Topic: EAD efile Vs Paper filing

What if we do efile and the EAD is going to expire in 30 days, I hope the efiling is still an option, only thing is it'll not be approved within 30 days.
I am still on H1B status and not in hurry to get the EAD within 30 days?

I efiled the application 15 mins back and then came across this thread where people say that efile means "go for FP" again. If I had read all of this before, I would've gone for paper filing...

I did NOT check the box where it says "I intend to send the paper documents". So I assume that I do not have to send any documents to USCIS now. Just wait for FP notice, get FP done and then wait for 90 days. Pls correct me if I am wrong.

1) the only worry is if I earn money and the transaction shows up in bank account, I need to be answerable. And this thing may very well reflect in background check.

With ref to #1 in your reply, are you saying that I can work for myself by staying in H1 status? How does it happen, as I have heard that on H1 I am ONLY permitted to work for my employer.

For my biz, we are just going to register a company now as my wife has an EAD and she can happily use that without risking the 485 processing. With employers, we have to file I-9 or something so that's why I was wondering which form we need to file in case we have our own business and no one is paying us any salary.

Another question, do you know if freelancing is allowed on h1 or h4?

Thanks greenlee! I agree with you, just need to be careful, especially when 485 is in process.
Can you tell me if my wife can use EAD for biz? I guess yes!. I need to know the procedure how to utilize the EAD provided by USCIS.

My spouse would like to startup a web site and we need to know how can we use EAD to run the business.
What kind of fee a lawyer would charge for this kind of consultation?

Topic: when is name check done?

My I-140 got approved recently and wondering what's the next step, is it name check or background check or something else?

I am not very sure about my priority date but it should be some time in 2002(EB3), so I am not current as of now.

Will USCIS be carrying out the name check and background check even before my date becomes current or they'll wait until it becomes current to do ANY processing on my case.

Is this something that I need to follow up with my company lawyer?
