Topic: EAD RENEWAL - Clarification

If you used e-filing, you can send a covering letter with highlighting
the change in nationality (along with the supporting docs). Call USCIS and ask whether it is okay
if you send a letter with the correction. Another option is to take an infopass. Send
the letter by USPS which gives you a signature confirmation.

Thinkpad,

Did your RFE clearly state that a non-availabilty is necessary?
If they have not specifically asked for it, they you are okay. Just
produce two separate affidavits and you should be fine.

Hi Nst,

Here is the good news. Normally if your name is long it is good,
the name check will be faster (probably lesser number of hits
when they check for it!). This is my understanding. If your / kids
name is having a very common surname, then it will take a
slightly longer time.

Topic: i-94 question

Hi Crazee,

I was told by the attny who filed my H1 extention to turn in both
the white I-94 and the tear off portion from the H1 approval notice that
is green in color at the port of departure (note that the I-94 number is the same
in the white as well as green portion!). If you call CBP, they also advice
you the same. Hope this helps.

I do not have the 'right answer' for you. But, I know a person in my
department who applied for his AP (JUST FOR HIM), and got it
approved. He was the primary applicant. If you want you believe,
otherwise ignore this and contact a LAWYER or for assurance a
second LAWYER.

Hi Harpreet.

You should have a new I-94 that comes with your H1 approval notice. It is normally
the bottom portion of the approval notice and with a new expiration date.
-Are you sure that you don't have to turn in your I-94s when you are leaving US?
I am not aware what the differences are, if you are leaving to Canada or to rest
of the world. May be you can post this in the 'Canada landing experience' thread to get
more informative responses.

If you had send 2-3 documentations to prove your marriage, that should be
fine. Photographs are okay, but documents are the ones which carry more
weightage. You should be fine.

Topic: I-485 and Birth Affidavit from abroad

I will try to get the affidavit on a stamp paper (a lower denomination will do, say Rs.10 or 50,
Sisy in your case you also get the lowest available, don't get it on US stamp paper). Get the affidavit
notarized by a notary public (I do not know what is equvalent in UK). Try to get two affidavits,
one from your parents and the other from a close relative who is elder to your mother.
This should be enough for USCIS. Search for 'Birth affidavits trackitt'.

Initiate a congressmen or senator inquiry, that is much better than
calling USCIS. The CSR do not give any information (may be they

This discusses various ways to get one or more birth records. I have
listed a format for the letter from school. You may try from 1-2
schools and if your parents or relatives know a small hospital
you can get one from them as well.

Start working on this immediately (as this take some effort from
your parents in India), you can respond to this without a problem.
Additionaly, you can get an affidavit from one of your close relative
(elder to your mother) stating that she was there at the time of
your birth etc (format is listed in trackitt, different forum) and
notarized by a notary.

Boink,

I will suggest that you consult with a lawyer and perhaps double check with
another one. Many times USCIS CSR do not give any useful information
(or they are ignorant!), so definitely check with two lawyers. Attny Murthy has
a chat session once in a while, that may be a good option.
