Topic: Leaving company soon after GC, but working with them for many years

My lawyer said that given the current state of the economy, it's ok to leave the sponsoring company even one day after getting GC approval. As long as you have been there for some time, which you have like myself. So go ahead..move on..you will be fine getting your passport.

That's it - I received the I-140 approval this morning and the I-485s both changed to "welcome package sent." It's the end of an 8 years long journey and I am so grateful it's over. Best of luck to all of you!

OMG - thank you so much for the response!! I just can't believe it - it almost sounds too good to be true. I started my case in 2001 and waited 6 years just for the labor certificate. My company went through massive layoffs a number of times, including only a few weeks ago again and I just barely made it. That's just unbelievable. God must be watching for us!

Topic: Urgent question - card production ordered but I-140 still shows pending

This just happened - my lawyer opened yesterday a second service request on my concurrently filed EB3 485 and 140 with date 8/15/07. I checked around 6pm and the I 140 had LUD with 1/14 (it did not get any LUD last time we did service request), but still showed as case received and pending. The 485s for me and my husband had no LUD. Then I checked again around 7.45 pm ET and OMG - both 485s had date changed of 1/14/09 and both show as card production ordered. The 140 still shows as case received and pending. Is this an error??? I am not sure whether to take this as true coin and whether to be happy. My lawyer has gone home for the day.

Topic: Can Company Change Attorney on File?

My lawyer has opened a second service request on my I-140 and still I don't even have a soft update. My I-140 and I-485 were filed together in July 2007 and neither is yet approved. Last LUD is from November 2007 when I got the fingerprints.

The attorney is my own and is not paid by my employer. The employer tried to get me to change it to theirs last year and even offered to pay, but I declined as I want an attorney who represents me and my interests. Looks like I was one of few who splipped through the cracks and did not get changed to company attorneys back some time ago. Now I am worried that they may have gone behind my back and changed it despite what we agreed upon in writing. My lawyer is telling me that I have no way of finding out who is the attorney on file and I don't want to ask HR as I don't want to draw attention to my case and me having my own attorney.

Has it happened to anyone that the company may change your attorney without telling you? I had the corporate attorneys file extension of EAD for me and the only forms that I signed authorizing that were specific to the EAD - they contained that verbiage. I wonder if INS or the company may have changed the entire file to the corporate attorneys altogether.

Topic: Great news for those awaiting EAD Renewals

It's not yet a rule, but is expected to become any moment. In summary:

In response to these recommendations, USCIS has indicated that it will shortly take the following actions:
1) Audit its caseload to determine which cases have been pending for more than 70 days
2) Process service requests at 75 days rather than at 90
3) Adjudicate EADs that are outside normal processing times within four hours for customers that appear at local offices

My husband's EAD renewal was filed on 7/21 and his current EAD expires 10/19. We were very worried about it, but today I logged in and saw Card Production Ordered!!! We didn't even get email..no idea why.

Great news for those awaiting EAD renewals

My EAD renewal was filed in mid-August and got approved early September. My husband's was filed in mid-July and is still pending. His current EAD is expiring in a few weeks. We are so worried about his job for that same reason..they make absolutely no sense

Topic: Why are TSC Processing Dates showing as of 7/31/08??

Message posted on 9/28/08 on https://egov.uscis.gov/cris/jsps/Processtimes.js... states these dates are valid as of 7/31/08. That would explain why we haven't seen any movement..but why in the world is it showing as of an old date? If we are to contact them when our dates are current, how are we supposed to know if they are current?

Agreed. My job titled changed several times. My lawyer says there is only 5% chance (in my case) for INS to ask for EV and if they do, employer has to respond that the original job is available to me. If I were you, I wouldn't bother - unless your employer is paying the lawyers that is.

I did describe what my lawyers said in the original post - in case your request was directed to me. They said it's ok to move jobs with I-140 and I-485 pending as long as employer is willing to commit that the LC job is available to me.

I wanted to try one more time - has anyone been in the situation I described above and able to offer advise? Talked with lawyer again today and he said that Immigrations are only about 5% likely to even ask for proof of the job and if they do, employer can write letter, which in this case can fully legally claim the job is available to me. I am just looking for second opinion.

Hello,

I need your advice on the following case. I have already checked with my lawyers, but need the real life experts' opinions too:

- Both I-140 and I-485 (concurrent) pending at TSC for more than 180 days
- I have offer from my employer to swap jobs with another employee from the current job I have (that was advertised on LC) to another that is similar enough to qualify for AC21 (but of course I am not eligible for AC21) but by all means not the same. Has some overlapping duties.
- Lawyer says I can do that because since it is a swap within same department and company is willing to swap us back if needed, then my original job is technically "available to me."
- I have all support from HR and senior management
- The swap is within the same division whose head sponsored my green card application, so technically he can swap employees however he wants
- I work at top Fortune corporation and have a reputable law firm

The offer is left completely up to me. My employer offered it only in terms of my own development and flexibility and has made it clear there is no pressure. I want to take it and my lawyers say it is ok - they say no documentation or anything else is needed.

Has anyone been in a similar situation and can you offer any words of advice?

I have been watching http://www.immigrationwatch.com/ and this whole week I haven't seen a single processed I-140 at the TSC. Does anyone know what's wrong? Are they on an extended lunch break?

Topic: Impact of Job profile change or promotion on pending I-485

I'm in similar situation. I-140 and I-485 are pending. I started as "Project Manager", then got promoted to "Sr. Project Manager" (still no people management directly) then after a restructure in our department, several people got assigned to report to me. Essentially, my job duties did not change except that I have the employee supervision now in addition to what I had before. My title in the system changed to "Sr. Manager," but I am still in the Projects department. My lawyers (both the H1B and the GC lawyers) did not express any concern. My advertised job did not explicitly state that I would or would not be managing people and I had the word "manager" in the title to start with...So, I hope that's ok.
