Topic: Add spouse whose case is a bit strange

Since your husband is EB3 and they will be struggling for a long while by the looks of things for India, and since by the current VB you are current, i would suggest filing the I-485 for your husband under yours as a back up. Although they do not like having two I-485's together there is nothing stopping you filing that however i have heard people say it takes longer because your husband's second 485 will receive a new A# based off your petition.

With regard to the H-1B and other things provided it has never been denied and your husband has never been out of status you should have no problems filing the second I-485 for your husband. I would suggest filing it sooner rather than later incase your PD is no longer current in the next VB.

Also try and find out the reason for the H-1 maybe see a lawyer or get your existing lawyer to press and find out.

Topic: Infopass experience (Waste of time )

Your finger prints will not expire in 2 weeks, if they were done after i believe Oct 2005 they can actually refresh them in the system them selves and hence you do not need to renew the finger prints.

Topic: H1 impact on I485 approval

1. It should not if you have the information from the doctor however sometimes conditions of H1 mean you should be continuously paid, so i would check with a lawyer on that.

2. Possibly from the week after she did not get paid.

3. Not now since she has the I-485 status hence if the above two are good then she is in a valid status and is good.

Topic: I-485 denial notice with a pending I-140*****URGENT*****

It is probably an NOID, it does not mean denial what it means is they need some information from you and if they do not get it within 30 days (or the timeline they specify) then they will deny your case. Calm down, and keep checking for the Notice they sent, also have your lawyer put pressure on them and see if they will fax it to him, since sometimes people will be able to get the Notice Faxed so you get it quicker and hence have more time to respond with the required documents.

Topic: Did not see approval!

Pre-approved means your sitting on the pre-approved shelf waiting for the PD to become current. Now once your current you have to hope they look through those pre-approved shelves and hopefully your case will be one they choose to go to an IO, if not, then your waiting on the shelf until you go to an IO who will request the visa number for you.

The visa is no longer valid since it was tied to his H-1 status which he no longer has. She can certainly try to come back but if the officer at POE is doing his job correctly then she will be out of status immediately and deported.

Only with Advance Parole and since you have to be in the USA in order to get that you are not in a good position.

You can wait for her green card to be approved then mail it to her and she can come back on that, other than that i do not know of any other ways.

You should check with your lawyer but the minute mine was approved my lawyer was at me to get my wife an Advance Parole since she cannot travel without it.

She is now no longer an H-4 because you are no longer an H-1 i have the similar situation and if my wife wants to travel she now needs advance parole, since H-4 is now invalid as of the approval date, hence your wife is now in adjustment of status (status)

Topic: Two weeks ago I was laid off and today 2 weeks later everything has changed, thank you everyone.

Sweatpea congratulations, make sure you file the AC-21 with USCIS and give them a cover letter with your employment letter for the new company that way there will not be any denial because your other company told USCIS about them laying you off.

Again congratulations, i am happy you found another job and can stick it back to the company who tried to screw you over.
