No update on AP's, I'm assuming the cards will be combos. Approved exactly a week after opening SR's on day 76. Best of luck to anyone still waiting.

Looking for advice please: my H1B stamp expired but spouse has a valid H4 for another year. If I travel out of the country and come back on AP, can my spouse then come back on H4 to pick up the AP or H4 can no longer be used to enter once the primary H1B goes on Advanced Parole? Thank you in advance

Has anyone seen anything like this? My dependent just got a 3d FP notice... This is beyond frustrating. Did first FP's in September. A month later got the 2nd FP notice, went for the appointment, they said the background check cleared (came back "non-ident" does that mean it cleared?) and no need to take FP's again, it was a duplicate notice in error, all set and have a nice day. We are ROW EB2, non-concurrent, I-140 approved in premium back in June. Our processing center is Texas Service Center. Just now got a 3d FP appointment notice from Nebraska Service Center. How is this even possible? Did they move the case from TSC to NSC? It says nothing about that online in the status - all six 485's/EAD's/AP's are "at the Texas Service Center". Also, unlike the first two notices, this one is only for 485 and not for "485 and EAD". ALSO, to top it off, case type it says "485" but the reference/case number with the barcode is the EAD number, not the 485 number...

What are the chances this was issued in error? I greatly appreciate any thoughts/suggestions/comments. This is such a nightmare. Thank you in advance

thank you. so official processing time for 485's now is ~4-5 months between NSC and TSC assuming priority dates are current. what if you get the green card 6 months after applying and change employers for a similar position at that point. That is perfectly fine and allowed under AC21 after 180 days anyway, GC or no GC, except, if you already have the GC there's no AC21 to file any more even if you wanted to. So if USCIS allows you to change employers after 180 days anyway through AC21 regardless of having the GC or not, why would they hold you accountable 5-10 years later for leaving the employer any time after 180 days from the time of 485 filing if the GC is approved?

Having to stay "for a while" / for 6 months after getting a green card sounds like a myth. What if you get laid off after getting the green card? Your job changes? You are told to relocate? You get a new boss and they don't like you? There could be a million scenarios where staying in a job for six months might be out of someone's control. How can they verify this 5-10 years later when you apply for the citizenship??

Based on my interactions with the 1 800 number it is hard to imagine them saying anything other than what's on the appointment letter. I can't imagine them saying don't go to your appointment even if you get invited back for the 10th time. I wonder if there is anyone out there in whose case it was an actual mistake and they didn't go back or is going back the only option?? Not a problem for me, but wife is out of the country now... very frustrating and expensive

Same here... wife, dependent, got a 2nd FP appointment notice just now. We both filed I485's ROW EB2 on 08/12 receipt notice 08/13 and had our FP's done on 09/08 (I actually went in with her on the day of her appointment because mine was a week later). While in there I asked the officers several times and they said we were both all set. A few days later I also went for an infopass appointment to check if the FP's were in the system and the officer said yes, they were all set. Her notice is dated 09/12, and we had our FP's taken on 09/08, so just four days later... Nothing for me. And she is out of the country now waiting for the EAD to move with her job... She can't fly in for another FP appointment... So is this a mistake? I don't know what to think. Have any of you guys called or went for infopass today? I just saw the notice and it's too late to call (9pm EST)

Why do you guys keep referring to 90 days? So the USCIS website says you can inquire about the EAD case status after 75 days. Does that mean that their regular time frame for processing EAD's is 75 days? On someone's day 76 can't he or she just go to the local office for an infopass appointment and ask to issue the EAD on the spot???

Hi everyone, hoping to get your opinions on my situation:

I am EB2 ROW, I-140 just got approved. Working for the sponsoring company on H1B valid through 09/30/2015. My girlfriend and I have been together for 5 years. We are from two different European countries. Last 3 years have been long distance since she has a good job in London, and H4’s are not allowed to work and PERM took almost two years in audit. Now that I am ready to file I-485 I want her to file with me. We are getting married in a few weeks, she is getting the H4 and we are filing I-485 right after that. We have a genuine relationship and we lived together for two years when she went to school in the US. Since then, because of the circumstances, we have been traveling back and forth and have seen each other on average once every three months sometimes every month. We have all tickets and pictures to support that. My questions are:
- How often in employment EB2 cases do they ask for Bona Fide marriage evidence?
- How likely is it to get that RFE if the marriage is very recent? Is it pretty much guaranteed or it depends?
- Is it better to submit all bona fide marriage evidence with the application or wait for them to ask for it?
- How extensive does the evidence need to be? We have lots of pictures, tickets, letters, postcards, joint bank accounts, credit cards, etc. We do not have kids, have not lived together for a while, etc.
Once the I-485 is filed she plans to go back to her job in the UK until I-485 is approved at which point she will leave her job and move. She can fly back for fingerprints/interview etc. Would that work?

Please share your thoughts/experiences? Thank you

My H1B stamp just expired as I just reached my 6th year. Employer applied for an extension a couple of months ago (based on a PERM pending for 365 days) and got the approval two months ago before the stamp expired so the H1B status is now valid through 09/30/2015 even though the stamp just expired. I have the original I-129 approval notice valid through 09/30/2015. My wife is overseas and we now want her to get H4. The question is - do I, as the H1B, need to have a valid stamp in my passport for her to get her H4 stamp or is me being in status till 2015 sufficient? And having an approved I129 through 09/30/2015? Is she okay to go to the embassy? Or do I need to leave the country and get a new H1B stamp first? Thank you anyone who can weigh in!

I know it's supposed to be random within a given month, but it is still strange to see audit cases with priority dates of 01/29, 01/30, 01/31 and audits received/replied in August getting approved when there are plenty of early January cases with audits from June still pending... so frustrating... We still have so many cases to get through and it's already been a month and a half and they have just barely scratched the surface it seems based on hundreds of January audit cases still pending on trackitt...

Topic: H1B extension in London, UK - 3d country?

The situation is as follows: PERM is pending, H1B stamp expired, I can't travel, but got an H1B extension approved till 09/30/2015 a few months ago. I do not have a UK passport, but have a UK visa valid for two more years. I was not planning to leave the country, but got invited to a wedding which I would love to go to in the UK. Thinking about going for the H1B interview while I'm there to get a new stamp. Questions:

- Is going for an H1B interview to the US embassy in a third country (the UK) where you are for a week on a tourist visa a risk?

- How soon can one get an appointment at the London embassy these days?

- How long does it take between the interview and getting the passport back?

- Do they deliver it via FedEx or something like that or can one pick up his or her passport themselves?

- What is the fee for an H1B at the London Embassy?

If anyone has had a recent experience please share. I would greatly appreciate. Thanks a lot.

I think your 3-month logic assumes that next time they update processing times in a week or two here the audit date will change to February 2013 and then to March 2013 and so on. Then if they are three months ahead on their website but you have not heard back on a January case you can contact them. However, correct me if I'm wrong, they can just keep the January date for several months. November was on there for two months for instance. So as long as they do not update the month you are not able to contact them for an update even in 6 months from now...
