Interview Status:clearedInterview Experience:Had the interview today, My attorney came. Lasted about 30 minutes at most. IO introduced himself and administered the oath. Asked for my passports and took my latest I-94 from passport. Attorney gave him the original I-140 petition and I produced l my old I-94s. IO went through my LC and asked questions about job title, employer, what they do etc. At one point he asked me about the job description in the LC. Lawyer interupted him and they went on arguing about what questions I should be asked. IO finally said " one more lawyer telling me I couldn't ask questions.. what do you want me to do... I could tell you and your client to go home now!" The IO said "I am just doing what they tell me to do". I just kept quiet and waited until he settled down. He asked for employer letter and my birth certificate. Asked how much I was making, gave him my latest paystub. Went to his computer and said about "they're going to close down the numbers soon" While looking at his computer he asked me I-485 questions. Towards the end he said my case is "approvable" but he couldn't give me a visa number because he get to the State Dept page to request one. ((sigh) Kept saying he will approve my case and will try again later to get a number and will approve the greencard to be produced. I asked him about my pending H-1 which is up for renewal Said I can start using my EAD because I've worked with my employer for the last 8 years. That's it. He didn't take anything from me other than the employer letter, paystub and 2006 & 2007 I-94s for his file. I had all the paperwork ready and copied since I came here. He didn't need anything else. I was relieved it's all finally over yet at the same time I was disappointed he couldn't tell me approve my case on the spot or stamp my passport, all he kept saying was it's approvable.

Topic: TSC, RFE on education sent, how long it will take now

as soon as TSC received my rfe on education in 2007 they approved my I-140 about 2 weeks after my lawyer sent the information. my RFE was to show my 3-year UK degree was equivalent to a 4-year US undergraduate degree. I had my university submitt dates of all subjects taken & marks received from my first year up to my graduation.

Topic: Can't Renew Drivers License...

I was able to renew my license in NJ last year. This is the 3rd time I've renewed my DL based on the H-1 extensions since 2003 (initial 3 year and subsequent annual renewals until last year when I finally got a 3-year H-1B due to the I-140 being approved). Try again in another DMV in your state or better yet, call first and find out before you go.

Topic: Oct Visa bulletin

i'm really disapointed with the OCt VB. from Jan 2006 as of March/April now to June 2002 for Oct. If means they finally have pre-adjudcated the cases and now can see a clearer picture of the older PDs, so be it, let the older PDs get the green cards first. If this is another game by USCIS to the State dept to waste more visas for FY 2010 then seriously I am thinking of leaving already. Until then I am in Facebook until they move to late 2004 dates.

jul3107, i also received FP code 3 again after 2 FPs last year , one in July and the other in August. Hopefully this means they're finally ready to approve our cases but i'm not keeping my breath over it. I would like all this to be over by December of this year.

that's great, so good that something is finally going with your case. i called the same numbers for POJ that was given but i kept going back to customer service, maybe TSC has disconnected their phones :-). I will keep trying again later and next week.

i agree withi nisra, seems that calling the IO is only good if your case is current, not before. All we can do is wait for the next week's VB and see where the dates are before calling.

as much as i am excited about this and want to get this to be over again, best course of action is to leave the lines open for the ones that are current so the service centers will not get overwhelmed.

That being said, congrats to those already greened and best of luck to everyone else who are on the waiting list...

I tried calling and got the customer service instead and I asked him about the status of my case, he also couldnt tell me if my background checks or if my case is pre-adjudicated or what's happened with my file since it was sent to Newark. However he did say check the PD when it becoms avaialble and if my PD is current (within their processing dates) to call the Cust service again and they will issue service request.
Seems like a waste of time to call them sometimes if all they do is repeat the same information you already have in CRIS. Even when i told him that my online status hasn't changed since January it doesnt make any difference.

You don't have to renew your H-1 6 months in advance, you can wait until up to Jan-Feb of next year to see where you are in the PD dates.

You are EB-2 from malaysia? don't worry come Oct 1 you should be current for ROW category and you can apply for AOS without having to renew the H-1 for another 3 years. You can even use your EAD if you have it for the time being. Unlike me who just missed the Greencard by few hours in March this year when i went for the AOS interview and consequently had to spend money on renewing the H-1 for another 3 years when the numbers retrogressed.

I think you're worrying too much over this. If I were you I will not worry about the extension until January to see where the VB is in regards to EB-ROW, very good chance your PD will be current in Oct.

yes you should be able to do a 3-year extension if your PD is not current by then, i had mine done early this year when i just missed the boat early this year. Your attorney would be able to assist you.

Topic: Rescheduling of code 3 Biometrics - Very Important

dude,
if you look at the bottom of the letter, it tells you to call the number on the notice if you cannot make it to the scheduled date. you're better off covering your ass and call to reschedule than to simply walk in and hoping they will take your FPs. worse case scenario they won't let you do it tomorrow and you would have wasted your time driving and paying for parking etc.
so why don't you call and reschedule and don't waste forum time asking what to tell them if they ask, you can try walk-ins but again it all depends on your support center. it's your choice.

thats probably why they're asking for proofs of all Non immigrant status up to this point to make sure you've always been legal. at the interview the IO asked to see all status notices and I-94s since i firest entered the US up to present time.

it seems pretty straightforward RFE to me, hopefully you won't have any problems submitting the requested info. good luck!

Topic: I-485 FP notice received today

Gurus,
I just received today in the mail for FP, code 3 in Elizabeth, NJ end of this month. The last time i had to take FP was in August 2008. Do you think this is a routine notice after 15 months or it means they're close to approving my application once my PD becomes current? I think its routine, but my friend thinks they're close to approving my case. What do you think?

yes i've been playing the devil in Facebook with Farmtown, Restaurant City, Pet Society and now my latest craze is Mafia wars... the latter makes you want to go and storm the USCIS officers and beat them up big time LOL

glad to hear you're doing well with your tests, and my thoughts and prayers are with you... keep that lrindy strength up and live one day at a time. take it easy and yes, no point in stressing over things (or thoughts) you have no control over.

I'm also interested as to when you will be greened... my fingers (and toes) are crossed for you and your family to get greened in FY2010!

Same here, Indy... i stopped posting since March when i got annoyed over the VB and my interview outcome. i also went off trackitt, went to Facebook, started playing some games there and made online friends, learnt how to cook, had lots of BBQs with friends and neighbours, worked on my backyard and generally just enjoying life with or without the VB. I just started to just taking it easy and you know what, I truly enjoyed the last 6 months. Once in a while i will check the CRIS status, but the status is still the same since January so i stopped bothering about it. I also managed to visit Senator Ted Kennedy's funeral in Boston and mourned the passing of a great man last week and the things he had worked for. I no longer care about predictions, i only am waiting for the new VB coming out and we start the waiting game again.

If and when they give me my greencard i will be thankful. in the meantime i am not going to stop enjoying the rest of summer (and life) this year.

So how have you been, lrindy? last we heard you had to undergo some medical tests.
