Topic: EB Visa Numbers Available for FY 2010 for all countries.

Hi alaman,
It looks like 2,987 is the 7% of 42,671 (42,671 * 0.07 = 2,987). (limit for each country).
I don't think any country hit that limit except (Phil, China, India).
If the report is correct and uscis use up all the visas without waste. It does look like backlog can be cleared within 2-3 years.

If we don't speak up, nobody care how long we need to wait or even we die.
If this bill is still valid and legitimate, there must be hope on it especially there are 74 co-sponsors on this bill.
Since Obama would like to postpone bigger immigration reform next year.
Let's pass one bill this year. It is much better than nothing done!!
Illegal immigrate needs help but let's work on legal one first!!!!

Anybody can confirm this one will recapture all the unused visas for employment based?
I read the details of the bill, it does says "recapture unused EB visas, last year + any used since 1997" but the main one is to reunited family.
If true, this bill is trying to do both but use family reunion as title. That would be awesome!
Recapture unused visas will be the only hope for us now or we else we will be "hanging there!!" for another X numbers of years especially for Eb3!!!
That's crazy!!!
We need to wake up and do something about this bill if there's a chance this bill will move to congress and become law soon.
Any lights here?

Topic: is IV's estimate of getting GC for real..

I doubt about the accuracy of the results because my PD is Jun 2007
and it says mine will get approve OCT 2009.
I am EB3 ROW, but I am quite pessimistic about getting approval anytime this year.
It will be good to know if possible happen sometime next year.

I got the LUD on 7/27 for my I-140. Got RFE around Jan 09 and got I140 approved on 2/6/09.
I am EB3 ROW. I also got soft LUD for my I-485 3/4 & 3/6. My PD is 2007. Look like we're in the same scenario.
I doubt mine will get approval any time since my PD is far from current.

Sorry to hear about that. Are you going to appeal for this because it does sounds like you do have the box checked education and experience are interchangeable or either one acceptable for job position. Since you have the master degree, then experience should not be an issue. Have you discuss this with your lawyer?
Also, if you have change your title during the time you work for the company, your previous position can be counted as your experience as well.

Topic: EB3 RFE - Experience letter from current employer sufficient ?

I looked into my LC form and there is a check boxes
specify
8. if alternate combination of education and experience
is acceptable? If you say yes, and then the next question is
8a. specify alternate level of education, if you specify master....
that means if you have alternate education then.. experience is not required.
At least this is how I look at it.... please let me know if I am wrong.

My HR just informed me that my RFE is for education and work experience.
I have a bachelor of CS and Master in IS in U.S. university, but I do not have
other work experience prior except working for my college. Any advice?

If you filter EB3 I-140 NSC from trackiit.com, 90% are processed for all application submit before march 07 but starting april 07 to august 07, it's like about 25% completed. USCIS processing time are wrong!!!
Unless they meant EB3, I140, NSC + "visa current" group?

Apparently, if you filter trackiit data to EB3 NSC, still many people from April 07 waiting for approval. I am not sure why processing dates are showing July 07 ??

NSC show processing dates for EB3 is 7/24/07 but if we look at the trackiit statistics...
Filter by EB3 NSC, it seems like they only process until somewhere around march, starting april only around 10% got process. Any thought?

Yes. you can get 2 years EAD while your I140 is still pending.
I think USCIS is planning to change the rule so that only issue 2 years EAD only if your I140 is approved.
Be happy if you get 2 year EAD because it saves your time and $$$ to renew it again next year.

It's really sad to know there are people who spend time to anti-legal immigrant who are paying taxes to us govt. Isn't it all american are immigrant except American Indian? Isn't most of the brilliant NASA PhD's are immigrant? I don't know what are they thinking. Btw, please keep us updated if H.R. 5882 bills will appear for debate soon.

According to this attorney Matthew Oh (one of the reliable source), visa recapture seems to be a hope for all of us especially EB-3? Anybody have more news about this bill?
