This entire website and forum is hijacked by people in IT who are busy vilifying the category of Green Card petition that is not their's. Eb3 hates Eb2 . Eb2 hates Eb1. Now the fight is about what should be the minimum cut off for H1B 100, 110K? Please get your head out of the sand. There are other fields where people come here because they are interested in the quality of the career (NOT money alone). Please just be mindful of that when making a wide brush comments.
We all are frustrated with the wait. I can say that all these IT folks are clogging the system....I don't, because we are all here to make a better living for us and our future generations. Be united and be thankful to this country who has given you so much to this point! Happy Thanksgiving!

I don't know if I am understanding the text wrong here. The requirement a gap of 1 yr or less between your priority date and cut off date for applying for EAD is in conflict with what we are achieving with the newly started 2nd table in a visa bulletin "DATES FOR FILING OF EMPLOYMENT-BASED VISA APPLICATIONS" .....where current date is July 2009 for EB2 and cut off date is June 2007?

Topic: I 1485 filing question

My wife recently converted from H1 to H4 and applied for EAD. 50 days have past and the case is still processing.
I have a I-140 approved with EB2 PD of Oct 2011.
Now, in the middle of all this if conditions turn in our favor to facilitate me filing for adjustment of status (I-485), do I basically lose my H1b status? and do I have to get my wife on the new EAD system based off of I-485?
I just dont know what visa status is a person on when he files for adjustment of status.

Please share some light! I presume many with PD dates before July 2011 may be in this boat already.

Topic: EAD for H4 Visa Holders

I saw some 1000+replies to this thread and am not sure if someone has already asked this question before (and someone has answered it).
I am in my 8th year of H1B with an approved I-140 under EB2 (with PD in Oct 2011). Wife is also on her 9th year or H1b with an approved I-140 from her previous employer and at least 3 months away from starting her PERM process again with the new employer. Now the question is, if the H4-EAD rule making process goes through successfully,
1. Does she have to convert to H4 to be eligible for an EAD under that rule?
2. Applying for H4 (under premium processing) may take 2-3 weeks, but the time frame for applying for and getting an EAD is up in the air..correct? The reason I am asking this is she won't be able to work between that period of moving to H4 and getting an EAD.
We both are in non-IT engineering fields, so thankfully we are not dealing with desi consultants!

Topic: What to do to get H1B stamping date in emergency situations?

I have a couple of questions in general about the visa stamping procedure.

1. People have to submit DS-160 and $190 to even see the available dates for visa stamping. Is there any official way around it? This is critical when people are buying tickets for a trip to India before they can schedule a visa appointment.

2. If you have to go to India in a family emergency situation, is there a different route available to get a visa interview date? If No, what do people do to not sit in India for 3 months for calender to get cleared?

I understand that CIR or immigration executive action (IEA) will primarily focus on the illegal immigration aspects. However there has to be additional tack on things that help legal immigration right? Does anyone know what those are? and how they will affect the eb2/eb3 clogg?

Topic: Stamping of Visa

If a person has I-140 approved from company A and changes the job to company B.
Now the person has a valid H1B with company B. Company B has also started the PERM process.
If person leave the country while PERM process by company B is progress (company A is not withdrawing the petition), does it help or hurt the chances of stamping (discrepancy of one company's approved I-140 and another company's current H1B)?

Topic: To jump or not to jump?

I have an approved I-140 with a priority date in October 2011. It is expected for PD to move to Jan 2008 this August. I have received a job offer that is difficult to turn down. However I will have to start my GC process again. They are ready to start it by August 2014. Now my question is since labor is taking about 10 months these days to get approved, do I stand a risk of missing an opportunity to file I-485 if PD becomes current between now and Fall 2015? Or am I being too optimistic about PD movements and paranoid as a result. There are a lot of great statisticians and mathematicians on this forum.
Share your thoughts please!
