The following is part of the note with the Oct. VB. Look at the "2)".


E. EMPLOYMENT VISA AVAILABILITY

Item E of the May 2008 Visa Bulletin (number 118, volume VIII) indicated that many Employment cut-off dates had been advancing very rapidly, based on indications that the Citizenship and Immigration Services (CIS) would need to review a significantly larger pool of applicants than there were numbers available in order to maximize number use under the FY-2008 annual limits. That item also indicated that if the CIS projections proved to be incorrect, it would be necessary to adjust the cut-off dates during the final quarter of FY-2008. The CIS estimates have proven to be very high resulting in: 1) the “unavailability” of all Employment Third preference categories beginning in July, 2) the “unavailability” of numbers for China and India Employment Second preference adjustment of status cases during September, and 3) the establishment of many October Employment cut-off dates which are earlier than those which applied during FY-2008.

Little if any forward movement of the cut-off dates in most Employment categories is likely until the extent of the CIS backlog of old priority dates can be determined. It is estimated that the FY-2009 Employment-based annual limit will be very close to the 140,000 minimum.

Topic: EAD and fingerprinting

I submitted 485 last August, and did FP on last November or Octorber.
I applied EAD and received the EAD card this May. No FP requested and "Fingerprint not availabe" printed on my card.



Yes once you file the EAD application you will be asked to do the FP again. The new rule states that you have to have FP for EAD.

I checked some # around my I-765 case, some numbers before and after my case have been approved, mine is still pending. Is this normal?

I never saw the date for Apr. 15th. Maybe you and me access the different sever by our locations.
Anyway, can someone post the process date for I-765 (EAD) (c9) at NSC for me? Thanks.

Topic: How to use EAD?

I got EB2 based I-140 approved, and I-485 is pending more than 180 days. If I change employer and want to use EAD instead of H1b transfer, what I should do? From other website, someone just draft a letter to USCIS and mention AC21. Is that the only thing I need do? How the USCIS know if I am still in the H1b for the old company or in EAD for the new company? Thanks for any reply.

I don't understand. If you use AC21, it means you are in AOS (using EAD), then why you need h1b from Company B?

If you already have I-140 approved, and I-485 pending more than 180 days, why you still need the company B to apply for labor and I-140 again? Why can just use EAD to work for the new company? (how to let USCIS know you are in H1b or EAD?)

My lawyer get the original (maybe they send two originals, one to lawyer, one to employer). I got a scaned pdf from my lawyer.

I got a copy from the atterney. And I found and paid for whole fee of my PERM & I-140. Just curious, if my employer will also get a copy of the approval. Because they are the petitioner.
