Topic: Possibly getting laid off - Need Help


Hi guys, I need some advise and would appreciate some guidance. Here is my situation. My AP, EAD, I-140 are approved. I am now waiting for I-485 to become current (in EB2 category and priority date of Nov 2006). My company is having layoffs and I think i may be on the hit list.

My question to you are:
1. What happens to my Green Card process after I get laid off and till I find the next job (in the current economy its possible that this may be delayed by couple of months)
2. What if I am not able to find a job in the next couple of months. what happens in that case. Do i need to leave the country immediately
3. Before getting laid off what do I need to request from my current employer so that my green card process is not affected
4. I am traveling to India this coming Dec (right about the same time as my layoffs) and was wondering if you think its still advisable to go. i mean, when i come back would i have problems at the Port of Entry.

1. Your 140 is cleared. So the good thing is that you have a position in the Q. That means in future, if at all you have to file GC again, you can re-claim your position as far as the PD goes. As far as the current GC process goes, forget it unless you are working for a multi-national company and you are in good terms with the company and the lay-off is sending you back to your home country and they agree to continue to support your GC process. At the time of filing 485, if I am not wrong, you will need a letter from employer saying your are still employed or they have intention of employing you (not sure of the latter).
2. If you can't find a job in some days ( i believe it's 30 days but not sure), you will be out of status. Again check with your lawyer. As long as your H1 is valid, I am sure there must be ways and means to transfer H1. Not sure though. Check with lawyer.
3. If you get laid off, you must get a copy of 140 to reclaim your PD for future application. That's the most you can get out of your current situation.
4. I am currently in your situation. I think if I get laid off, it will be a blessing in disguise. Enough walmart visits. I miss the"dukaans".

Topic: motion to reopen clarification

Did you apply for appeal or did you apply for MTR. I applied for MTR which is basically requesting (or begging) the USCIS to reopen and reconsider the case based upon new evidence. I got approval notice but the online status of my 140 still shows denied.

Medicals bills can show up on your credit report if sent to collection agency. It might not ruin your score but surely impacts your interest rate when you apply for loan.

You can check your credit reports from all the 3 agencies once a year free of charge ...[Decline to get your credit scrore as that is not free]

If your medical bills have been reported to these agencies ... they will show up under 'Collections' section. You can dispute them.

You should ask the Hospital for their policy on cash pay. If they have a policy which says 40% discount for cash pay, then they will not discount further. If they do, they can get into trouble about discriminating. They can write it off completely and get a tax break. By the way what is the name of insurance you got from India for your FIL?



You brought up interesting point here and looks like the situation here wherein they walked away from my offer (they had my check on the table and yet the politely returned it).

The insurance company is Tata AIG and they do not pay for OPD.

keep negotiating, and you will reach a settlement price. Do not opt for NOT TO PAY. If you don't pay, they will submit the case to collection agency, and then ultimately comes to your credit history. Also, if not now, you have to settle this case by paying it at the time of Citizenship acceptance.



Appreciate your response. A quick question:

1. How will it come to my credit history? They don't have my SSN. They do have my correct name and contact information. However the prime here is my father-in-law.
2. I haven't opted for "Not to Pay". Neither have I received any official document. Should I be expecting one? Or will they assume this as my intention?
3. Citizenship acceptance? How is it connected? Can you please elaborate?

Friends,

I know this is not the right place to post this but this is the only place I know where I can find someone like me. Especially by the time you apply for 485, you age enough to come across this kind of situation (although I wish no body comes across this situation).

Recently my father in law was hospitalized for few hours (OPD). We had an insurance from India. At the time of hospitalization, we submitted the insurance information along with my signature as an assurance for payment. The medical bill (USD 5000) got rejected by the insurance and so the hospital contacted me to advise on payment. I told them that I will pay the bill and they offered me 40% discount which I felt is completely unreasonable (does not even include ambulance charges which is @ USD 400) based on some Health Care industry research that I did. So I counter offered to pay $2500. They rejected my counter offer. Can anyone advise what will happen and what are my best options?

I will appreciate your help in this matter.

Topic: I 140 & I 485 denied please advise

Friday, you should be fine. But an RFE is not ruled out. There are evaluation agencies who will put the right wording for you. WORDING is very important - whether you get it from a world renowned organization or a solo evaluator. Basically they will explain in their verbiage (just like every profession has it's own verbiage) that you have a BS equivalent. Going for the best is not always helpful unless they understand your situation. For example, I went for the best but my case got denied. Then I had to personally gather lot of proof to prove myself right. The evaluator used this information (both lawyer and evaluator are thankful to me) to put a TWO page evaluation. My case got approved immediately in MTR. So anticipate crap in advance and get your act together and be prepared. Shit happens when you are least prepared.

problem is that my supervisors are not with the companey anymore and they are ready to give affidavites on plain letter formate. would this be enough.



You are smart enough to understand the problem. I believe you are smart enough to figure out the solution. I assume you did something that you are not able to justify with the very own organization that you quit. Don't expect UCICS for justice.

To me, it seems that you are trying to jump the queue in a way. There are individuals you will find in this forum who have gone through a hell for the very reason you quit. So consider yourself lucky if you get through but do not expect empathy.
