Topic: Approved after 5 years of wait!

Hello all,

I wanted to let you all know that I have finally received the GC approval e-mail today. I appreciate all your insights and help. A quick question - what is the difference between welcome notice and card production ordered as different people seem to getting different e-mails.

This is the message that I got:

Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Current Status: Notice mailed welcoming the new permanent resident.

On September 2, 2009, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before you get your new card call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.

I see that the processing date for EB application at TSC is 23 August 2007 and not 1 September 2008... That is of today's date. Am I missing something?

Can the existing EB-2 be filed again as EB-1 (especially in light of the long EB-2 wait)? What is the process? What are the pros and cons? Can that be done by a candidate or the petitioning company?

How does one know that their application has been pre-adjudicated among those 120,000? Do they get a soft LUD, an e-mail or a letter? Or there is simple no way of telling till approved?

Hello,

A few months ago I sustained severe injury to the spine. My insurance company is insisting that I file for social security disability, and I do not want to file especially in the final stages of the green card process. If I were to file for social security disability benefits, will there be a problem in adjudicating the I-485? I don't want to jeopardize the GC process after waiting more than 4 years!

Any thoughts or comments?

Should I retain a lawyer to get the entire file (LC, I-140 and I-485) through FOIA, or is this enough that I can do so myself? My current employer refuses to give me a copy of this for my records! The lawyer has asked for approx. $400 for this. Thoughts?

Topic: A New ICE rule, especially for people who get laid off in this awful economy...

Hi LRIndy,

I was a little skeptical about this as well when I met with the lawyer today. She asked my husband to immediately go to H4 for maintaining status(though I have I485 pending and he is a dependent with an EAD). Apparently in this economy many people are losing jobs and ICE wants to make sure that people maintain a status somehow and not depend on the EAD. I will ask her for a link that supports this and post it when I have it.

Hello all,

I wanted to share a new rule that my lawyer shared with me this morning. This has not become a law yet but is apparently strictly enforced. Anyone who gets laid off should consider going under a valid status like H4 immediately. Apparently ICE and CBP have started deportation proceedings against people who are without a job and with an EAD with AOS pending (the way it used to work till a few months ago). Just thought that I would share this with everyone.

I think that the processing date depends upon when the USCIS Service Center received the application and not the PD. Just my 2 cents!
