Just to let u know - if u come back using AP, make sure you have EAD also. Because, once you enter the country using AP, then I think your H1B becomes invalid. So, you will have to use EAD to work. I have been using H1B to travel and I have never had any issues with immigration and I have traveled twice to India in the last 3 years. so, you should be fine
entering back into US using AP does not affect you H1B. It does not make your h1B invalid. AP is a travel permit given to you to travel when you are adjusting your status.......... |

Btw, if a tourist stayed more than 183 days on tax year, he/she is considered "resident alien". IRS has different definition of resident vs. non-resident.

With all the retrogession news coming out today I received my fingerprinting notice. The sad part is (apart from the retrogession news) they only sent it for me and not for my wife. Is there a way that I can get her fingerprints also doen with mine at the ASC.........please advice......... |

Topic: Talked to an Immigration Officer(Good news or Bad news)
I finally reached a nice talkative IO that gave me some information. She stated that my NC is cleared. The very interesting part is that when I specifically asked about my FP she said that they are OK. In fact ones she said they are current and when I said that I think that they expire after 15 months (my last FP was 10/7) she said that they are OK. She also said that she will forward my case to the "group" that should be handling my case (?).
I called to get information now I am even more puzzled...
BTW I have a round number coming up 600 days since filed concurrently in two days.
I have hear dthe exact same thing that my prints are ok.......dont know what the real story is? |

I know exactly what you mean...i have never been this frustrated with anything...i keep getting contradicting info too...
But maybe what i heard today is right then...a case maybe assigned to someone and then once that IO does whatever her needs to do...then it moves to another location and waits for someone else to review..that would make sense for contradicting info...but I donno that even God knows what goes on in USCIS...

my attorney said they called on tuesday and learnt that my case was assigned to an IO...i heard from the forum it is good to double-check so I called on wednesday and the person said even before i asked anything that my case is reviewed by an IO (I already got RFE in October last year)..but she said she cannot give the date that it was assigned as they are not supposed to disclose that info...she said said you dont have to raise another SR or anything since the case is where it should be....
I have a sudden trip coming up for work (out of the country) and i have heard people here say that it is good to be here when the GC is issued so I am trying to figure out if i should push it by 2 months so that it gives the IO enough time..
However I called today to check the date assigned actually so I can decide on my travel..and the lady said it is not assigned ..and I told her that my attorney said it was...etc, and she said it goes through a few IOs before a decision is made...
Anyone that got approved, or got the same info ...that the cases are assigned and unassigned and assigned..like that?

my congressional enquiry revealed that my case is with an IO whereas when I call TCS they say its not assigned to an officer. I just dont know who has the right info. .........I havr heard of a lot of inconsistencies with the the IO when u call them....................it a real mess.... |

Topic: Linking the EB dates
Yesterday i recieved finger printing notices for us and the appoint was for today. I went to the Local ASC to get those done.
I am not sure how did we recieve those FPs, I did couple of things
1.I changed my address and on the same day while talking to the IO asked about my FPs and she told me that its expired, Let me schedule that for you.
2. I called one more time after that and asked the IO is my FP appointment scheduled, the answer was no.
3. I contacted my congressman after that and thier office contacted TSC on 13th Feb.
I Postmark date on the Notice is 18th Feb and the appointment date was for 24th.
I am not sure what triggered the FP notices (oh well, atleast i am done with the second FP). Now the question i have is, How long is the timeline for the FP appointment from the day you recieve the letter. mine was like the very next day. I could have easily missed that if USPS were to delay my letter.
what date did u call the IO the first time to schedule your finger prints? What city are you in? |
