They seem to be processing apps primarily from August, and some from March/April. God knows when they're going to get to July...

The current pace of processing has simply GOT to accelerate. There are currently just under 400 EB3 I140 applications from 2007 (in Trackitt) pending at NSC. They seem to be processing at a pretty steady rate of 26 per month (there were 26 processed in the past month, and 13 in the last two full weeks). At this pace, it would take them ~15 months to get through just the 2007 applications! So in February of 2010 (!!!), they'd start working on applications from Jan of '08. This pace of processing just seems unsustainable!

If they keep the current pace, they'll be averaging over two years in processing time for these applications. I thought I'd read a statement that they expected to get down to their 6 month target in the near future. However, if they're to have any hope of getting to their target processing timeframe anytime soon, they need to get through this '07 backlog first, and that would require a several-fold increase in the pace of processing.

NSC please get your act together NOW!!!

Topic: How does one open a SR?

The Received Date for my I140 application (7/2/07) is finally within the processing dates posted by NSC. I'd like to know how one can call and open a Service Request. I've called the USCIS Customer Service number about five times but I can't figure out how to get to a human being. Can someone please help me figure this out? Thanks.

If I understand your question correctly, you're asking how come there are EB3s whose I140s have been approved despite being concurrently filed and not having visa numbers. Let me say two things about this:

1. I have seen two statements from the USCIS - one verbal and one in writing - that said they have been using visa availability as a factor in determining which I140 cases to process. I don't think this is a matter of opinion. They've said it a couple of times now. The written letter was scanned in and posted here on Trackitt by someone a few weeks back. This also explains why more EB2 apps are getting approved than EB3, as there are more people that are "current" on EB2, while much of EB3 has been "unavailable".
2. That said, we don't know what other factors are at play. Even though the above statement seems to be borne out if you take a 30,000 foot view, there are plenty of exceptions that can be identified (as you pointed out). There is an element of unpredictability in how they are processing that can either be because we don't know all the factors they use to prioritize, or because they themselves don't have a robust process and it results in a significant amount of randomness. I personally believe the latter is true. There are far too many August '07 EB3 applications that have been approved even as most July '07 EB3 applications remain unapproved. It's pretty hard to believe that there is a perfect single queue that uses clear criteria to prioritize and reprioritize applications.

Net net, the system is unpredictable. However, one of the reasons some EB3 apps are going slower than normal is due to visa availability (although it's not the only reason).

I looked at the full passage on immigration-law, and I think I've figured out the right interpretation:

TSC and NSC have been using visa availability as the primary criterion for processing concurrent cases and stand-alone I485s. This means that concurrently filed I140s that don't have available visa numbers have been held up (even though theoretically the visa number availability should only impact the I485), while other I140s that were filed around the same time non-concurrently (independent of an adjustment application), or that did have available visa numbers have been processed. They believe that the instance of delayed I-140 adjudication should decrease significantly (presumably when they say "delayed", they mean the I140s that are being artificially delayed due to visa number unavailability).

I haven't got to this stage yet so I'm not an expert, but it seems that if his I140 has been approved and the I485 outstanding for more than six months (which it would be if he filed concurrently), then he should be able to use portability to switch to a different employer without having to start over.

Somebody else should be able to confirm...
