Topic: I-485 getting denied after I-140 is approved

In fact I had a question about it myself. Apologize to the OP if I am butting in on their thread.

My 140 was accidentally denied because the USCIS misplaced all the supporting documentation we sent. It took a MTR and 4 excruciating months of waiting to get the thing resolved. What happens if the 485 is denied accidentally? And you are using the EAD to work?

Just put down American Indian as ethnicity. That will cause them to think that there are not as many Indians in the USA as previously thought, and they might give us a bigger quota :)

Well I think the guy is just now finding out that talking eloquently about something is quite different from getting it done. He is taking fire from both sides over health care. He inherited a whole mess of problems, and those problems have festered over the last decade or so. Not to mention he is black. I am sure a Bill Clinton in the office would have eased things along quite a bit. If you think there is no racial discrimination in this country, the president is a living proof of it.

Having said that he is at cross roads now. He needs to show an effort here. Does not matter if the CIR is passed or not. He needs to show that he tried and "they" shot it down. Otherwise there is going to be a pig with lipstick in the white house after the next election.

Do you guys remember the time right after hurricane Katrina hit. All the politicians were in Louisiana congratulating each other of how they were doing a great job, when in reality, nothing was really getting done. This blog reminds me of that.

Take the wait-and-see approach here. If they every accuse you of not filing the address change from A --> B you can always blame the USPS and say that they lost the forms. If you say something to them about it now, it might come back to bite you.

Topic: Off- Do we need Valid visa if Travailing on Lufthansa airlines

There are two things here.

1) Depending on where you have a layover (if any) you might need a transit visa. I know you need one if you are traveling through London or Paris. Since its Lufthansa, if you are traveling through Frankfurt you don't need a transit visa. Your travel agent should be able to tell you this. Or just call the airline help desk.
2) Reentering the USA: Your AP will be checked by airline personal at the exit point in India, Mumbai in my case. They will check it again at the layover.

I bought the insurance last time when my Dad was here, but I have decided not to buy insurance for his future visits, since the insurance for which I have paid $350 (for 6 months) does not cover anything, I ended up paying from my pocket for all his doctor visits!



Precisely!! My parents bought the insurance in India for Rs. 10,000 / head. They also had all their yearly checks done, and brought along all the medication they usually need. That would be the blood pressure medicine that my mom takes, and dad's diabetes medication. The Rs. 20,000 insurance was for peace of mind, that is all. I am pretty sure the bloody insurance companies would have made my life hell even if I claimed $50.

Topic: Porting old pd at AOS stage.

Did you do AC21 during the process? From what I understand once an I140 is approved, the priority date can be used any time after that. It would be interesting how the law is interpreted in your case. Important questions would be

1) Did company A inform USCIS about you leaving? Was the 140 approved before, or after you left?
2) What action (if any) did the USCIS take on that basis?
3) Do you need an AC21 chain going from Company A to Company C to be able to use the 140.
4) I am pretty sure the answer to this is no, but do the labor certifications have to match (or show progression) between what A and C filed.

Whatever you do, make sure you read the fine print carefully. My brother-in-law's mom had to go to the emergency room because her BP spiked. He ended up with a $15,000 bill. Last I heard he was trying to work with the hospital to reduce the payment amount.

Believe it if you find it on a credible news source. This one I don't trust. Like someone else pointed out above, they twist facts, either intentionally or otherwise. Either way that's the last thing you want from a news channel. And I am not saying news sources like CNN or Fox don't twist the facts. In fact these two have taken the art of facttwisting to new heights. That's why for something like this, I'll wait for Murthy to post before I trust it.

Hi,

It all depends on what price you paid when you submitted the 485 after Aug 17th 2007, was it the old or new price. Now please remember that USCIS are not going to refund you any money if you paid the price. So it might be best to call and ask before you renew. Now I thought that only the first renewal would be free, but someone pointed out to me that they had had 2 renewals now and not paid for one of them so far. I have to go on what they told me here.

Also, if you are renewing your EAD then you do not have to send, yet again, a copy of receipt notice for 485. If anything is missing they send you an RFE. Trust me onthis as it happened to me!

Nice to see you back here posting.I was getting worried when I did not see any posts from you for a good month or so. Looking at the posts it looks like you are just about recovered :).
Quick question. When we applied our 485s we paid the old price ($385). However, we did not apply for the EAD + AP till middle of 2008. Do you think we still have to pay for EAD + AP renewal?
