Wow... Just read the article above... What a broken immigration system man... But C'mon... Who is the dumbass in Fragomen that wrote this in the labor cert process: ???

'After interview, should any of the applicants appear to be qualified for the position, please contact a Fragomen attorney immediately to further discuss the candidate's background as it relates to the requirements stated for said position,' or some variation thereof."

That was an easy target for DOL...

Topic: NEW CLARIFICATIONS TO AC 21

I do not like the part that they talk about REVOKING an already approved Labor Certification. That part, in combination with the announcement that all Fragomen Labor certifications are going to be audited stinks really bad. With the rise in unemployment in US it seems that the department of labor is tightening the belt on immigrants.

Topic: Know of good lawyer in the OC/LA area?

I was like you last week. I spoke to the hiring company (which already made me the offer and wants me to start ASAP) and they convinced me to not move now. According to them most big companies are withdrawing the I140 these days once you leave. You might find a lawyer that tells you that he can do it but is not really up to him. You must have an I140 tied to your I485. If they withdraw it, it might be bye bye GC. UNLESS YOU ARE ABLE TO FILE A NEW I140 BEFORE THEY CANCEL YOUR I485. You could do that by asking your new employer to file a PERM now. Here is the timeline:

DAY 1 - Hiring company starts PERM process and file AC21
DAY 15 - You announce that you are leaving to your old employer
DAY 20 - Old company withdraws your I140
DAY 30 - You receive a NOID from USCIS about your withdrawn I140. The letter gives you 30 days to respond.
DAY 60 - Before day 60 you should hope that PERM was approved so that you can file an I140 and reply to immigration saying that you have an I140 pending.

Topic: Approved I-140 transferred to NSC

My speculation is that they just sent your I140 to the place where your I485 is pending. They do that all the time but, typically, they would not even process the I140 at TSC. Once they see a chance of getting rid of work they don't think twice and transfer the case before processing it (that is my case).
In your case, if I am right, it looks like the IO was kind enough to process your I140 and now they are transferring the files to the center where your I485 is pending.

As long as your new job is similar/same occupation all you have to do is send a letter from your new employer stating the salary, your position and activities along with supporting documentation. Other threads in this post should cover it.

I know how you feel. I have a job offer with a 45% increase in salary that I can't take right now because my I140 is still pending and I don't have an H1B visa. The hiring company wants me to wait until october (when I get the H1B) for me to start because they are sure my current employer is going to withdraw my I140. According to them, this is the standard procedure with large corporations. I went to read the immigration policy of my corporation and she is right. It clearly states that they will immediately withdraw both H1B and I140 once you leave!!!!

I think you would be better off using AC21. What if your old employers don't respond to the RFE? Remember, the I140 case still belongs to them

Various dates as some were Labor Sub. Anywhere between 2004-2006. Yes, I know people who just got approved (last week)

Topic: O1 Visa


You cannot change visa type if your adjustment of status is pending. You have to continue to be on the same visa as it was during your I-485 petition unless you start using your EAD when you abandon previous visa status.



You cannot change from inside US, but you can go out to get a stamp. I applied for I-485 when I was a student (F1 visa) and now I am going back to Brazil to get the H1B (it was approved last month). This action will not affect my I485 petition.
