h1b regular (Transfer): APPROVED

File date: 28th march 2016, approved date: 8 Dec 2016: it took them 247+ days to approve it, to all guys with expired i-94, please DO NOT risk your future and go premium, my employer (DID NOT) allow premium, otherwise all the 5-6 h1b transfers i have done have always been premium

H1b transfer or extension? I am guessing yours is an extension and your I94 still might be valid, so you can get it soon.

Worst case is mine: h1b transfer with 4 month expired i-94

Not Sure how you are counting your days, but the DATE on your receipt notice is the date uscis will consider --> so that is 9 feb 2016 and you are an h1b transfer?

Yes since your was a h1b extension, you got priority over H1b transfer DUE to the difference in law of AC21 that's applied to someone with 240 days and more..pending processing

Guys, the way USCIS processes h1b petitions follows this priority level:

1. HIGHEST PRIORITY --> FRESH h1b petitions (F1 to h1 kids)
2. H1b extensions
3. H1b transfers

You guys are very lucky, is your friend h1b transfer or h1b extension, there is a BIG DIFFERENCE on the 240 day rule b/w these two.

I am guessing your friend was an h1b extension - so he got priority over h1b transfer

Sorry to hear my date is 28 march, no updates yet, lawyer reached out to csc and created SERVICE REQUEST after my 210 days passed, and they replied sorry, its pending consideration and cannot provide any estimates on when we will process it.

RIGHT NOW I AM PENDING for more than 245 days and very nervous

No sorry, you are seeing incorrect information, please google "USCIS PROCESSING TIMELINE" and select SERVICE CENTER PROCESSING DATES --> CSC

If you check the CSC center processing timeline, they are now processing applications with date of 16th March, 2016...so all march apps should be cleared by XMAS hopefully.

To all my desi friends, especially the one under consulting firms, if your date is April-May-June --> do not expect to see your file even being considered (forget rfe, approvals etc.) by CSC this year, my advice is do premium processing. I wish my employer did allow me to pay & get it done but i am stuck with a bad one.

Anyways, do NOT be surprised if you get your h1b file processed by USCIS (9 or 10 months) after date of receipt and YOU MAY ONLY GET APPROVAL for 1 year, so just 3 months with that approved h1b, the whole thing is a joke and non-sense. YOU cannot get a new stamp, what will you do with a 3 month stamp? Honeymoon? Marriage? Attend funerals..? Huh....its quite weird friends..

Anyways this is just another uscis ploy to get more dollars from indians by paying premium and with new regulations coming in on Jan 17,2017: the 8 or 10 month processing delays will get more normal and we all will continue to suffer

You all are very lucky, my filing date is 03/28/2016 and USCIS responded yesterday that "Sorry, we are not able to give you any estimated time on how long it will take to process your case", my case is one of the worst as my employer did NOT allow me to file premium processing (I was ready with $1225 cheque in hand) and now USCIS has taken more than 7.5 months ~ 220+ days and my case is still NOT TOUCHED by them, their official word is "pending consideration", so folks who are getting their h1b via regular processing done after me are very lucky.

Please note that i never received any RFE or anything on my case that was filed on 3/28 and till date it is just in the waiting list, i don't know what process is being followed by them to process a case, my general thought process was 1st come 1st serve basis for all regular (extension) filings but that does not seems to be the case.

The reason i was able to find out about what is going on with my case is after i pressurized the attorney to contact USCIS to atleast let them know that i have been waiting over 220 days with no action on my case, my i94 has also expired and i stand at the risk of being thrown away to India if i loose my current difficult job.

Guys,

I am a 2014 FSW applicant and my consultant applied to CHC NDVO last year and now CHC NDVO (on 25th Feb) has requested for passports and i live in Los Angeles, USA

My consultant has notified CHC about my residence in USA on 13th Feb and since its ILLEGAL to mail passports from USA to INDIA, i am trying to get my case transferred to CIC LA, so far based on my consultant advice, i have forwarded the PPR Email that my consultant received to :

I am NOT SURE if this is the right approach, please HELP ME. I only have 30 DAYS to complete this
