Topic: Its been a month.....
Since we received the approval e-mails for our I-1485 applications (husband and self). Yet there is no sign of the CPO mail or the actual card. We've raised a service request a few days back, but have little faith in the SR process. At this point, we are getting desperate due to a number of personal reasons - its like the USCIS gave us a teaser (that we've been approved), but for all practical reasons, nothing has really changed. Lawyers have advised us to stay with the current employer until we receive the cards.
What are our options? |

my husband is in the same situation, and we have contacted 2 lawyers - here is what they said. there is no legal requirement to stay with the sponsoring period for any period of time. however, it is important to prove intent - that is you intented to stay with your employer and moved only becuase of a significant reason, if you move within a few weeks. in our case, that significant reason is living toghether since both of us have jobs in different states. but even a good offer from a different company, with a higher level of responsibilities and significantly higher pay, should be a decent justification.
the lawyer also mentioned that companies will not generally inform the uscis. in fact, it is extremely rare. but this does make it important to maintain good relations with the employer and leave on good terms. |

We have considered seriously the question regarding moving so soon after approval; we've also spoken to a lawyer. I agree that its safer to stay for a few months more, but i think that we have a good reason to justify the move. Living together is a big reason. And if it is a risk at the time of naturalization, we're willing to take it cos' of what we are getting now. We've been through too much cos' of this whole process and we aren't willing to take any more just to 'safe' after 5 years!
Only thing we are worried about is - If mu husband moved before he actually gets the green card in hand, and later the USCIS sends to old employer's lawyer - is there any way that the old employer / lawyer can hold it back or trouble us in any manner, or return to USCIS? The GC is our to keep, isn't it? Also, once my husnand leaves his current company, we will be paying them back for all GC expenses since he had signed a 1-year contract. |

Well, we 9my husband and myself) got our padssports stamped recently. We were scheduled to travel to Europe (for vacation, not work - so no urgency there, except that we would have lost money in canceling tickets, hotels etc). just a week after we received the approval. We scheduled an infopass appointment, the IO didn't ask too many questions either. They made us wait for close t2.5 hours though cos' they said that they have to run some background check (which sounded silly to me, since that is something that they would've taken months over before approval. Not sure what they acomplished in 2 hours0. But anyhow, we got out passports back with the stamp valid for a year. we are back from our trip now too and there wasn't any issue at the airport immigration. |

This is regarding changing jobs after I-485 approval. My husband's I-140 and our I-485 applications (my husband (primary applicant) and myself) got approved on August 16th. We received the approval e-mail on the 16th and after a week, we received the approval notices by post. However, 3 weeks later, we still haven't received the card production ordered e-mail or the actual green card by post. The reason we are getting impatient is - my husband has an excellent job offer (in the same city as me, whereas he is currently a 4-hour flight away) and while this new company has been waiting for him for a few months now, they are now getting impatient.
What I want to know is - Can my husband move employers with just the approval notice in hand? We also have the I-551 stamp on our passports since we had to tarvel out of the country last week. Or is essential to have the actual green card in hand? We raised a service request yesterday, but frankly after spending so many years in this whole process, we don't really have much faith in USCIS to respond soon. Our case is at TSC though. |

well, we got soft LUDs on all of our cases on a friday, and by monday, we received all approvals.....i-140 and 1-140 for primary and dependent. |
