Topic: H1B stamping-Canda/Mexico?

livingwater, this is an experience from a very close friend. She want to stamp the passport and she decide to go to Canada. The only problem was when they filled the application there is a section where USCIS ask about what consulate needs to sent all the information, and wasn't Canada. So, when she went to Canada at the consulate they said that they don't have anypaperwork fromUSCIS and she has to go to her Original country.
Keep that in mind and have a plan B and talk to you lawyer.

simple explanation... USCIS, DOS, NVC all of them are lying and the numbers are fake... The truth is they make up the number to look good and to give some excuses if there is any investigation...

It's no a secret that we as H1b we work very hard and sometimes we been exploited. So I need some advice for who has the experience.
My profile is EB3 PD Jan/2006. Employed since '03 I-485 submitted on Jun 30 '07.

scenario 1: I quit. What could happens?
Scenario 2: I got fired. What I have to do?
scenario 3: I've found another job offer but different profile of I-140 and job description (match w/ my background). What my options?

Topic: How long is taking EAD renewal these days..

I think that depend on your case. I applied for mine just because my H1b was about to expire (1 month gap validation). I did it on line, and they response in three weks with a RFE ( Picture and Driver license copy) my problem was that they sent the notification to my old address and took me three months to find out what was the RFE (long story). But It was fast.

Yep... that's true. I applied for EAD and never get a FP notice, when I received my EAD card I have my FP on it. The times tha USCIS had taken my FP ...let's see.. 3 times at the consulate back in my country... three times in the port of entry.. and one when I applied for I-485...

I think they mean spiil over of visas in the current year .. They cannot use old visas as that will require legislation ..

Hello Friends,
i received a bunch of rfe's and one of them is "USCIS is asking for explanation since you are residing in different state other than the employer work site, please provide explanation for the address discrepancy"?
My consulting company is located in mid-west and i work in west coast for a client thro' preferred vendor, is it something to do with employer-employee relationship? and can you give me some advice how i can reply this one?

the main concern is why you're living in a different state and work in another state. USCIS is trying to determine if your company is commiting tax evasion... or maybe you... This is a valid question because there is a lot of ways to avoid tax using different address. Just explain everything and you'll be good.

Yes, you are true. unused/wasted visa numbers can be re-captured by an administrative fix.
which is simple and straight forward when compared to CIR or any other legal immigration bill.




My dear friends... recapture visa is not longer available anymore... If you Check the visas reports they are showing recapture visas... When this happened or how this happened is a mistery... Only i know is during last four years these reports never included the recaptures visas.. since november last year they started to include the recapture visas...and they says that all the visas are used...

Can we say that Pre-adjudicated case = Documentarily Qualified Case, or its more thank that ?



Pre-adjudicated case is like Santa Claus when we were children (or whatever you believe). Just think about it... If there is pre-adjudicated cases bullentin visa should be out at the first of each month and GC will be expedited... None of those thing is happening... again USCIS is Lying about preadjudicating cases.

One more thing... I've found out why the DV program still exist... Just multiply 55,000 visas by $930.00 per application every year...that +50millions every year without medical exams and others fees. The saddest thing is the congress is aware of the situation with USCIS and one solution was raise the amount of visa on the DV program ( I believe two years ago someone proposed to raised it 130,000 visas per year

Palguy is right. This is my experience w/FP: They took my wife, my kids and me when we applied for I-485 Nov'07. My wife applied for EAD Jun '07 , no FP (and no FP is shown on EAD). She renewed the EAD on '08, they took FP (shown on EAD). I applied EAD on Jun '09, no FP was taken and there is my FP on EAD. I talked to IO on phone, he told me my FP are good. I took an Infopass, the IO told me before I get my GC they send me a FP notice.

At the end...Nobody Knows and depends on the IO criteria...

Remember that we are dealing with USCIS. Every single thing that they published or announced, it has a purpose. For example, the Visa Memo about the job description is for denying application and relief a little bit the backlog. I think that the problem would be happened with all those application that been approved with the condition that they targeting on the memo.
From this Particular "new document" I'm thinking in two things:
1) There is a lot of pressure with all the crazy dates and USCIS is blaming the department of state, and the department of state blaming the visa office, etc, etc etc. So this is an excuse or explanation why is the mess, or
2) There will be another July fiasco coming. USCIS is broken.That's no a secret. No immigration reform will happen in this presidency if Obama want to be re-elected. Right now, USCIS is trying to increase the cost of all consular process (for example for B1/B2 visa the actual fee is $131.00, they want to raise it to $148.00), so the only way to get more money is another wave of current category on EB3. If you see how long EB2 and EB1 have been current and the spillover is not vertical (meaning that EB1 goes to EB2, EB2 goes to EB3 and so...) so the anyone can move in to the other category (meaning EB3 goes to EB2, EB2 moving to EB). The thing is most of the people are skeptical about this 'cause USCIS is denying too much application, so if nobody applied, no fee is charged.

When I was in High School there was a song that says "... the money is the blood of the system..." In this case USCIS needs a urgent transfusion...
