Topic: Immigration reform will start this year!!!

I've been waiting for one for the last 8 years. Did it happen?
Even if it happens, you may not be the beneficiary of the reform or it may take years for it to take effect.

Essentially, Obama promised an immigration reform, but the priority of which at this point is very low. He has other important issues to tackle. As other posts said it, he will do one before the term ends to show to constituents that he did (or tried) everything what he promised so that he can get re-elected again. 2011 is a very good time-line, plus economy should recover by then. It is easier to have immigration reform talks when you need those extra people for economic growth...

I would suggest you to get with your life and not to hope for anything any time soon. Just be realistic!

Thanks, Jhaalaa.

Summary of my status: Perm approved, EB-3 140 approved, no pending 485 as I am still not current. Lawyers filed me under EB2 first but then decided to withdraw and re-file under EB-3. So, if employer withdraws i-140, it is still important as I have no 485 pending...

Next week, I will try to get an appointment with a local attorney (can't use my employer's counsel). I will try to go EB1 or EB5 route. We'll see if that would be possible. Other than that, I don't think there is anything else for me to stay in US. I am actually thinking going to Canada or somewhere else where I can accomplish the venture as long as I can get good qualified workers. I am meeting with some folks to discuss if I can temporarily go to India as it is cheap there and plenty of qualified workers and they know english...
So, we'll see. I still keep my fingers crossed... Maybe, something works out.

bstar,
if you can get financing, then do it in this market (of course, depending on your specific business idea/market)... Human resources right now are abundant and fairly cheap for some basic/"factory" work, such as web designers, software engineers, etc. Some businesses it takes 12-24 months to develop and test out before complete roll-out. So, by the time, it is ready for the market, the economy will improve (I hope in 2010-11). Timing is the key!

My country is not eligible for E2.
But EB-5 might work. Do you know whether $500K or $1M should be my money or not? All of the investment money would come from US venture capital firm. Yes, I might need to talk about EB-5 options with an attorney...

Does anyone know what options would work for my situation to get my GC differently than waiting for it thru EB-3?

VC (venture capital) firm just offered me that they will invest in my startup. But this means that I would have to leave my current employer, who most likely will withdraw my i-140 and will not file 485 when my EB-3 becomes current. What status can I go to? so that I can still immigrate to US and remain here running the startup. This is like dream come true in the worst possible time... I got the greatest opportunity and financing to bring some unbelievable idea to market and I am not sure if there is a status that I can change to in order to make it happen...
Does anyone know of any way? Please, God, be there a way!

Topic: 'S' corporation on EAD


Anyone can elect for Chapter S. The only requirement is you need to be resident. To be a resident for IRS purpose you need to be in USA for 180 days. The difference between C and S is that you save double taxation with S corp. And your profit or loss is stated on your personal tax return. Consult any CPA and he shall advise you.
If you have a Employment authorization Card you can elect S chapter.

But to be on the safe side you can stick to C corp and when you have a GC you can elect Chapter S.



IRS definition does not apply to S-corps. S-corp is a pass-thru entity, to be an owner of one, you should have US citizenship or GC in your hands. EAD person can be employed by S-corp, but he/she cannot be an owner/member. When we do tax returns or any accounting work for/with S-corp, we ask for copy of GC or US citizenship.

This economy is such a perfect time for starting numerous new business if one has a brain! Oh, well, we'll sit and wait for one "sunny" day...

That's not true, its around five years.



No, it's not. check the visa bulletin. 1JUL2004. It takes 5-6 years (not 1-2) on average.

Another option is:

sign up as a reserve in the army or go full time there. Within 12 months, you will get US citizenship and processing is super fast for naturalizing military. Until then, you could just visit her once in 3-4 months. Good luck.

Yes, I've just received my FBI records and I do have that arrest on it.
The reason I've answered 'no' in the first place is when I called the local court house,
they told me I didn't have any records at all. They've even issued me a letter stating
I don't have any criminal records, including arrests, in their county. So I figured the arrest was
dropped off the record somehow and didn't mention it, after all it didn't lead to anything
serious, like convictions.



How did you get your FBI record? Did they send you a copy as part of the 485 filing? I am just curious how I can receive one to make sure what FBI has on me...

have you checked your criminal record? There are many companies that provide such services... If it is not there, then you might (and only might) get lucky and USCIS won't know about it. But still you will always be subject to removal as you lied on the application. Please consult a good lawyer... You might still be able to withdraw the current application and re-submit one with correct info (by marking that you were arrested). Then you take a lawyer with you to interview and try to persuade the IO that it was a mistake and will never happen again...

Why not? Makes total sense. Folks who have been here for over decade legally should get the GC.

Look at my ties to this country:
My child is US citizen...
My parents are LPRs since 2004, eligible for citizenship this year.
Lived here for 13 years. Own property.
Still no GC.
All my friends are surprised too... Da-a-a!

Topic: March Visa Bulletin?????

Last year in march they started moving forward EB3 dates fast to make sure that they get enough cases to use the annual limit. I hope they will start doing it this year around the same timeframe... March or April.
If they use the same logic as prior year, then EB3 dates may jump 6-12 months in March or April.
But in few days (I hope) we will learn the fate.
