My spouses h1b is due for renewal this year. When we spoke to our lawyer, she sounded reluctant about filing. First the question was whether the employer will pay the prevailing wage. Then she said we cannot file 3 yr extension because her PT license expires next yr . I have a few questions for the gurus .. if you can please guide or share your experience it would be great.

1. 6 yrs of h1b minus few months loss of time is complete and i140 is approved .so can we file under AC 21 extension of 3 yrs ? Will we file loss time plus 3 yrs or just 3 yrs?

2. Does the physical therapy license play a role ? She mentioned something about license expiring next yr in 2017 and her filing only till then. How is that feasible ? Extension every year and the money needed to file then the employer will be frustrated even more ..

3. How much of a role does prevailing wage play ? She mentioned that the employer must be willing to pay prevailing wage . They are paying the salary as it is. What's the difference ? Is prevailing wage less or more than the salary ?

Can you please help?

What's the worst case scenario?

With USCIS, you always have to assume the worst case is true!

If H4EAD does not get approved until the last day, do I have to quit my job? or I can show the company the papers for renewal like how we do for H1B.

Has anyone gone through the scenario where they were not able to renew on time when their EAD card expired?

Any thoughts.

Good Morning Folks,

Not sure which forum to post this under but I need some guidance from people who have already done this or are in the process of doing this.

We have approved I140.
6 years period is ending Sept 30, 2016

Need to renew H1B, H4 and H4EAD.

I have the following questions:
1. For H1B and H4, dates for renew seems to be backed up in Vermont. If I file H1B in premium processing, does it benefit H4 as well? or will H4 follow it's life course?

2. Do all the applications go together as one packet or need to be sent to 2 diff places? H1B and H4 in one place and H4EAD application in one place?

3. Do i need to wait for H4 to be renewed first and then file H4EAD?

4. H4EAD ends Sept 30, so if not renewed by then, do I have to stop working? Or I can submit the renewal papers to the company if asked? What are some of the implications of not having it renewed by the H4EAD end date?


Is anyone in this same situation or has been through the same situation can please share their experiences?

Please correct me if I am wrong.

Below is just an example of how i see the process..

So, for example:

if B = Sept 2012 (eventually in a few months whatever) -> I can file 485.
but, A has to be = Sept 2012 for me to get my green card?

Does this simplify my understanding of the A and B parts of the bulletin?

I am in the same boat...Case was approved on 31st July. got approval notice on 5th or 6th of August.

Status shows case was approved. No change after that ...just waiting.
A lot of folks got card production notice or something like that pretty much right away.

Good luck to all those folks who are waiting ...hang in there.

I got an approval notice which I thought was something new as others here were saying they got the card directly after the initial email or text .....so felt weird ...

Can someone who has gotten the card already clarify if we get a receipt and then the card? and how much time

I received my approval email op 31st. I received my approval notice just yesterday (8/6) and I am still waiting for the card.....
any ideas?

H4 EAD is given to folks who have already started the Legal permanent residency process and have their i140 form approved. So, before you convert from H1B -> H4, do you have i140 approved? Folks who only have H1B do not qualify for H4 EAD.

When do I need to stop working on H1 if both are not approved at the same time?
-- If your H1B visa is ending, the H4 has to start the day H4 is ending. so that answers your question. As long as you have filed H4 COS before H1B ends, you are fine. If you don't do that you automatically go out of status and then other complications.

Please make sure you consult with a lawyer and get a few answers before doing the conversion. You can file all the applications aka H4 COS and H4 EAD on your own and probably even at the same time provided your spouse or partner H1B is active and valid until whenever it is valid.

Sent USCIS: 27 May
Received USCIS: 28 May
Approved USCIS: 31 July

Thanks to all the members for the encouragement and occasional venting. Also, good luck to everyone waiting in this process. The approval will come soon. Hang in there .....

Muthukerala, scroll back to around page no. 760 - 780> A lot of people around there were discussing supporting documents etc. You could get a good sense of what a lot of them have sent.

Below is the list of what I sent.

Documents for the H4 visa holder
1. G-1145 e-notification form.
2. Filing fees payable to U.S. Department of Homeland Security ($380)
3. 2x photos of H4 applicant.
4. I-765 application for Employment Authorization.
5. I-797 approval notice with I94.
6. Previous I765 EAD approval card and notice.
7. Copy of marriage certificate for proof of relationship.
8. Copy of new and old passport(s).
9. Copy of SSN card.
10. Copy of driver's license.
In addition to this, documents for the principal H1B
1. Form I-140 approval notice.
2. I-797 approval notice with I94.
3. Copy of recent paystubs.
4. Copy of passport.
5. Copy of SSN card.
6. Copy of driver's license.

It seems Vermont is far behind on other things as well, maybe it is lack of resources.

Look at where they are for extensions of H visas.
I-539 Application to Extend/Change Nonimmigrant Status Extension of stay for H and L dependents October 13, 2014


Soon this will catch up to a year gap. smh :( what does this mean for H4?

How early can you file your renewals for H1B's, anyone knows?

and I wonder if we can just go and help out. I don't mind doing the paperwork all day if they hire me.
First they have to send me my EAD :(
I hope they can clear the H4-EADs soon so at least we can get jobs.

You bet!

Looks like CSC seems to be approving cases from mid-june already. And, VSC on the other hand has not even cleared the first few days. Damn! that's slow. I hope there is no impending issues with the case.

There should be some kind of transparency in this processing. I think it would make their life so much easier and our life so much happier.
