Topic: NIW TO EB1 UPGRADE credentials evaluation


1. Doesnt matter.
2. Good.
3. Bad. The word postdoc and EB1-EA dont get along well. You cant work in any one else's lab if you are extra ordinary. You must have your own lab.
4. good.
5. good. not much value.
6. Doesnt matter. Is it paid membership or were you selected.
7. Good. They must be independent citations.
8. Helps. Did you review journals?
9. Good for you.

EB1-EA is an art. You must silently prepare and go for the kill. Dont rush and get denied. Priority dates will be current and PP is always available.

In the next six months do the following,

1. Try to get elected in associations that require certain criteria for members. Sigma Xi helps. Some people disagree.
2. Review lots of journals. Write to editors and they will send you papers.
3. Chair sessions instead of presenting posters. Posters are for kids, NIW is for boys and EB1-EA is for men. So go for it and chair sessions. It is hard doing it as a post doc but not impossible.
4. Start kissing the ass of some big scientists, so that they will write strong letters. Remember in the letters, they should not talk too much about themselves but about you. NIW and EB1-EA letters have vast differences. NIW letters can be from a scientist loathing about himself and talking about you. But if in the EB1-EA if someone loathes so much about themselves, then the reviewer will use them as a judge for the EB1-EA criteria. He will simply state, be like him to get EB1-EA.
5. Get a darn good lawyer to write a super strong covering letter. The first few paragraphs must clinch the deal. Every sentence should be a killer.
6. The word 'potential' is death for EB1-EA. You must have already accomplished.

Remember, you already have NIW approved, so wait...dont send an underprepared EB1-EA case.

I am so sorry to hear what you went through. I have been here 14 years after 4 M.S and 2 Ph.ds. Yet it seems it was not anough for EB1A. But we cannot loose hope. I-485 shows the following message: Card production ordered.

But I-140 shows: Case Received and Pending.

I called USCIS. But the representative told they are not supposed to disclose any information regarding I-140 to Applicant.

Please give me any suggestions.

Don't worry too much about web updates, they are known to be unreliable. Your i140 must have been approved some time ago. I got my card in June and my i140 is still shown as pending.

I highly recommend not to delay with O1. Read about other people with expired h1b I-94's. According to recent changes in regulations, you will be out of status and deportable as soon as your i94 is expired. AOS under pending i485 doesn't protect you anymore.

Get O1 asap, don't try to save money . I filed it premium this spring and it was approved in 2 days. Only $1k extra

Good advice. I will talk to my boss about O1 but will have to wait a couple of months. My boss has already spent a lot on these two filings. Hopefully they won't decide the EB1 in 2 months.

Same thing for me.

Never sent any affidavits or disclosed any bank info. I haven't even mentioned my visa status when inviting my relatives. I was J1 and my wife was J2. My in-laws got multi-entry visas.


Really good sources of information.

My parents and in laws have gotten US visa twice now...and each time all I gave was a letter of invitation certifying that I will take care of their boarding and lodging. I would also mention where I work and how much I draw.

Personally I will be a little scared to sign that I134 affidavit. I have heard horror stories of people using medical services (emergency) and if you have signed the affidavit....you might be liable.

Topic: Resident of CA, can I submit EB1-EA I-140 petition to Texas Service Center

I am in CA and was supposed to file to Nebraska. When I e-filed my I-140, the system instructed me to actually send my application to Texas. Many other people here had the same experience.

However, I regret it. Nebraska is much faster now for EB2-NIW. I would've been greened by now if my application went to Nebraska. Still pending in Texas...

Yes, you can do all that:

I'm not sure what you mean by TSC is still down.
I can go to Case Status online and search for an SRC number and it returns the status (albeit still unchanged) with the date and time stamp : 03-12-2009 07:59 PM EDT. This case is at TSC.
The 'processing times' link for TSC shows I-485's being processed at TSC for July 18, 2008.
Is there some other link that's not working?


But the time stamp that you are getting doesn't mean anyhting. A lot of people have been approved or sent RFE or whatever else but their status remained unchanged. Since Feb 10, there hasn't been any updates at TSC web site (updates are also known as LUD's, or Last Update Date). Same applies to their phone system.

Why haven't I paper-filed to Nebraska... :( I live in California and my I-140 was supposed to go to Nebraska. However, when I e-filed I-140, it went to Texas. And Texas is now 9 months behind Nebraska for EB2-NIW.

uscts says the following: Translations prepared in accordance with 8 CFR 103.2 (b)(3) and guaranteed to be accepted by USCIS and employers.**

Here is the quote from 8 CFR 103.2 (b)(3): " (3) Translations. Any document containing foreign language submitted to the Service shall be accompanied by a full English language translation which the translator has certified as complete and accurate, and by the translator's certification that he or she is competent to translate from the foreign language into English."

Translator can be ANYONE competent in your language. Don't you have Indian friends who can sign the translation that you prepare yourself? Why using any services like uscts?

No such thing as a certified translation in the US.

Anyone who is fluent in the language may translate and certify it. Documents may be translated by yourself, but then the translation must be verified by someone else who knows both English, and the language the document was written in. You could ask that person to look at your translation, and confirm its accuracy by signing the following statement which you must include on the same page below your translation:

This is to confirm that the above is a true and correct translation from _________ into English, and that I am competent in both these languages.
__________(prepare signature block) type name of person signing.

It would be a good idea to notarize the signature but it is not required.

I have already informed them.... without answering if its down or faulty... they connected me to IO two times only talk about my 485 case.

How to prove that the system is not working??? I am not able ad my new EAD rect number in uscis portfolio.


Well, then you can complain to ombudsman and everywhere else. My point was that I can not complain about anything myself, except for the fact that I am unhappy not to see any LUD's :)

I agree, we should do something about it. It just makes my life so miserable not to know what's going on. It is just impossible to plan anything. And speaking about recession and housing crisis, etc., I would buy house next week if my application was approved. And probably there are tens of thousands of people like me, if not hundreds of thousands.
