USCIS knows pending AoS applicants is their cash cow by generating revenue in EAD/AP renewals, why would they consider giving us any relief.

In this country evrything works on funding, so long as USCIS is funded by our EAD/AP renewal money, they care less...they will rip us one way or the other.

Legal immigrants do not have any VOICE in the Washington DC....Obama's promises for immigration reforms was just a promise during the 2008 residential election, he doesn't care about immigrants...maybe he will just talk about it again during 2012 campaign.

I dont think Indian consulate employees here will ask for any special favor or demand bribe to expidite your application.

If you talk to consul general and explain your situation, and provide evidence to support your request they will expide your application, but at times they have to depend some kind of background check reports too from india andthat might take a while.

One never knows these Babus can do anything for money.

We have the good example of LIFE act (245i) and how badly it scrwed us during labor and now in the AoS phase.

Politicians didnt plan well for the 245i mess, hope they dont repeat same mistake again with this cr4p CIR.

If you are dreaming that they will clear the EB backlogs before CIR, you are fooling yourself.

Remember guys he is a Hispanic supporter, he wont do anything for us, he care damn about EB immigrants.

Dont get HIGH on this news of CIR....CIR is complete cr4p for us and somehow the dems are trying to oiggyback on EB legal immigrants and using our support trying to get amnesty for 12 million undocumented workers.

If you look at any immigration forum around, you will see its only Indians who are concerned about the retrogression, rest of the population are just watching us from the fence. I dont see any action or initiatives whatsoever from RoW community.

Until we all Indian,Chinese, RoW folks shows any kind of unity or raise our concerns for the VISA recapture BILL nothing going to happen.

When senator sees the letters or Faxes from indian constituents only for VISA recapture bill, they dont care, but if they start receiving similar messages coming across from RoW and Chinese folks , it may weigh into their desire to help us.

Lets start the campaign on trackitt forum for all members irrespective of their country of chargeability...then only we will see some success, else it will be viewed oly as Indians only initiative and nobody really cares for indians any more.

I guess somewhere I read that these extra numbers coming from FB, will be given to most retrogrssed categories and it is not subject to the normal spillover rules and EB quota.

This is the reason why they used up more numbers for EB-3 india during FY2007 when they received additional FB numbers, and all these numbers they used up during the Q-4 of FY 2007 ( July-Sep 2007).

Lets wait for Ron's explaination, he said he is going to address it soon.

Most logical reasoning is in the pastt hey have used the numbers from the FB quota, so it is posssible that thye will get this additional 8K numbers and used for the most retrogrssed PDs. USCIS has done this in the past and helped clear some of the EB-3 india backlog.

I hope and wish they use additonal 8k to clear the backlogs based on oldest PD cases for all EB-3 (Row, India, China, Phillipines and Mexico).

They will roll in these numbers in the Q-4 of FY2010...so until then just wait and watch.

Politics is Dems wants to ride on CIR bandwagon using LEGAL immigrants like us, and republicans are dead against ILLEGAL or undocumented immigrants.

I hope our writings to the US senators and Congress Reps helping them atleast to address our concerns and separate us from the 11 millions.

So long as we are tied up with CIR, we are doomed. Every Democratic Rep I write to tells me that they understand the concerns and they are for legal immigrants, but if at all any relief it will be part of the BIG picture which is CIR.

CIR is not happening in this country, no politician would like to side with 11 million undocumented workers, when the country is facing 10% unemployment rate...It will insane for them even to talk about any kind of immigration reforms.

Only hope is by some kind of ammendment they could re-capture the VISA numbers for EB immigrants....that Hope is kind of keep me going.

Dont worry the SUMPI guy wont BARK again....He was just trying to be over smart and every now and then we bring up some kind of fruad issues in this forum, peole like him will jump into it to disrupt the discussions or divert the subject of the discussions.

One thing for sure when USCIs becomes suspicious against EB-1C fraud or they get any RED flag while wprking on those cases, they will make life hell for those fraud folks and their employers...its just few lucky ones got away with it.

Monday is federal hoiday (Columbus Day)..maybe Tuesday Oct 13th morning....but do not hope it to be very good news for EB-3 india.

Oh law firm website is kown for making sensational headlines. To be honest their isnt any legislative bill for the legal immigration relief.

Why dont you understand the reality when their is a smoke means their got to be some FIRE....its not that folks are suggesting every EB-1C is fraud, what people are suggesting is that many companies (US corps and consulting companies involved in US projects) are now using this rout to get GC faster, when people are suggestign they have seen peole with lower skills are also able to manage the EB-1C ,their must some TRUTH in their allegations.

So dont taker this as anything personal to you...people are just highlighting this fact and what i would recommend them is to go to USCIS and ICE and let them know whats going around them, if they are serious about highlighting this fraud to USCIS.

If you are so sure about the known fruad in the EB-1C category, why dont you report it to USCIS leadership journal. Its as simlae as that, whining about it in this forum not going to help getting rid of this fraud.

U can be anonymous poster on the USCIS leadership journal and let the USCIS leadership know this is what happening in the EB immigration system which is very subjective and every category has a potential to abuse the system.

USCIS do have ways of verifying the facts, but in this system many things can be manipulated and people who are SMART and competent Attorneys are able to do it...its USCIS job to work on these issues, just being bitchy about it in this forum not going to help your cause.

If for some reason USCIS can not approve these complex 245i cases which are in Pending status due to evidence verification process, then YES EB-3 india PD will move, but it wont jump very much, maybe around 2002 beginning level.

I still have my doubts about the USCIS pending inventory data, noone know if thats accurate data.

My only hope and expectation from USCIS is to start approving the approvable cases in the order of PDs and receipt dates.

Honestly people have lost faith in anything happening with this broken system, where fraud means under the name of legal loopholes are being used to get ahead of line.

All i can sense is nothign works without lobbyingin US congress, so long as legal immigrants like you and I are paying taxes and not a liability on the govt systems we will be ignored.

Every time i write to my local representatives, they will come up with the respone that we are working on CIR and we will keep you in our thoughts...this is BS...all dems care is to please their Hispanic vote banks, thats the bottomline. Weak Economy is another excuse, VISA recapture is being discussed for past 5 yeras ever since the retrogression began.

I am not at all shocked when i see poor response to any of such initiative, bcos people have realised that their is noone really cares for legal immigrants.

Unfortunately it is TRUE some BAD apples and Greedy consulting companies are going to bring down this H1B VISA Program and eventually the EB GC program too.

Guys ignor the hatemonger "marek12". Heis going to be disrupting all healthy threads.

Keep the discussions relevent to OP's concerns about EB-3 India PD movement and contiue disucssing EB-3 india issues and explore some good ideas on getting some relief for all of us.

This hatemonger started another thread attacking indians, dont know his intentions but other than being jeolous I dont see any other reason.

This is a very simple RFE to answer and you can answer it on your own.

IF you think attorney's charges are unreasonable then you can change your attorney with new G-28 form for attorney representation...or if you want to reprsent yourself you will have to write to USCIS and let them know that you will be self representing your case and the attorney on file for representation be removed....dont know if your employer allowes to do it or not...but in the most EB cases we dont have any choice, its just few small comanies give you the option of choosing your own attorney.

Inventory data suggests that they do have enough cases for EB-3 india with PD in April 2001.

IF those are not easy cases to be approved and requires some kind of verification/validation work, then YES we might see some forward movement in Nov 2009 VB.

I guess the TRACKITT members who posted their PD data in this thread and are on NIsra's spreadsheet would be able to verify if they received any approvals.

Some folks started theory USCIS is only looking into EB-2 adjudications, its hard to believe, but its USCIS they can adopt such policies and they are good at changing rules in this game at their own convenience and to make them look good in their efforts to clear the EB backlog.
