Topic: Very very precarious situation

$ travels from Client -> Prime Vendor -> Consulting company (My employer) -> ME.
X -> Y -> Z -> ME. (Z is my HR/employer).
So,here is the coup. Few months ago, (Aug/Sep 2009), USCIS had a random check on one of my colleges.
who works with me in company Z. For some odd reason (laziness), HR from company Z /employer never
cared to reply to those queries and phonecalls. Now this has resulted in my college's visa status in $HIT.
USCIS has given ultimatum that they will revoke the H1B petition,if employer does not come back with necessary
supporting documents.

The bigger problem is this: THere are atleast 7 more guys working with me who are from same employer Z and
almost everybody is on H1B (although few have EAD). My questions are
1. How is this going to affect the visa status of all others?
2. Can the USCIS mark company as black-listed and thus resulting in all employees on road?
3. There is no fraud going on,just lapse/laziness has resulted in this chaos. This is a continuous maintenance project
and there is every document to prove "good" visa status for all the employees of the company Z.
4. Lawyers, CPAs from my employer are already doing their best but we are firmly believing that this is a sinking boat.
5. I do have EAD, and its ending in Sep-2010. Should I apply now and get 2 yrs more extension before anything happens
with the company Z?

Topic: Please Help! H1b Visa Stamping

What is your country of origin? You need to get the H1B and H4 stamped in your country of origin. That is the tried and tested (safest method).
As long as she is NOT working as a consultant (and has a h1b petition from her employer whom she works for on the premises) you both should be fine. Potentially, they can ask the intent (as in B1->F1->H1 etcetc...) but you can give some valid reasons.

Topic: Recent H1B travel to India anyone?

I travelled in May and got my visa stamped in Chennai consulate. No issues whatsoever.
You need to have a valid job + all the relevant documetns. If you have valid documents
there should not be any problem.

a big plus point. Oflate many companies are asking this to show your _REAL_ self. Open Source is one easy way to _advertise_ yourself. You might be a SAP/ERP programmer and might have written numerous lines of code, but do not dis-regard the Open source & zeal of the
many Indian students who are doing their PhDs.

PS# I do not want to correct anybody,but blackswan's comment on PhD & Open Source is the honest .

I've a valid H1B, AP and EAD. Currently, I'm on H1B and not using EAD/AP. However, my visa stamping on passport
has expired (Due to earlier h1b). And, there is a need for me to visit India. My questions are

1. Can I re-enter US on AP and continue to work on H1B. I'm already aware of:

Most importantly, I'm soliciting information on "what-if" I485 is denied.?

2. If H1B stamping is safer chioce, which consulate to go in India. I hail from Karnataka,but can I goto Hyderabad or Mumbai?

Topic: AP renewal

My AP is ending on Jan 06 and same for wife. I would like to apply for AP ASAP.
My questions are

1. Can i apply for AP renewal ONLY for wife? (I do have valid H1B right now and I've a PENDING H1B petition
for 3 yrs extension as well).

2. If answer to #1. = Yes, what is the process and What documents are required for the renewal.?

3. If answer to #1 = NO, then Do i need to file for AP renewal as well?

10/19/2007 checks cleared

Have all the receipts, but no FP appointment,nothing so far. Do you think I need to get an infopass appoinment?
