Hi, Someone could please help me on this:

I am having H1B status and spouse has H4-EAD, my contract was ended with client on 12/31/2017. I haven't found new assignment yet, at the time of joining employer assured me to run my payroll till I get new assignment, now they said will not run my payroll anymore and terminated employment effective 02/01/2018, last payroll was run on 01/31/2017. I started transferring visa to new employer based on I-140, not filed yet it is in process, I am on grace period now.

1. As soon as I receive H1B receipt, legally I am on valid status, right?

2. I am also applying H4 along with me, during this period shall my spouse continue working on H4-EAD approved with last employer? (It is valid till Feb 2019), any issues?

3. New employer said as long as EAD has validity we should continue working, is true?

4. Same time we are re-activating my spouse H1B with their employer (we have still 2 years left on previous H1B), if it is approved shall we revoke H4 with new employer which is in process now?

5. I have previously approved I-140 with new employer (also have I-140 with current employer, both have same priority date), they said will re-activate old I-140, can we do that?

6. If they re-activate do I need to do PERM process again? Please suggest urgently.

Topic: EB1C is a new H1B

I worked for 9 years in CTS. I knew many people who got Greencard under EB1 category within a year. This is how they got apply:

- Actual designation is Senior Associate which is equal to Senior Developer
- CTS project them as Managers and they create fabricated organization chart to show some people reporting to them to justify Manager role
- And then start filing in EB1-C category within 6-12 months of their onsite entry.
- Once they get GC, after 6-12 months they leave the company (90%)

Topic: Cognizant - EB1 filing

With my 9 years of experience in Cognizant, I know they file EB1C starting from Senior Associate (SA) level, even my cousin also got GC within 1 year, they projected him as Manager (designation was Senior Associate). I know more than 13 people who got GC's within a year, 11 of them with fake manager experience.

So far who got GC's from CTS, 95% were fake managers.

Since I wroked in CTS, I know CTS files more EB1C than H1B's. Fraud..Fraud..Fraud

Even my cousin got GC within 1 year, his designation was Senior Associate (SA), they showed him as Manager and filed EB1C.

I worked in CTS more than 9 years. After 6 months of onsite tenure CTS files EB1C for all levels from Senior Associate designation. I know many of them who got GC's within 8months - 1 year. They project them Senior Associates (SA) as Managers and file EB1C.

In my tenure in CTS who got GC's 95% all are projected with fake manager experience. And there are few more poeple ready to file in coming months.

What is the benefit of this rule? I am not seeing anything for I-140 people:

1. If we change job on I-140, I think we still have to re-file PERM and I-140, right?
2. Since there is no AP/EAD for normal I-140 cases, whats the benefit here?

First USCIS must revoke Cognizant fake GC's, we should send emails/flowers to UCSIS to revoke them.
85% are fraud in Cognizant GC's, they apply even for small developer in EB1 category, they show them as international manager experience.

if you are Cognizant employee, then you can file in EB1 with fake manager experience and get it GC in 6 months-1 year.

In Cognizant 85% people got GC with fake international manager experience. They shows Senior Associate role in India here equals to Manager which is big fraud. Because 99% Senior Associate just works as developer in Cognizant.

First USCIS must revoke all Cognizant GC's

why should give to preference to masters? First has to give who really have experience and sort it out fake experience people. I know most of them masters put fake experience causing issues to real time experience people.

USCIS should come with proper plan and prefer first real experience people.
