Topic: Soft LUD on Sunday Feb 10, 2008

Wow, your I140 was approved in 2003 and you got a soft update in 2008?

My I140 was approved in Jan 2007 (I already got the GC in May 2007) and when I got an I140 update (and email) from USCIS yesterday I was like WHAT'S GOING ON? but now I see a lot of people got updates, but still, from 2003... wow!

2-3 weeks gap? in my case, 13 month gap!!! LOL!!! At the time the I140 got approved I didn't even have an account with USCIS. I made one only after I sent in the 485s, and then I decided to add the I140 to teh portofolio just in case. I never got the original email (since I was not registered) but now an emai 13 month later? Also it looks like it was updated, some sort of soft update I guess, since the case has long ago been approved.

I remember there was also a soft update in March last year, at som epoint many people reported soft updates on already approved I140s.

For the 485 I got the email (card production ordered) before I got any sort of approval notice.

I guess there is a bug in their software? who knows...

good luck to you all.

my I140 has been approved in Jan 2007, and today (2/17/2008) I get an email from USCIS regarding the approval notice for I140. What? I already got my GC in May 2007.

what's going on? did anyone else get updates on their old I140?

Topic: Advanced Parole, how many copies?

Hi Adrian,

yeah, since I got my CG I don't come here to visit every day like I used to, but I stop by at least once a week. I still have friends going though the process and it's nice to keep up to date with the latest changes and give them advice, when possible.

So even though I don't post much, I still read. I have an extra glass of wine each time I see someone from Romania being approved :) I hope to drink one for YOU any day now :)

Thanks for the answer and links, and MULTA BAFTA (Good Luck!).

Topic: Advanced Parole, how many copies?

Hi, when I got my AP in April I received 3 copies. Mine came from Nebraska Service Center.

A friend just got hers and she only got 2 copies. Hers came from National benefit Center. Does that make a difference?

How many copies do you need when you enter the country? I never used mine since I got the CG :)

Thanks

Topic: Will you be bored?

yes, I am. got the GC in May (I applied in Feb and was expecting it right now in November).

Still come here once in a while when I am bored and I am too tired to start something new, but no, I don't check the visa bulletin and trackitt as often as before. I still have a few friends in the process, and I keep up with their struggle, but once they get GC I think it will be over for me, at least until we apply for citizenship.

Topic: how long should one stay with the sponsoring company?

My best friend was denied his citizenship since he moved right after his GC. I am going to wait at least one year. Thank god, I have a great employer.

what happened to him, he still has the Green Card?

Thanks, so he should go back the the first employer and work there for a while, like how long?
This is basically the same company so things should work out.

Hi, any lawyer here? I want a second opinion

My cousin works for a medium sized company. They have several locations over the US.
He worked at one location from 2001 till 2005 and he started a Labor Certification process there (EB2) in 2004. Then in 2005 he moved to one of their other locations, technically a separate company, but similar name. The TAX ID is different, and his lawyer said that in the view of USCIS they are a separate entity. So he started a second LC process, this time with PERM. But the first LC kept pending. Both were approved within weeks of each other.

Next step was I-140, and it was much much faster to put together the application using the LC from the first location (he did not work there anymore). The reason is that HR department had all the necessary papers ready, including papers from the accountants about company income, etc. To put the same thing together from the second location would have taken several months.

So, he filed and got the I-140 approved, then he filed I-485 and the USCIS asked for RFE, updated employment letter. The HR from the first location sent a letter to the USCIS stating that they offer him employment, wage, job description, etc. So they sent the RFE back and he just got approved a few weeks ago.

The lawyer says this is OK as long as the first employer still keeps the offer open. All you have to do is to prove the intent that you might go and take that offer one day. But you don't really have to do so.

So, my question is: is this true, can you start a LC and then move to a "different" employer (and I put different because practically the first and the second location belong to the same multinational corporation, but legally they are different), and get the green card, or he just got lucky somehow and the USCIS did not notice the change?

He was expecting difficulties, in which case he was prepared to file a second I-140 with the PERM from the second (and still current) employer.

Topic: Reasons for I-485 RFE???

Yeah, in my case both the RFE and AP went to the Lawyer, but the EAD came straight to my address.

Are you back in the US? BTW: you have 60 or 90 days to reply to a RFE.

Good luck!
