Thanks lampbreaker.

My question now more specifically is, take the case in which she applies for H4 COS after I get H1B approval (say on June 15 2016) and then stops working. When she stops working she kind of loses her H1B status, but by the virtue of the fact that she applied for a COS she can stay back in this country till Oct 1 (when her H4 will be kicking in). What will happen to my H4 and my H4-EAD then. Will I also lose my H4 status and will my EAD become invalid and hence I not able to work will Oct 1 ?

I am currently on H4 visa and have an EAD card (dependent on my wife who is on H1B) that is valid till Sept 20, 2017 (which is same as the validity of my wife’s H1B).

My current company is applying for H1B visa for me this year. Since my wife wants to stop working in order to take a maternity break, when is the earliest she can become my H4 dependent, assuming I get my H1B visa selected in the lottery and approved thereafter?

Can she apply for H4 when I receive my H1B approval (which is usually some time in June 2016) instead of having to wait till Oct 1st 2016, when my H1B would kick in? Will that jeopardize my H4 status and hence my eligibility to continue working?

Isn't it a grey area still?
Practically speaking it is hard to see why USCIS would go behind H4-EAD holders and revoke their EAD's once the I-140 has been revoked. In my opinion, problem will happen only at the time of renewal, when USCIS would re-check again the status of the I-140 and the applicants eligibility criteria.

Also in my case my wife also has been on H1b for 6+ years, so I am eligible for EAD based on that criterion too. So how will USCIS treat it?

I think nobody, including the attorneys correctly know about these things.

I wish more experienced members like Karthiksubbu or Kamakazee replied to his here. Or can anyone share their email addresses. I remember seeing their email addresses in this forum before. But I dont see a way I can search it out now.

If I-140 is revoked or cancelled, 'H4 visa' wont be affected (just to be accurate). H4-EAD also may not affected (this is my understanding). But it may only affect the H4-EAD renewal. But if the principal H1b holder has had 6+ years of stay and extension, the H4-EAD can be renewed based on that eligibility-criterion.

So my question now is more about the priority date. Will it be retained or not, for the new I-140 application by the new employer.

I know this has been discussed several times in this forum before. But since it is an important issue I thought of asking it again here and know the latest intel on this.

So now if the primary H1-b holder switches job (thus maintaining the H1 status), the H4-EAD is not going to be affected and it should be valid till the expiry date, right? (irrespective of whether the employer withdraws/revoked the I-140.

One related question is: Will the original priority date be retained when the new company applies for I140 again? There are two cases here 1) I-140 not revoked 2) I-140 revoked.

My understanding was that the priority date will be retained if the I-140 is not revoked by the employer. But I talked to an attorney today and she told me that once the H1-b holder changes job, the previous I-140 will be 'naturally' withdrawn or revoked. I am confused hence.

Any thoughts on this will be appreciated. If this could be asked in a different forum here, please let me know the name of that forum.

Hi everyone who have got their EAD cards,
Could you all please update the tracker as to when your EAD was received, when you get a chance? Right now only a small fraction of people have updated the EAD receipt date in the tracker.

My case got approved yesterday and am trying to know when I will get the card in hand, as I have a pending job offer and need to update my employer.

Got my approval today. EAC15906801**.
Have been restlessly waiting for the last several weeks since the time people started getting approvals. Most of the people before and after me got their approvals much earlier and I was the only one not approved near and around my series.

Good luck to everyone else. Thanks again to Anirban, Rashi and everyone who strived hard for this rule.

I lost my OPT-EAD last year after my school unjustifiably terminated my SEVIS (after doing 7 years of graduate studies in this country). Thus I lost my hard-earned job etc. So, if not for this rule today, I would have left USA for good earlier this year.

That seems to be correct. But background checks dont take much time. When I applied for OPT last year, they did not touch my application even after 90 days and I put a service request and then I got my EAD within a few days. So it means the background checks for EAD-granting is not very time consuming. So it is hard to believe our applications are delayed just because of the time entailed for background checks.

Folks,
I think that the processing is done based on a mteric concerning the principal H1b holder, like the priority date, I140 receipt number, or H1B receipt number or so. A random processing wouldnt make sense, not only to us, but also to USCIS.

It would have been great if folks whose I765 is approved could share their priority date too, so that we could analyze.

I am wondering if USCIS should be sued for the random processing of applications? I think they have to make transparent the reason for this random processing or explain the basis for the sorting of applications.

Well I am in similar situation.

I lost my OPT due to 'poor luck' (in fact racial discrimination and misuse of authority by my school) after doing 7 years of graduate studies in this country (MS+PhD). So I could not take up my job offer and since Dec 2014, I have been waiting for this rule and the EAD card. My wife has same H1b history as you.

We would have left this country, if not for the H4 EAD rule.

Haven't come across any yet. I bet Vermont is super slow. I cant forget my COS application with VSC that was not processed even after 5 months ! Lucky are the ones whose applications went to CSC.

I did a google search to know what it means when the USCIS status says "your name is updated". Most people say that they got their approval (of whatever form they applied) 5 days after this status appeared.
So as we have been surmising. people who got this update in their status should receive their EAD some time next week, which we have to wait and watch.

I am quite upset about the Vermont service center. They are terribly slow. My COS application with them earlier did not come through even after a 5 month wait and since then I am quite upset about them. I hope they don't show their laziness with I765.

Got my receipt number. Application re-routed to Vermont service center.

Vermont processing center is in fact very stupid. My H4 (change of staus) application itself was not processed even at 5 months fromm the date of application and I had to travel to India to get my H4 before May 26th.

I am afraid they will delay the I765 processing also. When my H4 was still pending in April 2015, the processing time for H4 was backlogged to August 2014 (as opposed to the normal 2 months processing time). I am hence very skeptical about Vermont.

Folks in California and Phoenix are lucky I guess. They always have had normal processing times alteast.
