In your case, being married to a citizen does not help you as you already got your GC last month. For citizenship, all they care about is when you became a permanent resident. It does not matter under what category you got your GC or whether you are married to a citizen. You can apply for citizenship 4 yrs and 9 months after you become a permanent resident (regardless of category), which would be listed in your green card under "Resident Since". Based on your post, since you got your employment based GC last month, your "Resident Since" probably has a date from last month. So, your wait would be approximately 4 yrs and 8 months to apply for citizenship. |

Texandude, Thanks for your concern. My wife DID get her card and everything is fine in it. So, our journey ended successfully after some anxious moments (or months)

Topic: H1 approved months after receiving GC!...and a goodbye!
I post this here just for some levity and to show how inefficient USCIS truly is!
This year (like an annual pilgrimage) I applied for H1 and H4 extensions in April. I have been doing this since 2005 and every year USCIS has been granting me one year extensions. Until last year, this was because I was stuck in BEC. But, got out of BEC (thank god!) early last year and got my 140 approved immediately after that via Premium Processing (this was when PP was still available for 140). So, last year, I applied for H1/H4 extension in May. Then came June 2007 when I became current. So, I filed my 485 in June 2007.
Well, I kept hoping that they will issue me a 3 year H1 extension. I was technically eligible for 3 year extension based on the fact that, when I filed H1/H4 in May, I had an approved 140 but due to retrogression was unable to file 485. USCIS took for ever to touch my H1. So, after several months wait, I was forced to shell out $1000 and upgrade to PP. USCIS approved my case after the PP filing but to my great disappointment they only approved my extension for 1 year because when they approved my H1, my PD was current (USCIS extends H1 for 1 year if your PD is current), and so USCIS chose to check whether my PD was current when they approved H1 not when I filed H1.
But, soon after that EB2 India became unavailable in Jan 08. So, this year I filed H1/H4 again when my PD was not current hoping to get 3 year H1/H4. Well, once again my PD became current in May. But, this time I got my green card approved in May. I was happy with this and forgot all about my pending H1/H4.
Here comes the kicker. Just last week got approval email for our H1/H4 3 months AFTER our 485 was approved. On top of that got a 3 YEAR extension of H1/H4 even though our PD is current now!!!
Several questions run through my mind:
1) If USCIS should really extend H1 for 3 years if PD is not current at the time of filing H1, then why did they not extend me for 3 years last year?Alternately, why did they approve me for 3 years this year when my PD situation was identical in 2007 and 2008 (i.e. not current while filing H1 but current at the time of its approval!)?
2) Why did they approve my H1 this year to begin with when my 485 is already approved?
Oh well! Just find the whole process ridiculous. This will be the first time in 13 years that I will not have to worry about any immigration issues. First it was F1, then OPT, then multiple H1s, then 140, EAD, AP and finally 485. Whew! Just realized that is over a third of my life so far!! In between had to deal with getting my wife her H4 when we got married. Worry about Visitor visas for my parents and in-laws. Well, now both sets of parents have 10 year visas, my wife and I have GCs and kid is a US citizen anyway. So, I do not have to deal with these folks for 5 years or later, that is if and when I choose to apply for citizenship. What a feeling! I am not sure what to feel. In a way, feels a little empty because a major source of head ache is not there any more! Has my mind gotten so used to worrying about a topic that when that worry is not present any more, my mind now feels restless??

Texandude! I am very happy for you! Enjoy the card and the freedom that comes with it! Now you can plan that trip to India.
Jireh, My wife was in the exact same boat for several weeks. We complained to Ombudsman and called the 202 number (Look at McBush's post for that number). We got a new FP notice for Wednesday. After she gave her biometrics, we got a CPO email within hours. We are currently waiting for her card. Expect it by next week.
So, keep following up with USCIS. The goal is to get a new FP notice. Someone stated that you could go on a Saturday to your ASC and see if they will take your finger prints again without a notice. May be worth trying. |

was this a CPO or Welcome Notice email?
If it was a CPO, then it means that it was probably sent to the production facility. There are some problems that can occur at this stage:
1) The production facility thinks that the quality of the picture and finger print is not good enough to print a card
2) The production facility was having machine problems. As a result several people were stuck in this stage including McBush and Texandude. But, I think that problem has since been fixed.
3) They have the wrong mailing address on your wife's application. As a result they may have posted it to the wrong address.
Either way, contact USCIS and find out what is going on. Keep calling (rather your wife needs to keep calling) them until they give you information on what is the hold up.

Give it some time. You may still get it within the next week or so. But, it is also more than likely that USCIS did not find your biometrics. Read my posts. This is exactly what happened to my wife. We were approved in May and she never got anything other than Welcome Notice Sent email. We contacted USCIS multiple times. They never found her biometrics. FInally they sent a new biometrics notice which she gave this week and within hours we got the CPO email update.
I would say, contact your service center using the POJ method to find out what is the delay. Many times, they make you wait 30 days before they will even look at your case. So, you may have to wait for that period before getting any concrete info on what is the delay on their side for sending you your card. The first thing they will do is try to find it by sending in an IT request. For some trackitters this has worked out. If USCIS still cannot find it, then they will issue a new FP notice like in my wife's case. In the meanwhile, you can try to get a temporary I-551 stamp on your passport by taking an Infopass appointment. Be aware that many local offices are reluctant to do this as well. For example, our local Office refused to stamp my wife's passport even though we tried to get it done multiple times.
Please be aware that in SOME cases, people got the card without any further LUDs or emails. But, based on seveal trackitters' experience in this thread, I would say there is a high probability that in your individual cases, USCIS is unable to find your biometrics. |

Yes. My wife was approved along with me on May 22nd. Both had filed 485 in June of last year and had given our biometrics originally in September of last year. So, the biometrics had not yet expired. But, in my wife's case, USCIS misplaced hr biometrics and could not find it to print her card. So, they sent her a second biometrics notice for yesterday. Within hours of her giving her biometrics we received CPO notice for her. |

ok a positive update.
My wife gave her biometrics today at the ASC. This evening we received the CPO email. Hopefully we will see the card soon.
A recap of our history:
5/22: Welcome notice email for both of us
5/22: CPO only fo rme
5/29: I received my card
5/30: Received the physical welcome notice for both of us.
My wife did not receive her card because they could not find her biometrics.
After a couple of visits to PASSNOINFO(er, Infopass), DHS7001, numerous calls to TSC and a call to 202 number, we got a new Biometrics notice for today. I honestly do not know what worked. It could have been the 202 number or the DHS7001. Who knows.
Anyway, looks like the end of the tunnel is visible for us and hopefully we will get her card in less than a week. Hopefully my next update will be the last. |
