Same case with me, my wife's EAD is approved on 10/23 and mine is still pending, both applied for renewal same day (08/29)and I am the primary applicant and my wife is seconday.

Don't know the reason why they are doing this to us,.

Topic: H1B petition approved - but never worked in the US

Folks,

I have a friend who had the H1B petition approved and Visa stamped (2004 -2007) , he entered into US only once on H1B but had to go back to home country without starting the work due personal reasons.

Now he wants to come back to US and would like to know if he can apply for extension on the same H1B petition? Or does he have to apply for a new H1 which is subject to cap?

Can some advise please?

Folks,

Just wanted to update on what happened with my case:

I called the Chennai consulate couple of times and also sent emails twise explaining that I need to return to US ASAP otherwise would incurr financial loss both personally and professionally.

Not sure if that triggered anything, the very next day they cleared me from PIMS and me and my wife got our passports back with Visa stamped a day later, it was just two days before we were to board the flight.

Thanks so much for giving your valuable suggestions folks, I called Chennai office today and was told to wait until Thrusday and make the change in travel arrangements, they said they did everything on their side and waiting for verification from DHS office back in US. I really wish if there's a way to contact DHS on this?

I am really frustrated on this sucking waiting process of USCIS system at every stage, Labor stage, 140 stage , 485 stage etc etc....

I recently applied for H1B revalidation ( 4th time) at Chennai consulate in India, attended the Visa interview on Oct 16th, the interview went well, consular officer didn;t ask a single question just took relevant docs and said we should receive our PP's back with in a week, which passed already.

I contacted Chennai consulate via email two days ago, and got a response that our case is pending PIMS verification. They didnt give any time frame on how long I have to wait.

I have my return travel booked on Nov 1st and really concerned about the status. This wait really sucks!!

Do you have any idea how long does it take to get this damn PIMS verfication to go thru? Please share if any has experienced simialr situation? Just so you know, this is my 4th H1B stamping and I am with this company since last 7 years.

And my wife is changing her status from H1 to H4 ( is working on EAD now)

I almost lost hope and until few moments ago where in I saw a soft LUD on 485.

On a lighter note, just wanted share that I just noticed today a soft LUD on mine and wife's 485. Have you noticed same on yours?

Topic: approved 140 went for consular processing to National Visa Center

Dont worry too much, it happened to my case as well as per screw up by my attorney, they mistakenley selected CP in the 140. However, they sent a letter to NVC to correct it later as AOS and not CP. Because of the fact that you filed 485 here and filed for EAD and AP, it proves that you are on AOS. So you should be fine.

The only issue that most likely happen is at the time of adjucating your 485, when IO realizes that the approved 140 is not with the service center they will request it from NVC which could add further delay in processing. I am suffering from it and it has been almost 4 months and now the dates are retrogressing from tomorrow.

Small mistakes such as this could be costly some times. But its not that it will affect your application but surely adds additional and unnecessary delay.
