Topic: Can I wait my I-131 while I am in Turkey?

You will have to return within the approval period for your 2nd AP ( July 19th 2014) which they gave you based on your family emergency.

In order for you to stay longer you will have to come back to US, receive your normal AP papers and then leave, this case u can stay max upto 6 months out of USA.

If u dont return prior to July 19th, which is the current approved period on your AP, your AoS status will be considered as abandoned. Please consult your immigration lawyer and make the decision. Its understandable the situation you are going through, but you need to be careful about maintaining your AoS status. Dont make your decisioned based on emotions, be practical here and comply with US immmigration laws.

Topic: Will CIR pass by end of this year

Nothing is FAIR in this immigration system.

CIR is a solution to bring some kind of sanity in this immigration system, but we are stuck due to congress's inaction and political parties fighting over how to legalise millions of undocumented which is going to be a huge "vote" bank for whosoever helps them gets the legal status.

Hope some kind of compromise emrges in the next congress. This congress is dead for now until the end of 2014. No immigration related ligislation on the agenda.

NSC sucks big time this year for processing Advance Parole, many indians who are anyways suffering due to retrogression and already booked their travel tickets to india for summer 2014 travel, either cancelled their tix with some financial loss or postponed their travel plans anticipating they will receive AP document priro to their departure.

This is really SAD story and we shoudl report this issue to USCIS ombdusman's office and make sure USCIS process AP on schedule and stay within their published processing time limits posted on their own WEBsite.

Thats 100% correct information, CBP will process your AP and give you I94 valid for 1yr.

You can use your renewed AP for next travel. Typically folks entering on AP will receive I94 valid for 1Yr.

You will need original doucment for Travelling, CBP will not accept "Photocopies" as they need to process your return with a valid "Advance Parole" document.

Please send original EAD/AP document to your wife ASAP.

Topic: Traveling on Emergency Advance Parole on F2 Dependent Visa

Your Wife should be able to travel back to US using the emergency Advance Parole doucment issued to her by USCIS.

Since you and your wife are AoS status now after filing (I-485) you are eligible to travel outside of USA on Advance Parole, expired F2 will not be an issue here.

U should be fine to travel with EAD/AP card, your RFE for medical is part of I485 process, u respond to that as what they have asked for. RFE will not create any issue at PoE, so long as you have valid travle documents in this case you have valid EAD/AP.

EAD/AP will enable your travel to canada. Enjoy the summer. :-)

wait till u get the USCIS notice.

What u read about local transfer is correct, its mainly for PErsonal interview if some of the initial evidence supporting docs are not good enough for USCIS service centre adjudicators to determine if your case can be approved for the benefit you applied for, i nthis case it is AoS or Green Card.

U can take infopass, but until local USCIS office receives your case papers infopass will not be much help.

Please try to collect all the supporting docs originals and see if u can get your company attorney with you for the personal interview.

Congrats to all EB-3 india folks who rcvd their Green Cards during Sept- Oct 2013.

Hope everyone from this Jan -Sept 22, 2003 pool is approved by end of Nov 2013 and hope for some forward movement for EB-3 India, though we have to still rely on SO numbers in the Q-4 of FY 2014 to get some relief.

its been a long journey for all of us, trackitt kind of bring us together.

I hope the immigration reforms pass in the current congress and we get much waited relief, this process is really shame for US, folks coming from india and china waiting for decades just bcos they r born in those countries is unfair and we should at least get the country cap limits out of this current immigration law. it will help lot of EB-3 india folks.

I am surprised on u still RiR and should have gone through your Labor approval much faster than the unfortunate folks like us who were victims of State Employment agencies backlog and then evntual move over to DoL backlog centres for Labor.

When di u file your AoS ( I485)? I mean EB-3 India was in good shape for the folks who got labor cleared in RIR process within months. Maybe during fiasco when they approved things in random, they just overlooked your file and didnt approve your case.

U should be getting your approval by end of this month, hopefully now that DoS started working we expect the speedy approvals.

Hi Murali,

If u have the legal documents after your divorce, you could submit it to USCIS through your attorney and file an amendment to your AoS, that should help USCIS moving forward, as they know your ex is no longer your dependent, else USCIs might be thinking you guys are preparing on her RFE response and may withhold further processing on your file.

Its better to file legal documents with USCIS and be clear on the situation rather then keeping her as an dependent and jeopardising your own case.

Again your attorney is your best resource, but as we all know sometimes they are simply axx hxxxx and dont know more than you and i know about Immigration laws. also google on USCIS Website, and see if you can find any information on the situation like yours while pending AoS, one goes through divorce process and what are the implications of that sepration on the primary and dependent applicants.

Looks like your case is scheduled for Personal interview.

Keep all the docs ready, soon u will receive notification to appear for a personal interview at your Local USCIS office, they will let u know. This coudl be as simple as FPs issue, so dont worry just be ready with all the docs u provided while filing your AoS.

Hope all of remaining members like SAMNYC would receive thier Green cards soon to celebrate Diwali - 2013 at the end of this month.

Guys US govt. shutdown is almost over now, so hope DoS will speed up the VISA numbers requests processing and we start seeing more EB-3 India approvals in coming weeks.
