Topic: LUD 11/1/07 indicates RFE ..... does it mean name check is done?

RFE is sent to request more evidence from you, it does not say anything about status of your case. If you filled G28 form along with ur 485, RFE will go to lawyer.

I was given just 30 days to respond to RFE. RFE was issued on Aug 16. Rcd by lawyer on Aug 23 and was given until Sep 16 to respond !!

It's very difficult to respond in 30 days and thankfully my HR and lawyer pulled it off. So pray it does not happen to you.

Topic: Relinking pending I-485 to a new I-140 ?

My case is as follows:

-I already have approved EB3 I-140 with PD of Jan'03 but could not apply for I-485 due to retrogression.
-I applied for EB1 I-140 and I-485 concurrently in Sept'06 as EB1 is not retrogressed. My EB1 I-140 is still pending with no hope in sight.

Fact: My I-485 is pending for more than 180 days and I can use AC21 portability as soon as my EB1 I-140 is approved.

Question: In June VISA bulletin, my EB3 PD is current and I can now apply for I-485 on Jun 1 on basis on the approved I-140.

-Do i need to file a new I-485 or can relink my existing I-485 to EB3 I-140 (altho' the EB1 I-140 is not approved yet)?
-Can I avail AC21 portability immediately because this I-485 is pending past 180 days ?

Topic: NSC I-140 Processing Dates Movement

Any thoughts on why NSC processing date movement is so slow and erratic ?

For e.g. it stalled for EB1A, EB1B for 3 months and suddenly lurched ahead by 1 month in March 15 bulletin. EB1C and EB2NIW slowed down and came to grinding halt.

1. What does the published date mean really (Say 16 June for EB1C) ? Above site says that all the applications before date have been 'completed'. Does that mean
A. decision has been made (approved or denied),
B. Picked up for processing
C. Either approval or RFE issues

If the date is past, should I expect at least an LUD ?

2. Is the date reported the Receipt Date or Notice Date ? For NSC there's at least a months difference between the two.

3. Is EB1C, NIW movement slow because apps take long time to be processed ? Can we mean it to take that the apps beyond the due date are also in process but decision is not arrived ?

4. Whats expected trend for EB1C ?

5. Is premium processing (or lack of it) slowing down EB1C and NIW ?

Really tired of waiting, so whiling away time thinking all these things :-)

-You could upgrade for premium anytime, if it becomes available.
-From experience of other EB1 premium category upgrades, you are more likely to get an RFE and hence more risk

On other note, please check if your app landed into LIN or SRC service centers. There's a huge difference in processing times of two. LIN is not moving since past 2 months at all :-(
