Can I file for 2 Labor Certifications Process through the same employer?
Please advise. We have received an audit on my Labor Process we have responded to the audit but and my employer is concerned with the delay to get it certified.
My sponsor is willing to enter with a new process, start from zero, but we are not sure if it is allowed for a company to have 2 labor process going for the same employee. Please let me know as soon as possible.

It all depends on what position you are going for, check the website that was suggested by the previous post that you can find information. Be careful not to use too much experience to avoid getting audit. Make sure your lawyer applies asks in accord to SVP requirements for your position

Topic: Business Necessity Letter -Need Help urgent
Hi guys,
This week my lawyer contacted me saying that my case got audit and that we need to reply with a business necessity letter proofing why they need someone with 3 years of experience. The requirements was BS+3 years and that is above the average based on Onet website. My lawyer should have requested for only 2 years. Now I see my employer and I having a hard time to justify why 3 years. does anyone have a sample letter? My lawyer is not being supportive.

I think whatever experience that you gained working for your perm sponsor it can not count , so when you fill out the form you can say that you work for them under x-visa but in the question that asks is the candidates experience was gained in with the employer that is filing for perm you have to say no b/c otherwise would be unfair for the other candidates.
I'm not sure what kind of visa you have while doing your PHD, b/c if it was F1 you need permission to work, so you got to be careful with that. When include your expirience make sure that you had permission to wrk under your visa. |

Be careful on your decision, before your lawyer design the ads, make sure that he consults the onet website for job requirements, there is a "formula" that LC goes by the and it is different for every position. I just got an audit (business necessity) for this reason and now we are having a hard time to answer to it. The requirements was BS+3years which in the end equals to 8 points and the maximum for the position applied would be 7.5. So ask your lawyer to really pay attention into it, such a simple thing that my lawyer missed out and now my employer is struggling to explain why they need someone w/ 3 years and not 2. So be careful in asking for too much experience, make sure to check onet for your job title and apply the SVP formula.

I have a question, my lawyer just received a letter of audit this week requesting for business necessity letter, I am not receiving much support from my lawyer, all he said is that company needs to proof why they need someone with 3 years experience and we are lost, I is hard for my sponsor to proof why 3 years of experience is better than 2 years. I'm lost. I went to other lawyers and a lot od them said that is better to re-file the process. Do you have any tips on he business necessity letter that you could share with me asap?
