US immigrant groups to march the day after Obama takes control on Jan 21

Immigrant rights organizations in the United States have planned a major march in Washington on 21 January, the day after Barack Obama is sworn in as the 44th US president.

Some 30 organisations, representing tens of millions of immigrants, will work together to demonstrate their case for immigration reform and remind Obama of one of the policy issues so central to his campaign and which helped secure a large Hispanic vote. Of 10 million Hispanic votes cast, two thirds were for Obama.

Angelica Salas, director of the Los Angeles-based Coalition for Humane Immigrant Rights, explained that the purpose of the demonstration was to ask for reforms and for an end to the raids that have seen illegal immigrants arrested and deported.

"We ask the president-elect to consider immigration reform one of his 10 domestic priorities," she told reporters.

According to Salas, reform legislation should begin "in the first 100 days" of Obama's term.

Both Obama and Republican Senator John McCain had been involved in a previous immigration reform plan in 2007, but The US Congress failed to pass that version, which proposed far reaching changes. It would have given legal status and a path to citizenship for the estimated 12 million illegal immigrants residing in the United States.

Immigration reform earned broad support from both Obama and McCain during the election campaign but in the final months before the election, the issue took a back seat to the developing economic crisis.

Chung-Wha Hong, executive director of the New York Immigration Coalition, said that organisers were 'trying to mobilise tens of thousands of immigrants' for the march, which would be used to highlight the vital role that immigrants could play in an American economic recovery.

Economy and Employment Based Green Card

The economy is in a pretty bad state. I appreciate what the Congress is trying to achieve by the Rescue Plan. And, I have the utmost confidence in the sharp minds we have in people like Federal Reserve Chairman Bernanke , present Treasury Secretary Paulson and whoever is going to take over the Treasury Secretary role in the Obama Administration.

On top of the Rescue Plan, we need to somehow fix the Housing crisis which started all of this. We need to figure out a way to add home buyers. Now, where are the buyers, you may ask. There is surprisingly an easy answer – Employment based Legal Immigrants. These are immigrants who came into this country legally, pay their taxes and social security and who apply for their Employment based Green Cards, the legal way.

There is a huge backlog of employment based legal immigrants who are waiting to get their Employment based permanent residency (Green card). There are approximately 750,000 applicants in line. This backlog has been caused by the annual quota of employment based green cards whose annual limit (140,000) was set decades ago.

These are the immigrants who have already passed through two stages of immigration processes – the Labor Certification where it has been verified that no American talent has been available for the Job Descriptions these immigrants were hired for and The I-140 where the employer is verified to be a genuine employer with financial ability to pay for the immigrants so that they don’t become a liability for the state. They are in the final stage of the Green Card process where this huge back log is.

On top of this, visas not used on a calendar year due to enough resources not available to process them, are wasted. Over the years, these un-used visas amount to around 250,000.

Increasing the annual quota of employment based Green cards from 140,000 to 300,000 would be ideal. Even Microsoft’s Bill Gates has supported this idea in his recent Congressional testimony on March 12, 2008. But that would require the act of Congress and the Senate and it needs to take its course. We need an immediate solution. Re-capturing the unused visas just needs some administrative fixes and this has been done in the past as recent as 2005.

Senator John Cornyn is working on an Amendment that would allow the Department of State and DHS to recapture unused employment based visas. Refer -

In this he states,

“This (recapture) is not an increase in employment-based numbers but rather, a direction for the agencies to use all the visa numbers that are available today”.

If these unused visas are captured and issued to the Employment based legal immigrants, who have stayed in the country for at least 6 years, we are adding a significant amount of home buyers to the economy.

These immigrants will eventually get their Green Cards in 2 to 4 years. Why not give it to them now so that it will be beneficial to the ailing economy.

The 250,000 un-used visas that are captured and the annual quota of 140,000 employment based Greencards for 2008 amounts to 390,000 green cards which amounts to approximately 195,000 families getting a green card.

Employment based legal immigrants (EB1, EB2 and EB3) who have stayed in the country for 6 years are economically well off and have excellent credit history. Once they get a Green Card, they'll feel more secure and think about buying a home and settling down.

Of the 195,000 families, 25 % may already own a home. 25% may not have the intention of buying a home due to various reasons. Even if the remaining 50 % buy a home, approximately 100,000 homes will be taken off the market. This will act as the much needed catalyst and will ease the Housing crisis a little bit.

Hopefully the benefits of the Rescue Plan will kick in by that time and our Economy will start flourishing again.

10/31/2008: IT Firm Settles With DOL to Pay $1.7 Million Backwage Payment to H-1B Workers

* DOL has announced that GlobalCynex Inc., a Sterling information technology company, has agreed to pay $1,683,584 to 343 non-immigrant workers after a U.S. Labor Department investigation found the company violated the H-1B visa provisions of the Immigration and Nationality Act. An investigation by the department's Wage and Hour Division found that employees hired under the H-1B program were not paid required wages from March 2005 through March 2007. Wage and Hour Division investigators also found that the company charged new H-1B workers training fees ranging from $1,000 to $2,500 that were in violation of the law. Globalcynex reportedly runs operations in Hyderabad, India, and provides offshore services. For the announcement, click here. Reportedly, if the settlement were split evenly among all 343 employees, they would get nearly $5,000 each, and the settlement is one of the largest of its kind involving the H-1B program

House leaders remain unsure about lame-duck session

House Democratic leaders have yet to decide whether to return for a lame-duck session, waiting to see which party wins the White House and the size of their majorities in the House and Senate, senior leadership sources said Tuesday after the leaders held a conference call.

The Senate is set to return Nov. 17, and Senate Majority Leader Harry Reid, D-Nev., has said he wants to work at that time on a second economic stimulus measure and another package of bills held by Sen. Tom Coburn, R-Okla. The length of the Senate's lame-duck session remains unclear, although it would likely be short if the House did not come back.
House Speaker Nancy Pelosi, D-Calif., and the rest of the Democratic leadership made clear last week that they would also like to see a second economic stimulus package approved in the near term.
But the details of such a package remain up in the air and House Democratic lawmakers have not gotten any indication that they will be expected back in Washington before next year.
Senior House Democratic aides said the biggest variable in whether they return for a lame duck is if Sen. Barack Obama, D-Ill., wins the presidential election. Other political variables include the number of seats picked up in the House and Senate by Democrats and the Bush White House's willingness to come to terms on another stimulus package.
If Obama is elected president and Democrats make a major gain of 20 or more seats in the House while achieving a filibuster-proof majority of 60 in the Senate, they could avoid compromising with Republicans on the measure until January. Alternatively, they could also put up a bigger fight on a stimulus package under an administration led by GOP presidential nominee Sen. John McCain of Arizona with major seat gains.
An Obama win is also viewed as a large incentive to getting the Colombia Free Trade Agreement -- a Bush administration priority -- off the table before the Democrat takes office. Senior Democratic aides said Bush's wish for Colombia might be a negotiating point to get the president to sign off on a stimulus deal before he leaves office, no matter which senator wins the White House.
