residency. I think this alone will stop continued housing price slide and revive the US banking system and the US economy.



yeah sure.. and yet again there will be categories..

399,999 and above home - EB1 NIW
299,999 - 399,999 - EB1 Regular
199,999 - 299,999 - EB2
85,000 - 199,999 - EB3

OOPS... I will still be in EB3 since I have paid most of money to this government in processing my existing EB3 case!!


Bush has all time low popularity and we are talking about great depression (extended extended recession is depression - if i am still reading the same english) so why not furthering this bill by:

who ever wants to be a permanent resident:

1. must give 2 years of service in IRAQ before applying. More years of service makes you higher in preference. For country of chargeability like Indian/China/Mexico - this is minimum 5 years.
2. must build 10 miles fence across the border to help preventing illegal immigration. Again, India/China per family will build at least 25 miles.
3. must help USCIS for 6 months in arranging their paperwork properly so that cases are not misplaced. if you are software engineers, you can help with their computer system. same rules for india/china.
4. different tax brackets for permanent residents.
5. A real teasor: if you default with your home loan/tuition bills - your existing citizenships and/or residency to this country will be revoked and you will be no longer US Citizens or Perm. Residents.

US needs all above to become number 1 again. The glory is gone and the future is faded..

forget about all these... I am just concerned because I am opportunistic like most people here and came here in search of a better life.. I see my dream is becoming an illusion in bush regime.. I seriously don't care about where this country is going anymore.. more than what it has given on positive notes, it has given mental stress and disturbed family/social/financial life..

US wants to stabilize it's own economy and that is why such a stategic propoganda is made public. Rabaxy has proved it's potential in the global market which is what bothering US.
