Thanks! We are hopeful too. My PD is current (Oct 2010) but I left my employer after my H1 was exhausted. Got PERM approved, but don't know if I can convince my old employer to file I-140 and I-485 for me. They don't have any openings for me anymore. They backfilled me with two resources! Such miseries we go through!

Done! I'd signed the petition multiple times using multiple avatars!

Guys, the USCIS email from today states:

U.S. Citizenship and Immigration Services (USCIS) Director León Rodríguez announced today that, effective May 26, 2015, the Department of Homeland Security (DHS) is extending eligibility for employment authorization to certain H-4 dependent spouses of H-1B nonimmigrants who are seeking employment-based lawful permanent resident (LPR) status. DHS amended the regulations to allow these H-4 dependent spouses to accept employment in the United States.

Does this mean EAD applications will be accepted from 5/26 or does this mean applications can be made now and the earliest they will be approved is 5/26?

No employer can revoke I140 unless for fruad



Not true. If it's in process they can. My desi consulting employer is a stickler to principles. As soon as I changed jobs they sent a revocation request to USCIS for my I140 application that was still in process. Now, that USCIS continues to show the I-140 as approved even after four years is a totally different matter. But I didn't receive extension on the basis of the revoked I140 (AC21).

Guys, I'm putting a lot of faith on this rule passing soon.

I took admission at ITU as a means to continue working after my H1 got over Dec 8. I didn't have enough days left to sit in the US and do a COS. so I came to India to get my F1 stamped. My company who held my H1 has filed for labor this week. But it's refusing to offer me CPT internship. They just don't want to get into the hassles of administrative work for "just a few more months" till my I-140 is approved. These "few months" of unemployment will put a serious dent in our finances, needless to say. We will have to put in our savings in order to save the mortgage. I put a ton of effort to secure a place at ITU (transcripts, TOEFL, reco letters, $$ for application etc) but now, at the last minute, don't feel too confident of the F1 route as I will have to search an employer for internship (that too sitting in India) to get the I-20.

Thus I changed my mind about F1 and will be going for H4 stamping tomorrow. I sincerely hope the rule passes this year with effective date in a couple of more months. I know it's a big gamble but I'm ready to take my chances.

I'm not gushing gratitude yet. Let's not tweet 'thank you' until the rule has been published. Instead, let's continue tweets to BO, WH, DHS, USCIS, and OCRLeon expressing our impatience. Let's keep the pressure on. Let's ask for a definite date. 12/00/14 is not good enough. We need a solid timeline.

My question is that is it a part of Obama's EO, meaning that it can be revoked by a future president ? Or is this rule for here to stay since this is handled by USCIS ?

India being the safest option.

It seems COS is not entertained in Canada or Mexico anymore. I have not seen any definite rule around that unlike Jamaica. But email has been send from Canada US consulate after DS160 had been submitted that you need to travel to your home country. I do not have any info about Mexico.

Since you have been to Mexico earlier you might try that option.

But File your status here. H1B docs of your primary applicant and your H1B and 3payslips are required. You can file yourself. Once you get a receipt number you will be in status since your COS application is pending.

I have not seen any denials in H4. Processing time present is max 2.5 months but it's the max time.

If you are in time crunch then decide wisely and comfortably.

Actually I am trying to join a masters program on F1 but their spring term starts a little over a month after my H1 expiry, so I can't do COS sitting here. I was hoping to have the H4 from Canada in hand before traveling to India (and thus having a few more days to finalize ticket-booking) as a fallback option while I apply for F1 while in India. I will now consider directly applying for F1 without an H4. I hope I don't get rejected. If they reject I'll reapply, but for H4.

Guys, this is a H4 thread so I wanted to pose my H4-related question here.

I'm planning to get H4 stamped close to when my H1 time is up first week of Dec, instead of just COS. I'd like to make a trip to India (have been there only for two weeks in the last seven years) shortly after.

My question is:

Can I go to Mexico or Canada for H4 stamping as a TCN? Note that I do have an old, expired H4 stamp from India for the same H1 my spouse is on. And I have been to Mexico twice for stamping of my own H1B.

Your case will be audited if you jump from h1 to H4 and EAD. You are trying to tap the system. USCICS will put lots of rules around. So don't mess with it.



To nochange: Good GOD why ? The system doesn't prohibit cases like mine. We are using the best scenario which provides the shortest legal route. Correct me if I am wrong. You would rather let me toil for another 4-5 years for the EAD even after the rule is in place ? You must be joking. Besides it is very difficult to get H1B sponsors in my field. Don't you think that is the whole idea of EAD ?- making it easier to get hired. I think you are missing the big picture. There is nothing wrong in wanting an EAD by getting into H4 even if I have H1B



@essykay: People like you are so selfish to the core...Please try to understand the whole effort put for the H4EAD by the face book and trackitt group through OMB and mass email.petition and tweets campaign is to get the H4 who are qualified and wanted to work again and to retain the H1B who will be leaving the country for that sake. Its was not meant to be an easy pass for people like you who wants to adjust their status as and when they desire just because your partner has a I140.
I wish the USCIS put some prerequisites condition that its applicable for h4 who are minimum on the h4 visa for 1 or 2 years at least.... Then people like you will think twice before start abusing the rule..!!!



Such a prerequisite would be a terrible thing. I am moving back to H4 since my H1 has run out: I changed a three employers during the six-year tenure and even if the current one has started GC my PERM application didn't get done fast enough for me to receive I-140 approval within 6th year. You see, this rule recognizes the unnecessary hardship spouses like us have to go through - even if one spouse is on a steady GC track the other will have to go through the same hoopla in order to keep working. I hope there is no such eligibility criterion for granting EAD on the basis of minimum duration of H4 status. If there is, people like us with perfectly valid jobs/employment offers will be left high and dry; forced to sit out at home to age in H4 status to attain eligibility to return to the workforce.

Final rule should be published in Dec. And since it's not a significant rule, should be effective 30 days from date of publishing in FR. So, Jan 2015.

We have Satish, Vinod, Anir, Sumit etc to thank, everyone. It has been quite the journey since these stalwarts got together and made the OIRA meeting on Apr 23 happen. I have been watching them do their magic since beginning of April. This is indeed a fantastic group of individuals.

So does it say that if we have approved I 140 from previous employer are also eligible for EAD?



You're eligible if either you have approved I-140 or are granted extension beyond 6th year by virtue of AC21 (this happens due to approved I-140 from previous employer). So, I would hope old I-140 should work. I'm in the same boat. My husband's current labor is in process. Was filed mid-July 2014. My labor will be filed around Feb 2015.
