Topic: Can H1 do side business while awaiting 485 approval (EAD is aproved and over 1 years old.)

I asked exactly the same question to my lawyer's office a few months ago, and their answer was that should I decide doing so, my H1B status would be no longer valid, and I would have to be on AP from there on. So, I had second thoughts and forgot it.

I'm not a lawyer, and I'm just recalling a past experience. Hope it would help you to make up your mind. Patience is the name of the game. Best wishes

Mangy, unfortunately you did not request the only help available, so it's going to take a little bit longer for you to get the residency depending only on your own effort and anxiety.

Topic: Anyone entered on AP, and got H1 Extension?

Hi everybody,
I just came back to the US from my vacation abroad, last Thursday on AP. I wanna use my experience to answer the questions posted on this trend. I hope it'd help many people to overcome their fears while traveling on AP:

a. used AP to travel back to US

Yes my family and I used our APs to re-enter the US.

b. s/he never used EAD to work (neither before departure and nor after returning back to US),

I've never before used EAD to work, my wife is using her EAD.

c. after return s/he continued to work on her/his left over H1 validity period,

I'm continuing working on H1B, my wife on her EAD.

d. Her/his H1 is about to expire, and the H1 extention is filed.

H1B extension filed on April, previous H1 expired July 15 while abroad.

e. Her/his H1 was about to expire, and the H1 extension was filed, and H1 extension was approved.

H1B extension approved while abroad, so that's why we needed to use AP to re-enter the US.

f. Her/his H1 was about to expire, and the H1 extension was filed, and the extension was denied on reasons except due to approval of 485 during H1 processing period.

N.A

If answer to (d.) is yes : did you recieve any RFE till date or just waiting for extension? Any experience, please share?

No RFE received, just notice of H1/H4 approval on July 16 while abroad.


If answer to (e.) is true, can you share your experience on extension?

No questions, no RFE. Only e-mail from CRIS announcing approval, new I-94 cards followed one week later.



At port of entry my family and I were interviewed as usual. Once the process was completed the USCIS officer kept the paper work, and asked us to go to another room and wait. No pictures, nor prints taken at this point. After about 30 minutes in the waiting room, another officer handed us our passports back. No questions asked; no photo, nor prints taken. Just welcome home. Interesting experience. Thank God, no hassles!

Topic: Help!! What date is considered for processing time?

Same situation here (receipt date Aug 13, website showed Oct 10 date). Called right away. Rep transferred call to IO, she told me that they go by the date on the receipt ; so don't worry, the Oct date is just the date your info was uploaded to the computer.

Topic: Biometrics Notice (Fingerprint request) after submitting I-140 & I-485 concurrent Aug. 2007


Hi,

My husband is on a EB-3 category, with PD Mar 2005.
We received a request for biometrics BUT we haven't even received a notice for I-140 or I-485,
or the AP or EAD documents...nothing.

What does this mean? Can somebody please enlighten me? ;)
From I've read, it basically doesn't mean anything...since they can keep asking you to
do the biometrics 2 or X years from now, when your I-140 gets approved or when they decide that
you should spend time and money again on this....

Any feedback would be great!

You don't need to be concerned at all, just be glad that the USCIS is taking the initial steps to have all your info in place by the time your PD is current. What it means (biometrics notice) is that your I485 application was received, processed and there is a service center near you with not a large number of applicants that's going to take care of phase one in the process. It's possible that soon you'll receive your AP and EAD approvals if you requested them (That's my case, filed on Aug 13).

From now on just relax and wait for the October 2008 bulletin to see what the retrogression date is by then. Enjoy a good glass of wine in the meantime.

Topic: Please type the correct info while adding your case!!!

Guys, it seems that some people don't understand what info they are asked for when adding their cases to this website. Many people are typing the "USCIS notice date" on the "USCIS received date" field and that's causing two issues:
1- The trends and stats are innacurate cause there is a gap between the date USCIS received the docs and the actual date they produced the receipts. That difference is causing an unreal drop in the average time USCIS is taking to answer the cases, and making the stats useless.
2- Some people are getting frustrated because they see approved applications apparently received by USCIS way after the closing date of August 17, and they still have not heard anything about their cases filed before that date.

So guys please be careful, and remove and/or update any wrong info that can cause variations to the trend. Remember this is a common endeavour and we need the info to be accurate, for this helpful tool's sake.
