If you use EAD/AP and your case is rejected then you go out of status. If your spouse use EAD/AP and you do not use EAD/AP then you do not go out of status. It will be better you do not use EAD/AP, as far as possible, and have your visa stamped on your passport and keep EAD/AP and use only when necessary.
