stop insulting me. I have not killed anybody just personal injuries. I will pay heavy fines and go 4 weeks class and get my license suspended for 7 months as a motor vehicle violation as first time offense. Get a life. Even the mayor of NJ had a got a DWI. Not to forget the president of United States. People learn from mistake. If you nothing else to say don't bother to comment. None of guys leave in NJ or know the law, so stop speculating. I have two friends in NJ, I just spoke with them. One just got a DWI couple years back and they never got finger printed. It is considered in NJ as a Motor Vehicle violation. Couple other aliens with pending green card recently got green card without any interview and said won't effect the immigration status. Only way it triggers if I get my finger printed flagged. They never reported to USCIS as it only effected in the NJ driving record no where else. In NJ whether you get collision or not, you get DWI and reckless driving two ticket. If I had killed somebody or fatal then it will be misdemeanor or felony and would have gone to county jail and finger printing mandatory. In addition my DUI lawyer spoke directly with my immigration lawyer as stated only way I will get finger printed if the court find this as misdemeanor or a felony crime, which is very unlikely as my first offense, even that can be plead by extending the suspension over 2 years. NJ laws are very friendly, but they will charge in fines, community time. Cost will be about 5-10K.. | |  |  |

The law clearly states it is motor vehicle violation for first DUI offense. Yes I did hit someone, I will be pay hefty fines and lawsuits with my insurance companies and licensee suspension. I willing to pay all the fines and suspension as long as it does not effect my immigration status. I was temporary arrested but I spoke with my lawyer you will not get finger printed. I spoke with my Immigration Lawyer they said it effects only if you get finger printed which raises the flag in the FBI database. Thank god it is in NJ... It is just a traffic violation effects in your NJ driving record. | |  |  |

Hey I am sorry I think you are wrong. Do you leave in NJ..I spoke with my lawyer they said it is traffic violation, other places like VA it is a crime not in NJ. I will get hit will lot of fines. Nobody was injured just personal injuries that was covered by my insurance. Had it been a felony I would have gone to county jail. So it is neither felony or misdemeanor just a motor violation as first time crime in DWI. Most people pay big fines and get license suspended for 7-1 year. | |  |  |

I was told by my attourney only way they add fingerprints to the database if I was convicted or gone to county jail. I was in a holding cell. My police report does not have fingerprints only picture. Only way it will happen if I get convicted to jail that I will know in 6o days. Or the case will be resolved and only get dwi offense. If the case in resolved and it is not a felony I won't be finger printed.. | |  |  |

Just regarding my case. I don't have H1-B..I have I-485 status pending and using my EAD. How does this effect me. I have EB3 India Labor date nov 2004. I know my interview may take atleast 2-3 years. This is my first DWI offense in NJ. I willing to pay all the fine and court fees and use public transportation. I have a perfect record this is my first major offense other than that I have some speeding here and then.. I did not get finger printing only picture taking in the police report. So what are people talking about finger being flagged and mandatory interview. Can somebody please clarify regarding my case | |  |  |

I did not get a fingerprint at the cell. In my police report I got picture taken that's all. What do you mean regarding fingerprints flagged. The attorney is very good handling DUI cases, but does not have any idea about immigration process. All he said best case scenario drop all cases only suspension 7 months will have DWI in your NJ license. But said no idea for green card... | |  |  |

I am in EB3..I heard it goes to the FBI database thus my green card processed get delayed and I will def get an interview. If it was normal DWI, I would be fine. But mine is worse due to collision and personal injury. I hit two cars in a stop signal when I drove over 60 miles. They took me in the cell and I was unable to blow so they gave me refused breadlizer. I tried 7 times. My friend bailed me out. It was very serious, and I never drank soo much in my life, I blacked out and I was in a rush meeting a girl. I think it happened all in once in a split seconds drunk driving, in a rush plus looking at the cell phone. I leave in NJ and work in NY. I willing to loose my license and suspension, but my concern about immigration. This is my first DWI offense in NJ. I did go to jail for 6 hours...They took pictures. recommendation.. Will this effect regarding renewing my EAD card and I-485 status | |  |  |

I am in serious problem. I got a DWI, Reckless driving, personal injury luckily not fatal, and refusal of breadlizer, and went to jail for 6 hours. I know I made a serious mistake and will pay what is needed and not drive even for three years. I have high priced lawyer they said they will merge everything and have suspension 7-1 year and will have DWI atleast 5-10 year in your NJ. He said it is not criminal as this is first offense, but I do not the effect of renewing my EAD card and I-485 status for green card. My interview may take place 2-3 years as my LB date is 2004 EB3 as Indian.

Hey fellows:
My life in the U.S last 2 years have been very miserable. I had no job since Nov 2008, and it is very frustrating. I have had EAD, but what is the point. Unemployment is so high, and competition is so fierce, especially in finance and banking. But I see that everywhere also. I am not as hot commodity as rest of employers, they prefer more experienced candidate than me. All I am looking for junior analyst in either banking, hedge fund or asset management. Lot of them now prefer CFA, it is just getting more competitive, as there are few jobs available and lot more candidates. Can someone give me any suggestion in terms of jobs.
I am trying to keep positive, but I don't how long I can survive. As you know we have dealt in worst economic crisis since the great depression. I was really thinking if I don't get a job by end of April, I was thinking heading back to India, because economic climate in the emerging is very hot, but I don't know whether it is a rosy as it shows in Bloomberg news, and plus I have stayed over 10 years of my life, I just do not want it to be waisted. Any suggestion in the job front.
Secondly, in terms my legal aspects is not that great too..
I filled my I-140 & 485 concurrently on 2007, and still my I-140 is show status as RFE at Texas center
On February 3, 2009, we mailed a notice requesting additional evidence or information in this case I140 IMMIGRANT PETITION FOR ALIEN WORKER. My employer did file everything, after that, we have not connected and I do not have great condition with him. My lawyer said it is either going to be rejected or approved. Lot of people are saying it will be approved simultaneous when my EB3 is current right now it Oct 2001, and LC is Nov 2004.
Overall it is not great, my first goal is to get a job, and second goal is to get my I-140 approved, every day passes I read the economic news and unemployment higher I just don't know what to do??? | |  |  |

Should I be worried my I-140 is still not approved. I applied in July 31st, 2007 concurrently filled 485/140, under EB3 India. My Labor Date Nov 2004. I did receive a RFE on Feb 2009, and the sponsor firm responded to it, with 5 years taxes, and plus CPA recommendation letter. Right now, I do not work at the firm and have bad relationship. I am using EAD card, but currently do not have a job due to financial crisis. My lawyer said it is either going to be rejected or approved. I rather know it sooner, than wait for the bad news and head back home. Does anybody recommend to file premium process. I checked the website and type the receipt number all it states as RFE issued on Feb 2009
What do you recommend to do?? I do not want waste my time and then in 2 years it get rejected. I am in a predicament. Once my I-140 does get approved I will be relieved, and do not have to worry about the sponsor anymore and can use the AC21 rule under AOS. I call my lawyer he says have patience and told me there is no visa available that is why they are not touching your case. I can not open a service request then the sponsor firm can find out. I was thinking about Premium through the Lawyer under G38 file. If I do not get any response by October should I file Premium process or not?
Anyway please tell what should I do it has been over 2 years....
