You can not port your H1.
Also, you can not get new H1 since you are out of 6 years limit. For new H1 you will have to leave for a year.

I don't know how to explain this easier than I did already.

Guys, when I applied for I-485/EAD/AP my I-140 was already been denied and under the appeal.
Very first front page of the I-485/EAD/AP application we submitted was stating I-140 Denied, Appeal Receipt # SRCXXXXXXX.
USCIS Accepted application. I-485 is in pending status, EAD an AP approved.

Now, in case appeal gets denied too, EAD will become invalid and my spouse will need to switch back to H-4 status. Until final decision is made on appeal your EAD is good and your I-485 is in pending status.

Before I even applied for I-485/EAD/AP I check this with multiple attorneys. Also my employer called the officer in Texas who initially denied application to make sure what attorney told us was right.

I did have USCIS article about this. I will try to find it.

You are incorrect.
If you file MTR/APPEAL you EAD is valid.

I applied for spouse EAD for the first time 5 month after I-140 denial (4months after filing for an appeal) and got approved.
Reason for eligibility for EAD we stated "I-140 pending with AAO"
