Job Portability and New Supplement J to Form I-485
The new rules formalize longstanding DHS practice requiring a foreign worker who is adjusting status to have a valid offer of employment at the time the I-485 is both filed and adjudicated. In order to facilitate adjudication of these applications, the DHS is introducing supplement J, a new supplement to I-485 applications that will be used to submit confirmation of a bona fide job offer or request for job portability. The form is intended to standardize the information and evidence that the USCIS will use to either confirm that the job offer described in the I-140 still exists, or, if an applicant has an I-485 that has been pending for at least 180 days, to adjudicate a worker’s portability request for a new position in the same or similar occupational classification. More detail on this job portability standard is available in the MurthyDotCom NewsBrief, Final Policy on AC21 ‘Same or Similar’ Job Requirement (07.Apr.2016).

Hi All,

I am in a similar boat and am planning to move to a full time position on EAD. Please if someone has been through this process, please shed some light on the below questions. I will appreciate it.

1. Can we have a significant difference in pay scale - e.g. a 50% increase from 100k to 150K, is that a red flag?
2. Do we need to have a new Attorney that can help with pending 485 and AC-21 work?
3. Any risk if the previous employer cancels the 140?

Thank you all for the valuable comments.

1) Based on all the readings so far I don't think withdrawal of 140 by previous employer would have any impact since its more then 180+ days.

2) I know the pay scale is different but it is a natural progression and I can request the HR to have me write something up for same roles and responsibilities. I am not sure if HR will agree with the Title though.

You don't qualify for EB1 unless you come from outstanding org like info, tcs,... and other shit. You know what I mean.

What if you join on EAD with the same title and the pay scale changes drastically like 50% more. Would that be OK?

Any one with similar experience, please help?

I don't know if I should wait for few more years or if I should grab the new opportunity on EAD. Please can someone share any similar experiences if any. I am more inclined towards joining but just want to understand the risks of joining on EAD. The reason for my concern is the difference in the pay scale and designation.

1. The only risk is that you mentioned: Budget constraints ;-), tomorrow they may have more tight budget
2. After AC21, who cares?
3. H1 alongwith pending AOS is always a plus. This doesn't mean anything effecting the GC process. - What happens if you get an RFE for EVL, could this be a problem?
4. Not sure what is a better option continue to work on H1 or is it EAD?

Please can someone help me understand the Risks for doing a full Time with AC-21. I work for Desi Company and am contracting for a long time but the client is pushing hard for full time due to budget constraints. My 485 application is 180+ days old from a desi company. Trying to understand if its worth joining on AC-21.

1. What are the risks of joining New employer in AC-21
2. What if my Desi employer revokes 140?
3. What if I join the new company on a brand new H1? Does this mean the existing GC process is all nullified. (Sorry for the Naive question)
