Topic: Employer Merger

Hi,

Currently i am working for Employer A ( GC sponsoring employer ).

My i-140 has been approved in Jun 2007 and i-485 has been pending since Aug 2007.

Employer A merged with Employer B in NOV 2008.

Since my current H1B ( with Employer A) is expiring in Feb 2009, Employer A ( i.e my current employer, gc sponsoring employer) is proposing to transfer my H1B to Employer B ( i.e instead of renewing with Employer A ).

Regarding my pending Greencard, when i ask my employer A, he is saying nothing needs to be done.

But,i am not sure what should i do with the pending i-485 in this case.

Please let me know 1) If I dont invoke AC21 and leave everything as it is in my Greencard what will be the effect?

Please advise on the best possible thing that i can do in this case.

Hi Track07,

i am in a similar situation exactly to yours.

Employer merger after i-140 approval and i-485 pending ( pending since Aug 2007) .

Since my H1B is expiring in Feb 2009, i am transferring the H1B from existing employer ( GC sponsoring employer) to the new employer.

Not sure what should i do with the pending i-485.

Pls advise. Appreciated a lot your help.

My i-140 has already been approved on Aug 2007. i have crossed the 180 day limit for AC21 on Jan 2008.

i want to move to EAD so that i do not deal with H1B renewals, frequent stampings in consulate, probablity of rfe/denial in h1b ( since my employer has merged the company with some other company and he says he will be applying for h1b with the new company) etc.

Pls advise.

Hi ,

Thank you for taking time to go through the below and helping me out.

My current H1B and my wife's current H4 is expiring in Feb 2009.

we have our i-485 pending ( EB3 India, PD :- AUG 2006 ) and both of us has got EAD and AP.

i am still working for the sponsoring employer ( both H1B and Greencard ).

Now i am planning to let my H1B and my wife's H4 to expire and start working on EAD with my employer.

Pls let me know :-

1 ) is it sufficient if i send a new i-9 along with a copy of my EAD card to my employer.

2) what should i do with our expired i-94 card ( since we entered last time using the H1B & H4, which is about to expire in FEB 2009 ).

Please advise. Appreciated a lot.

Assuming, i still stay in the initial Employer A ( who sponsored my Greencard ) , even after the merger , what are the risks involved.

Hi,

i started my Greencard Process with my current employer ( i.e Employer A ) on June 2006.

My i-140 approval date is June 2007 ( through Employer A's attorney )

My i-485 filed date is August 2007 ( through Employer A's attorney )

My Current EAD is Valid till August 2010

i am still on H1B with Employer A and i have still not used my EAD.



on November 2008 ( this week ), Employer A merges merges the company with another company.

Employer A informed us only after the merger happened and he does not specify what he intends to do with my Greencard..


i am planning to quit my current employer ( i.e Employer A ) and join another company using my EAD with the same job description.

i am planning to hire an experienced immigration attorney and use my EAD and invoke AC-21.



Pls advise if there will be any problem for me in my greencard process in the future.

Hello ALL,

My current H1B is expiring on Feb 2009.Also, i have got my current EAD renewed till AUG 2010 and AP renewed till AUG 2009 (Pending i-485 --> EB3 India ).

i am not sure if i

1) should renew my H1B before Feb 2009

( or )

2) let H1B expire on Feb 2009 and start using EAD & AP till my Greencard comes.

Please advise if option ( 1) or option (2) is best recommended in my situation.
