Topic: July 2007 filter - NO FP Yet

My friend and his wife filed filed for I-485 (I140 approved) in July 2007 and haven't received FP notice. Online status shows pending. They talked to lawyer (famous DC immigration lawyer) and he told them not to worry. Is any one in similar situation? What are his options and how can he trigger FP notice to be sent?

Topic: Getting raise after GC Approval

Looks like either you or your employer or both mislead about salary not to be higher than LC. If it were your employer, he really took advantage of you. Average pay in 2008 for similar experience is much higher than that of 2001 and if you factor in your experience all these years, you have lost ton of money. I am sorry about that. Now don't lose what you have always deserved even for a month. Why settle for just 20% raise after 7 years of no raise?

The requirement is that you should be working in same or similar position as stated in LC (actually what is specified in immigrant petition i.e, 140 counts) till/after you get your GC. And it is a requirement that you should at least get what is offered in LC. To give an example, I was getting about $35K higher than LC (my LC wage was very low) at the time I filed for I140 and and now more than $45K diff and I see no problem. Unfortunately couldn't demand for raise as my new company (gc sponsor got acquired) doesn't care about GC status as they anyway do not sponsor H1Bs.

If you are approved.. you are approved. So Just relax.

Typically, if no additional bio metrics required, you should get Welcome notice + Card Production Ordered emails. You will probably receive Approval Notice email, but may not actually receive the physical notice. In my case, I got all three mails, but only received Welcome and physical card.

If additional biometrics (ADIT processing or something like that) is required, you might get Approval notice only (no CPO or welcome). You might want to read the approval notice to see if there is a mention of it. You might want to call USCIS to confirm.

Also, if you need to travel outside, take an infopass and get your I551 stamp on your outside by showing the approval notice. If you dig into forums, you might find several people have done this.

Topic: I-140 and I-485 both pending,Applied for Advance Parole( Denied)

Is your H1B pending for 1 1/2 years i.e, from Jan 26, 2007?? That is quite odd. According to my lawyer, you can work on pending H1B for 240 (or 180?) days only. Did you call USCIS and check the status of your H1B application and make sure if it is in fact pending and why? All my H1B extensions got approved (usually 2 - 3 months) after H1B expired and never had a problem.

The fraud comes into picture if the company has the permanent offer for you (thats why an immigrant petition is filed on your behalf), but you left the company too soon giving it the impression that you do not want to stay permanently. If company lets you go because of financial difficulties or any other reason, then you can always argue that you intended to stay with the company permanently. Just get the proof from the company about lay-off and you can show it if you were asked during the naturalization.

There is no such rule that you need to stay for 'X' amount of time with the employer after getting GC based on employment. It all depends on whether IO cares about specifics of employment history during naturalization and look for any red flags. If IO sees that person left the employer too soon (what qualifies as soon, is left to IO), you may have to be prepared with valid/convincing reason. If IO has sufficient proof that you have gotten GC fraudulently, there is a chance of naturalization app getting denied and even worse deportation orders.

I have read few cases in news channels where people have received deportation orders for incorrectly reporting marriage (actual marriage or time of marriage) and relationships to obtain Green card.

I would say, just sleep on it. You status is already adjusted from Non-immigrant to PR. If you get a decision about I129, just inform your lawyer and ask if you need to do any follow up action, but still nothing to worry.

I got my pending H1B extension approved 2 weeks after I485 approval and also I received my physical cards by then. Informed my attorney and she told (as expected), H1B approval/denial does not change anything regarding PR status and I can simply ignore it. In fact she didn't even send me H1B approval notice :).

Topic: painful situation

I am really sorry to read about your situation. I can imagine what you must be going through. You are going through a bad time now.. hopefully things will clear soon.

I just mentioned this situation to my friend and he told me his sister did exactly same thing few years back but came back with out a problem. She applied for AUS residency and went there to get stamped and came back on AP. Her H1B employer didn't pay her for long time (out of money) and she was worried that her I140 might get denied so didn't want to lose Aus residency also.
Apparently she was quite worried about POE, but however IO(s) didn't question about her Aus PR either in the first or second screening (AP requires secondary screening).

It is just bad luck that you faced an IO who is probably in bad mood and decided to play with your life.
