Topic: Pending I-485, travel on advance payroll

in the past i heard of UK and Germany being trouble makers.
i used to email or call the consulate of the transit country to double check and also the airlines.
my flights were usually direct but some transits were through middle east with no issues..

Topic: Reason for 485 Inventory not coming out?

haha . Mars is a long way to go as of now . as of now i say . Elon Musk wants to send us all there soon . sooner than we expect.

ok jokes apart. sometimes in the past there have been instances where the inventory is not released that often. this is an indicator of things not moving fast and also due to political impacts (as others have mentioned earlier) . usually at times of the shift in presidency and also leadership changes in USCIS and DHS things like the inventory are not released until the departments are back on track under new leadership guidance.

Topic: What will a Trump Presidency Mean for Immigrants?

all we immigrants have done till now is, as the article mention, “We don’t really know for sure!” and i say "its all a waiting game".

rules have been passed, some good and some bad. we have had good times and worse. hope for the best.

Topic: I-485 July 2016 Filers

the go in to the queue FIFO. thats just for the first step. but once the processing start it depends on a lot of factors, incl service area, case complexity, worker (some are fast some are slow just like all of us), speed of background checks, fingerprinting verifications etc etc etc.

Topic: I-485 July 2016 Filers

dont look too deep into the dates. some times old cases that are complicated, even if we think its straight forward, take a while. it also depends on the service center and the workers who are processing the cases. mine was a similar case :) but hang on and your turn will come.

Topic: 485 medical expires again

I have seen cases that get stuck at the RFE even after medicals have been submitted. best option at this point would be to open an SR with USCIS on the case status, give them a call no harm in that. Also DO open a case with your local representative, go to their office in person if close by.

dont submit addl information if not asked. that may complicate your case.

Topic: Question - switching job after I-140 approval EB2I - Urgent

yes your current employer can revoke i140 its theirs. but if its been approved, you can always port the priority date. make sure you have a copy of the approved I140. THATS A MUST.

pros -
. better job better salary better life.
. carry over pd

cons -
. big thing is you will have to go through all the perm , i 140 thing again .
. make sure your H1B is still valid for another yr or so ie you are not hitting ur 6 yr mark soon. else its a whole different story.

consult a lawyer if you feel your case is a complex one.

Topic: Outside US for more than 6 months this year - POE Options pls

this is a tricky situation. consult a lawyer. it can count as misuse of re-entry permits, if you keep going out every month and back after 5 months.

Topic: Sad news from Oh law firm

Late08 to Early09 seems reasonable. Based on past stats and usage.
There is a possibility that closer to the end of FY the dates may be moved even further to Mid09 to gather applications of those who missed last time (remember when it went till Mid2010). But chances are less.

Topic: Mass RFE

I know getting an RFE sucks , but based on last 2 yrs of statistics a mass RFE does signal a significant movement.
keep your fingers crossed, hope you dont get an RFE and if you do respond asasp and all the best.

Topic: Mass RFE

Question 1:Do I need to attach send any thing else? Do I need to write any letter explaining/summarizing EAD start & end dates, AP start & end dates, H1B Extension start & end dates, etc.?

A cover letter is always helpful.

Question 2:
Do you know if I will be able to get Delivery Confirmation & Signature Confirm from this address?
What do think is the best option to mail the RFE Response eg., USPS, UPS, Fedex, etc

Signature confirmation at a POBox is useless.
You will get a deliver confirmation from any of the carriers. make sure you do select that options.
You can use any of them, just make sure that you send the response way ahead of the deadline

1. many recommend 6 months, no law but a cautious approach.
2. yes you can. as long as you dont have any non-competes with either employers.
3. no waiting period for part time empl.

Topic: When can i apply for EAD?

the flow is job > file PERM > file I140. PERM determines your priority date and EB1/2/3. once PD is current for your EB1/2/3 level you can file for 485 and EAD/AP.
current PD can be found at http://travel.state.gov/content/visas/english/l...

as karthik said .. if you care looking for EAD for H4 , still a long way to go for that to become a rule or a law. dont keep hopes on that. EAD through employment based (or family) GC is the only option at present.
