I've received the physical card in hand on 11/01 after waiting for 117 days. Finally, I am out of this club for good.

Thank you, richmond. I did lawsuit by my self. It is Writ of Mandamus (WOM). Court fee is $350. If you hire lawyer, you may spend $2~3,000 more. But you can do that by yourself. To me, it took 1~2 days to survey and fill out forms and complaint.

Congrats on getting your EAD Buzzy. I am planning to file a lawsuit soon. I have no clue why my EAD renewal is pending for the past 110 days. I've tried all of the following.

1) 3 service requests (1 for Biometrics, 1 for expedite, 1 for Interim EAD )
2) Multiple calls to NCSC
3) 4 Visits to USCIS office
4) 2 emails to ombudsman
5) Fax to Congressman
6) Mail to Senator

What else is left? Contact the President ?!?!

I wish i could kick the fat a** of the lazy bum working on my case for complicating things on a simple case.



At laaaaaaaaast after 112 days, my EAD application status got changed to "Card production ordered" today.

Lessons learnt :

1) Never ever file for EAD renewal electronically so as to avoid delays with bio-metrics.
2) File for EAD renewal exactly 120 days before expiry.
3) Always include 2 passport style photographs with the application irrespective of paper-filing or e-filing.

folks,

photos are not needed....they will take the photo at bio.

I got my EAD in 50 days(today) from TX.



That's not the case with all e-filers. Some (including me) have got RFE for photographs in spite of bio-metrics.

Saiprasad, what you said hold's good for paper-filed EAD's. But the receipt notice generated by E-Filed EAD's states

"DO NOT mail photos or copies of identification unless requested to do so by USCIS"

Go figure.

Topic: Can any one tell what documents USCIS need?


Bhai would you be able to send me information about "congressional inquiry"? My status changed on oct 22 to " Response to request for evidence received, and case processing has resumed". I have sent my job offer letter with my evidence to get it expedited. Hope it works.



Pls. follow the steps below to contact your congressman

1) Navigate to http://www.house.gov/

2) Go to the top left hand corner of the page and enter your "ZIP + 4" and press on "Go" button.(You can get your "ZIP + 4" from http://zip4.usps.com/zip4/welcome.jsp)

3) Click on the Representative's name returned by the search and go to the representative's web page.

4) Click on "contact us" link on the representative's web page and get the phone no.

5) Call them up, explain your situation and provide a fax no.

6) They will fax you a "Privacy release form for CIS cases"

7) Fill in the "Privacy release form" and fax it back along with the supporting documents to the fax no. specified in the form.

8) That's it. Someone from the congressman's office will make an inquiry on your case with USCIS and update you via phone or email.

Topic: Do someone really needs an employer consent before applying for EAD and AP?


Technically, EAD and AP are benefits provided by uscis to you on your pending AOS...So you can do that without consent of your employer... the trouble would be when uscis comes back asking for some documentation from the company... that is the most unpredictable part...

People generally do it for a purpose, like spouse job or getting ssn... or themselves changing jobs on ead...etc...etc...

As far as EAD/AP is concerned, USCIS NEVER asks for any documentation from the employer, unless you want to raise an expedite request on the pending application based on severe financial loss to employer.

Topic: Request for Interim EAD denied even after 90 days


After contacting the ombudsman, how is everything?

I sent e-mail to ombudsman today because I was waiting for over 90 days with no RFE.



I've emailed ombudsman twice and here's the latest response from them

"I am sorry to hear that you have not received a response yet. I understand your frustration and I will forward your case to the Customer Assistance Office at USCIS. You should receive a response shortly.

We have made a recommendation that USCIS process all cases within 90 days. Please visit our website to read our Recommendation #35 at: http://www.dhs.gov/ximgtn/programs/editorial_0769.shtm

Please note that CIS Ombudsman is independent from USCIS and cannot adjudicate immigration applications or serve as a substitute for the legal options offered by USCIS to correct a problem.
