it's (they're, most likely) allotted only AFTER the interview is done, and the field officer adjudicates that you can be approved. if any review is needed at this stage, visas aren't allocated until that process is complete.

nope, it's not. the monthly bulletin check-in discusses the next month's bulletin, and comes after its release. essentially, he's talking of what will happen in the may 2018 bulletin, which was released a couple weeks prior. the fact that we've seen the bulletin and have analyzed it is irrelevant to the check-in.

thank you for the reply! as i read it, the only reason to keep F1 status is to avoid potential complications if the 485 is denied; so there's that additional consideration if he needs to travel outside the country while it's processing. got it!

Hi. My son's going to college this fall, and he'll adjust to F1 status, from H4 to do so (he's getting a good scholarship that requires F1 status, so there's no other option). I'm in EB3 India, and expect that my priority date (15 Oct 2008) will become current in the next few months (fingers, toes, everything crossed).

If I go current while he's on the F1, can I still apply for his adjustment of status without needing to convert back to H4? Or, should we have him either adjust to H4 here, or have him visit the US consulate in India for a fresh H4 stamp before submitting the I485 form? (My H1 is valid until December 31, 2020, and his H4 stamp has expired).

Any thoughts?

People may complain about employers but are still not willing to go back just because in comparison what they have here is certainly better than what they had before this employer came in the picture. The choice is ours. We should be thankful for the opportunity at hand and not hold a grudge against anyone or brood over things that can not last for a long time.
Always remember that we have to pay nothing to think good and remain hopeful. Every experience is a journey for a better life experience!

that's interesting... i wasn't aware of the lawsuit, and that definitely explains some things i was curious about.


i wonder why any normal lawyer wouldn't assume that this would be automatically thrown out, considering that these dates are explicitly at the discretion of DOS / USCIS... yet another example of a shark doing what it does best, i guess. another example of folks stuck in this situation taking advantage of any perceived benefit, many times to their own detriment.


i know of a bunch of people stuck in the eb2i 2009 loop, and can certainly commiserate. but being in eb3i myself, i can't help but wonder if they've got it just a little bit better :) to each his own.

i totally agree on the sugarcoating responses thing. someone has to be the bad guy here, specially when (almost) every poster here is hopeful that they'll see light at the end of this long tunnel, and will grasp at anything that might make them feel good... we're all human, after all, and hope is always just beyond that horizon.

the Obama administration brought in the concept of Filing Date (when you could apply for AOS + EAD, even if your priority date wasn't current), in addition to the already existing Final Action Date (which requires your priority date to be current). this was sometime in 2015, if memory me correctly.

ostensibly, this was an administrative mechanism to assist people with long wait times, and to let them at least jump jobs without being stuck with a single employer for decades. this was - if i remember correctly - in response to inaction from Congress on any employment-based immigration reform. the idea was that with Filing Dates, you could apply for both AOS + EAD, you would receive an EAD, but your AOS would be held in abeyance until the priority date became current.

however, i believe the Filing Dates were only respected a couple of times (i don't really remember exactly when). each month following the bulletin, USCIS decides whether to allow people to use the Filing Date or stick with the Final Action Date. *if* the filing date is allowed, you can apply and receive your EAD even if your priority date isn't current, as long as it's before the listed Filing Date.

most months, USCIS has only allowed the Final Action Date for employment-based petitions, which means that you can't even apply until the priority date is current.

it sucks, but such is life.

no, joint accounts are not at issue here.

what's important is who executes the trade. you may not have all the evidence required to prove that the EAD holder and not the H1-B holder actually carried out the trade, but that's not a USCIS problem.

trading on H1-B is NOT a grey area... there are very few truly grey areas in immigration or financial services. you can do all the trading you want with the money you've already earned, as long as that's not your primary source of income.

simple questions are: are you charging someone to trade for them? are you making money from charging for trades? are you only making money, or are you also losing some? is it your own personal money that you're investing?

I'm not sure that there's a hard limit. Do you have any references that you could cite?

My understanding is that this falls under the ambit of investing your personal earned money, against which there's no restriction. Unless you're trading other people's money on a H1-B, and charging them for the privilege... now that's a violation for sure.

as i understand it, the preparer should be somebody that you report to, or your company's HR representative. the form is an attestation that you work there, and claiming that you're filling it out may be seen as suspicious.

What's happening to DHS website. When I enter my Priority date to calculate it says "congratulations. Your priority date is Current. But mine is 14thNov2018



that's NOT a DHS website; it's an independent 3rd party, with what appears to be a bug at this time. please don't look at that website and expect anything other than some light entertainment. it's a very nice, feel-good kind of analysis, and it's nice if they turn out to be accurate.

just setting expectations, is all...

you're welcome!

the main reason i would recommend this course is this: you don't want to provide any more information than absolutely necessary, and specifically requested. primarily, there's no reason to do that, and secondarily, you don't want to show that you're second-guessing the officer... most people don't really like that, and at this point in time, you really want to build your case as positively as possible, with no hint of a potential issue.
